So, you're saying that if a soldier absconds from his unit and, say, murders someone, his commanding officer is also culpable, or, in BRS's case, that the commanding officer knew or should have known that BRS would or had committed murder?
I’m not saying it. International Law says it, in regard to war crimes.
It goes back hundreds of years and Commanding Officers have been found guilty and in some cases executed, just as we executed German Generals under this law, and in one case at least, where he could not have possibly known.
Australia has ratified the International agreements on this law so should implement it.
It is, of course, a rather stupid law, but then Australia has many stupid and unjustifiable laws.
