Waltz has been careful not to take the bait, because doing so would hand Trump exactly the pretext he wants to invoke the Insurrection Act.

Instead, Waltz has outsmarted him. He has deliberately avoided deploying local law enforcement or the National Guard, choosing instead to draw a clear line that enough is enough and allowing people to document, share, and peacefully protest.

That approach is steadily burning ICE's public image and credibility. As more evidence of their conduct comes to light, particularly who they are actually targeting, not hardened criminals or organised gangs, it is damaging both ICE and Trump on the national stage.

So now the next move is obvious, lean on a compliant and politicised DOJ to manufacture a justification for the Insurrection Act since Trump has been outsmarted by Waltz.
