Labor And Unions Slam Govt Superannuation Amnesty

Labor, unions slam government superannuation amnesty

The New Daily The New Daily
Feb 24 2020

The Labor Party and unions have slammed new legislation giving a one-off amnesty to employers who haven’t paid workers’ superannuation entitlements.

Under the legislation passed on Monday, employers would need to come forward voluntarily, without direct prompting from the tax office, and pay all employee entitlements.

Penalties and administration fees would be waived to allow payments to be tax deductible in the same manner as regular super contributions.

Employers who failed to voluntarily come forward during the amnesty face fines of up to double the unpaid entitlements.

The Coalition legislation was backed by crossbench senators, while Labor and the Greens voted against it.

Australian Council of Trade Unions president Michelle O’Neil said superannuation formed a major part of the wage theft crisis gripping the country.

“This law will recover a tiny fraction of the billions in super estimated stolen since the beginning of the system and will do nothing to change behaviour in the business community,” she said.

Unions want the right to superannuation included in the National Employment Standards so repayment can be more easily pursued.

“This is a shameful act by a government which it seems will stop at nothing to cater to employers at the expense of working people,” Ms O’Neil said.

Labor frontbencher Jenny McAllister said the amnesty was unfair.

“If you are an employee and you steal from your employer, you have the book thrown at you. The police will come around to your place,” she said.

“But, under this government’s plan, if you are an employer and you want to steal from an employee, no worries, so long as you say sorry.”

Liberal Senator Andrew Bragg said Labor opposed the measures because union-linked industry super funds rejected any changes to the system.

“There is no other way that these workers will get their super back. This is the only chance,” he told Parliament.

“Voting against it and arguing against it is arguing against the workers that people on the other side of the chamber purport to represent, which is just extraordinary.”

The measure is expected to recover $160 million in unpaid retirement savings, with 7000 employers already coming forward and the same amount expected to own up once the bill passes.

Super should be paid by employers along with your PAYG tax to ATO.

Workers should just have to notify ATO of their Super fund

Why have laws at all....Just let business do what they want and if they get caught let them off without paying interest on the stolen wages (super) or even face a fine....Why would anyone not take advantage of the Australian taxpayer (worker) when this Government will support your corruption....No doubt the Morriscum Government believes it has no duty of care towards workers???

The Lefties simply do not understand how complex the pay rates rules are and how easy it is to misinterpret them and OVER and UNDER pay employees.

Of course the GetUp! slime etc ignore any OVER payments because this does not serve their nefarious purpose of trying to send Australian companies bankrupt as they pursue the LIMA Declaration of sending Australian jobs overseas.

What a bunch of anti-Australian traitorous creeps.

The big problem with this scheme / rort is that it does nothing about the decades of lost interest. The amount paid back may be no more than 10% of the value of the lost investment - 10% of the value to the employee of what has been stolen.

The positive about the scheme is that it is better than nothing. Maybe not by much but better.

In face of national crisis, Morrison pardons historical theft of super payments
24 February 2020
ACTU

In face of national crisis, Morrison pardons historical theft of super payments

With daily revelations of wage theft dominating the start of the new parliamentary year, the Morrison Government has today passed a bill which will waive penalties for employers who have stolen superannuation from workers.

The bill protects employers from prosecution by the ATO for any theft of superannuation back to the birth of the system, regardless of the size of the theft or the intent of the employer.

This is an unprecedented move by a federal government – blanket pardoning of a serious contravention of federal law, with no caveats or limits. The Government has said publicly that if employers cannot determine the extent of their theft before the end of the amnesty, it will be extended.

Quotes attributable to ACTU President Michele O’Neil:

“We are living through a national crisis of wage theft and superannuation forms a significant part of this issue. Instead of punishing the employers who have been stealing money from their employees, potentially for decades, the Morrison Government has waved them through without any penalty whatsoever.

“This law will recover a tiny fraction of the billions in super estimated stolen since the beginning of the system and will do nothing to change behaviour in the business community.

“The Government has had seven years and has done nothing to help workers with unpaid super. Workers need their right to Super included in the National Employment Standards so that repayment can be easily pursued and have super paid at the same time as wages.

“The best way to stop wage and super theft is to allow unions to once again conduct compliance checks in workplaces to end this epidemic of ripping off workers.

“This is a shameful act by a Government which it seems will stop at nothing to cater to employers at the expense of working people.

“The ACTU will continue to explore all available legal avenues to ensure that working people get the money they are owed and that thieves are held accountable for their actions.”

That would be a very sensible reform. That's why the corrupt Morrison government won't consider it.

My understanding that if back dated super is paid then the amnesty applies. Pretty good idea if you think about it.

As long as they also pay the interest that they would have received from their dividend....Otherwise they are still stealing without penalty and being aided by the Morrison Government in doing so???

Huh Huh Huh
