The White Australia Party is in the High Court challenging the hate laws they were banned under. But the most interesting thing in that courtroom isn't what they're arguing. It's what the government is arguing.
The Commonwealth's position, in their own written submissions, is that the smaller the group, the less difficult it should be to justify banning it.
That's the argument I want you to sit with for 44 minutes. Because if size works against you rather than for you, the question stops being whether these laws apply to them, and starts being whether they apply to you.
I've worked all three sides of this system. Cop. Prosecutor. Defence lawyer. So when I tell you the law doesn't work the way you assume it does, I'm not guessing.
