Western Australia moves to ban no grounds evictions, but industry warns there would be ‘no winners’
Another Aussie state has moved to ban no-grounds evictions for tenants, despite warnings from housing industry figures there will be “no winners” from the decision.

No grounds evictions will be banned in Western Australia under new tenancy reforms aimed at improving housing security for renters, as the state grapples with one of the nation’s most severe housing shortages and affordability crises.   Smiley

Under the proposed changes, landlords would be required to provide a valid reason to end a tenancy — such as, when an owner or relative intends to move in, the property requires a substantial renovation or demolition, or a tenant has repeatedly breached the agreement.

In addition, tenants may need to vacate a property if it is sold, they have not paid rent, or illegal activities are carried out at the property.

The WA Government will ban no grounds evictions and restrict the types of information landlords can request from tenants.

The types of information landlords, agents or third parties can request from prospective tenants will also be restricted under the reforms.

Tenants must also be provided with one avenue to pay their rent without incurring fees.

The Department of Local Government, Industry Regulation and Safety will consult on the detail of these reforms during the drafting process.

Premier Roger Cook said the laws would help sure every Western Australian had a place to call home.

“Ending no-grounds terminations and replacing them with commonsense reasons for landlords make Western Australia’s rental market fairer,” he said.

“This next wave of residential tenancies reforms builds on our previous changes, which included a ban on rent bidding and limiting rent increases to once every 12 months.”   Smiley


Premier Roger Cook said the laws would help sure every Western Australian had a place to call home.

Commerce Minister Tony Buti said the government was committed to reform that ensures fairness and that includes making sure no Western Australian loses a private tenancy amid a rise in cost-of-living pressures.

“This has flow-on benefits for the community,” he said.

“At the same time, the next phase of tenancy reforms demonstrates our commitment to providing stronger protections for renters and a fairer, more secure housing system for all.”

Real Estate Institute of Western Australia (REIWA) president Suzanne Brown said the organisation was deeply concerned about the inclusion of no grounds evictions in the next review of the Residential Tenancies Act, warning there would be no winners.

“Our objection to the removal of no grounds terminations should not be seen as being anti-tenant or pro-landlord; it’s about ensuring the viability of WA’s rental market,” she said.

“Across the state, the rental market has not fully recovered from the mass exodus of investors post-Covid. Western Australia cannot afford to lose any more rental properties.

“Another drop in supply will see the vacancy rate fall, competition for available properties increase, and even more upward pressure on rent prices.”

REIWA President Suzanne Brown said WA’s rental market has not fully recovered from the mass exodus of investors post-Covid.

End Unfair Evictions campaigner Jesse Noakes said there was no evidence from any other state that ending unfair no grounds evictions had an impact on rental supply.

“Even if a property investor sells a house, it is not as if it disappears into a puff of smoke. Either it houses someone who was previously renting, or it returns to the rental market,” he said.

“Rental supply in WA has fallen from more than 14,000 in 2018 to just 3000 properties this year, according to Anglicare. The rental market can’t get any worse – this can only make things better.”

End Unfair Evictions campaigner Jesse Noakes said rental supply in Perth had fallen to just 3000 properties this year, and the reforms could only make things better.

So what happens when a tenant trashes the house but you have a long legal battle to kick 'em out?

(I've never been a landlord, but we see examples of people trashing houses on a regular basis on the nightly current affairs shows ... often it is extremely difficult for the owners to get rid these types of tenants.)

I blame Albo and his mass, uncontrolled immigration policy
when there were not enough places to rent.

He's like a hotel clerk who overbooks the rooms.    Roll Eyes

Expect to see a BIG increase in these after the "reforms" come into effect.

And, I'm sure scumbag real estate agents (that's all of them, by the way) will already be working on ways to get around all this.

It's what they're best at (being greedy scumbags forcing house prices and rents up all the time).

How does a tenant prove the owner or relative is not moving in?

Our politicians are  over paid ego tripping and need to be stopped.

If you own a property you  choose to rent out you shouldn’t have to worry about  anymore  new  laws than existing now .
The ones we have in place now I believe are completely adequate.

Ffs.

It will soon be a case of the renter has more legal rights than the property owner!

People are perfectly able to communicate effectively without more laws made by corrupt politicians.

I have been a landlord but not now.

My current residence is provided by my employer and is part of my salary deal so I can say Im a renter.

I need my tv fixed.

Whenever.

They will sort it and pay for it, whenever.

All good.

I have an inspection, I clean the place like a barracks.

All good. The owner is stoked and I feel great living in a super nice clean place.

I asked permission to have three goats (herd animals, cruel to only keep one).They said I can have one cat.

All good.

I don’t need politicians to make new laws.

Renters have ample rights now.

Seriously, our politicians would do better to start removing laws that have been passed since federation  and completely outdated than constantly telling people what they are allowed to do with something they personally own themselves?

Labor have made owning your own home unaffordable for younger people so now they try to stop renters from being evicted.

Landlords already have enough trouble trying to evict problem tennants
