Woolworths and Coles face court over discount scheme

Neve Brissenden

Mon, 23 September 2024 at 10:22 am AEST·2-min read

Australia's two biggest supermarket chains will face court after allegedly misleading buyers with fake discounts.

The Australian Competition & Consumer Commission launched legal action in the federal court against Woolworths Group Limited and Coles Supermarkets Australia Pty Ltd on Monday.

The watchdog claims both retailers bumped the prices of products by 15 per cent for brief periods before placing them in Woolworths' Prices Dropped promotion and Coles' Down Down promotion at prices lower than during the price spike but higher than, or the same as, the regular price.

ACCC chair Gina Cass-Gottlieb said the duopoly breached consumer law by making "misleading claims about discounts, when the discounts were, in fact, illusory".

"We also allege that in many cases, both Woolworths and Coles had already planned to later place the products on a 'prices dropped' or 'down down' promotion before the price spike and implemented the temporary price spike for the purpose of establishing a higher 'was' price," she said.

The ACCC found some products were subject to at least 15 per cent increases for brief periods before being placed in the discount promotions.

It conducted an in-depth investigation using industry contacts and social media monitoring.

The ACCC estimates tens of millions of products have been affected and argues that it diminishes the ability of consumers to make an informed choice.

The legal action follows a Senate inquiry into supermarket prices and calls for the sector to be overhauled to ensure people can afford everyday items during a cost of living crisis.

SBS News has contacted Coles and Woolworths for comment.

I was confused why Albo was all over the media announcing this when it’s obviously the job of person in charge of the ACCC.

I google and found out why-

Chair Gina Cass-Gottlieb

Labor’s leader of faces less men would never allow a woman to say anything important!

For anyone who still believes there's any difference between the Labor and Liberal Parties.

I wonder what the few remaining socialists in the ALP feel about Albo having such pro-capitalism rhetoric

Yes, but I also wonder if there are ANY socialists left in the ALP these days?

If Coles and Woolies made all their goods free the whiners would complain that their free money is devalued by their action because they can't spend it on free goods.

Every retailer in the world, including those in alien worlds outside Earth's galaxy uses this sort of practice.

The only ones that don't do it are those in strictly communist countries where the price is fixed.

Discounts are a way of disposing of excess stocks especially ahead of the arrival of new stocks of goods.

I have never trusted sale prices.
I actually kept records of a few jewellery shops once when I was looking for a watch.

The sale prices were up to 3 times more expensive than the same watch on EBay out of Singapore.
I ended up buying the same watch for $217 out of Singapore - delivered -
when the sale price here was $640.   Grin

Prices at Jewellers are usually at least 6x ex-factory price of goods.

Bobby's Singapore Supplier also made a decent profit.
