Reuters —  Australia’s most decorated living soldier has been arrested over five counts of the war crime of murder while on deployment in Afghanistan, local media reported on Tuesday.
The man, whom police identified as a 47-year-old former Australian Defence Force member and media named as Ben Roberts-Smith, was arrested at Sydney Airport on Tuesday morning.

He will be charged with five counts of war crimes in connection to the murder of five people in Afghanistan between 2009 and 2012, Australian Federal Police (AFP) said. The maximum penalty for each charge is life imprisonment.

Roberts-Smith was hailed as a national hero after being awarded several top military honors, including the Victoria Cross, for his actions during six tours of Afghanistan from 2006 to 2012.

He has consistently denied allegations of wrongdoing during his service, some of which were first reported by Nine Entertainment newspapers in a series of articles starting in 2018.

Among the accusations reported were that Roberts-Smith had shot dead an unarmed Afghan teenager and kicked a handcuffed man off a cliff before ordering him to be shot dead.


I just watched his arrest on TV, and he wasn't handcuffed.

He's being charged with five counts of murder, and he gets to walk to the police car unrestrained?

Seems odd.

It's all hearsay - and if there hasn't been enough evidence/proof after 10 years then how on earth is it now any more provable beyond reasonable doubt?

Their killer was tracked down after having been helped to escape by the TALIBAN - and he fled to Pakistan.

He was tracked down by our SAS soldiers - BRS being one of them.

Yet he now lives free as a TALIBAN HERO who vows to keep killing foreigners & Australians.

He will be facing criminal charges(war crimes) in a criminal court.

The civil court procedings have long gone.

But what does it have to do with the arrest of Ben Roberts-Smith?

You seem to be quite worked up about this and I don't understand why.

Again:

1. I have no dog in this fight.

2. I maintain that he's innocent until proven guilty - I have no opinion on his guilt or innocence. I'll wait to see what the courts decide.

Moreover, I have no beef with the SAS (a close relative of mine served with them).

All I did was ask a question and state a fact:

Question: Why wasn't he handcuffed when arrested? I thought someone charged with multiple murders would be restrained.

Statement of Fact: He didn't apply for bail. It seemed strange to me that he didn't want to get out of there as soon as possible. I certainly would.

You seem to be picking a fight that's not there - I am 100% neutral on the subject.

The innocence of any of the so called Afghani citizens is something that hasn't been proven correct in the whole time this witch hunt has been on.

The town was a known Taliban stronghold & many of the inhabitants were spotters for the Taliban ... including the bloke BRS is accused of killing & kicking into a ditch.

No one outside the theatre of action/war has a right to condemn him on unreliable hearsay - especially a Taliban governed Afghanistan looking for Aust govt/taxpayer reparations.
