Grin Grin Grin That's almost as funny as the way you're defending him Aussie.

First you talk about him being the sole shareholder so he can do what he likes with the profits ...

The company is in trouble ..... the receivers are in ....

and now he's one of the creditors?  Grin Grin Grin

Too ferkin funny Aussie ... fairdinkum ... last shower & all that ......

His company QLD Nickel of which he is sole shareholder of therefore the owner & solely responsible for it's debt owes rail company Aurizon $27 million alone for rail cartage

he's not a creditor .... he's a debtor.

Like him you're all for smoke & mirrors bullshyte to hide the truth.

I am not 'defending' him.  I'm pointing out the facts.

Quote:

That's correct. As the sole shareholder he is entitled to.  What do you reckon the outcome of any shareholder's meeting would be?

Quote:

If he has lent to the Company, yeas, he is a creditor of the Company.

So that's water on you.  I thought you were salivating that Clive is copping flack.

Nah.  The Company is solely responsible for its debts.

Incorrect.  The Company and Clive Palmer are separate and distinct legal entities.

The  smoke and mirrors are from the hostile and politically motivated Murdoch schmedia empire which has been chasing Palmer for at least three years, painting him in the worst possible light in every scenario.

Don't know, but I doubt it.

you should read your own links...

you dont get it do you... it isnt his own business...

when you borrow money.using it as collateral . it it is no longer yours to do with as you please...

what he is doing is not showing his financial reports.. its not listed on the stock exchange so no watch dog....

if you wanted to use your taxi or your home..as collateral to borrow more than your interest in it was worth...and or value of it was worth..

how do you think you would go???..

Palmers business has lost enormous value...not only on paper but in reality..

if Palmer was going to really prop QLd Nickel. up..

why didnt he come across with that BEFORE THEY RAN OUT OF CASH?????>..

he is blinding everyone with his methods.. dont forget he is a SELF PROCLAIMED BILLIONAIRE...

pity some of us dont believe him isnt it???.

Queensland Nickel: Clive Palmer 'could be liable' if he acted as QNI 'shadow director', lawyer says

Quote:
Clive Palmer could be held personally liable and face a hefty compensation payout if he is found to have operated Queensland Nickel as "shadow director" while the company was insolvent.

The billionaire MP has warded off accusations he has been secretly running the troubled refinery, maintaining that he retired from the company in 2013 when he entered the political arena.

But Mr Palmer admits he did remain part of an expenditure committee, and signed off on company purchases using an email under the name Terry Smith.

According to corporate law Professor Ian Ramsay of Melbourne University, it is possible for "director's duties" to be imposed on people who are not properly appointed as a director.

"If they are found by a court to be either a de facto director or a shadow director and also found to have breached their duties, that person can be personally liable and possibly be held to pay compensation," he said.

Professor Ramsay said if Mr Palmer was found to have been operating in the capacity of a director of Queensland Nickel, the implications could be significant.

"In particular, important director's duties apply to that person, and if a court finds that one or more of those duties are breached, then personal liability can be imposed on that person."

Professor Ramsay said "director's duties" included the duty to exercise reasonable care and diligence, to act in the best interest of the company, and not to have their company trade while it is insolvent.
