War is brutal and most people expect that there will be things done that are best left alone. So where was this lowly corporal's commanding officers? Surely they have some responsibilities in this. Yet he was recommended by those officers for his many acts of bravery. The Victoria Cross, the Medal for Gallantry and the Commendation for Distinguished Service - how did they come about? Seems there might be some cases of jealousy playing out here.

That’s been asked a few times in this thread. I will offer this opinion.

The winner writes the history.

Do you think any of the Nazi would have faced war trials if they had had won?

Why do you expect the Taliban to act any differently?

Does not anyone else understand that this is a very serious legal precedent.

This is a military matter not a civil matter .

This should have been heard and dealt with in a military court and has no place in a civil court.

Why has all legal precedent and military protocol been ignored?

I strongly suggest ( again) that in a civil court action none of the officers or commanders of Ben ( war criminal) Smith will be either named or examined.

In a military court that would be the complete opposite. Ben ( war criminal) Smiths officers would be examined and possibly prosecuted.

SAS went completely rouge and it wasn’t an uprising led by a mild corporal.

Ben ( war criminal) smith is the victim of some of the very worst leadership ever displayed in the field by Australian military officers.

Who remain unnamed and never heard answer a question about what “they” were directly responsible for.

The fix is in for Ben ( war criminal) Smith.

Ben ( war criminal) smith is being trialled in a civil court.

The two have no comparison.

The little I have read I believe mordants superior officer escaped being shot but was sentenced to life imprisonment. This was changed to 4 years.

Non of this has absolutely anything to do with Ben (war criminal) smith situation.

He facing criminal charges in a civil court.

His direct and indirect leaders are not relevant to the civil court proceedings.
