The enemy:



Hekmatullah, the rogue Afghan soldier who killed three unarmed Australian diggers in Afghanistan a decade ago, is living in a luxury home in the capital Kabul, treated as a “returning hero” by the Taliban who released him from prison.

He has said he does not regret killing Australian soldiers, and has vowed he would again kill Australians, or anyone who opposes the Taliban.

“If I am released I will continue killing foreigners,” Hekmatullah told an official of the former Afghan government when his release was being negotiated.

It's more than likely that there is an international component to this.

The unnecessarily maximally visible and dramatic arrest of BRS was likely not for Australian eyes. His arrest was clear and obvious via video footage, even with the sound turned down (i.e. no translation required).

Of course, BRS only has himself to blame for any international pressure. His decision to sue for defamation resulted in an Australian court finding that he probably committed murder(s).

From an international perspective, what else should result from an Australian court finding an Australian probably committed murder(s) if not the case being taken up by a higher court to determine if his guilt is beyond a reasonable doubt?

The arrest of BRS has absolved the Australian government of international accusations of ignoring or disregarding possible injustice meted out to Afghan citizens.

Advocates are not witnesses.

When the advocate represents a state actor/nation-state you have the certainty of political pressure on the Australian government to act.

Not necessarily. The thing is; the process has begun. There is no more pressure other than to follow the rule of law. Unless the government wants to bow down to them.

The Australian government has likely already submitted to international political pressure by the Hollywood-style arrest of BRS. It has now absolved itself of any further action as the case is now before the courts.

It is ridiculous and dangerous to treat them as equals.
