OK I took that as evidence within criminal law by media, government statement and so on. You meant in a criminal court case. And you are correct.

I think of a parallel in WWII.
'The Lidice massacre was a brutal June 10, 1942, Nazi reprisal in the  Czech Republic, where German forces destroyed the village, murdered 173 men, and deported women and children to concentration camps. This is the thing and I’m careful what I say.

There are no rules in war or combat situations.

The only thing close to what may be considered a “ law” in a combat situation are orders and tasks requested off you.

That’s as clean as I can describe it.

You do as your told.

It maybe wrong, it’s often evil but you do your task till you can physically no longer do it anymore.

Rules?

They didn’t exist in the jungle and I doubt they existed in the desert.

What does exist above all else is  company culture, structure and respect for the command structure/ rank.

It’s my personal opinion that the company culture, structure was the worse seen by any Australian fighting force in decades.

The  Ben ( war Criminal) smith is being held for others failing at several higher rank.

How many others drunk beer out of the  dead Afghan artificial leg?

I suspect those that didn’t may have turned  undisciplined eye while in the role of enforcement of discipline?

Anyone got photos that they can post of Australia war  veterans and their transport proudly displayed the Nazi flag while on tour in Afghan?

Does that make anyone here proud?


Because what you are seeing is what was once an elite Australian unit being led by completely useless/ stupid/ idiotic officers.

It’s no doubt we lost the war under the command and leadership of those far higher up than corporal Ben ( war Criminal) smith.

I will not answer questions on what my experience may or not be.

I share enough and ask you respect my privacy.

I will add.

There was a command structure of rotating each commander out and having them replaced.

The primary purpose of this was because the commander was so incredibly stupid / useless he required retraining every six or so months.

Again, that may be true but dodgy leadership can't be used to change what is law.  It's common knowledge that ADF, the diggers of Anzac, don't shoot prisoners.  They don't torture, don't take out anger by beating up captives and do give first aid to enemies even while still in their trench after surrender.

The background may reduce jail-time (if any) but it can't change the law on murder.  Kids know what murder is.

On another note it seems members of the AFP are also not on board with the  method of arrest of Roberts-Smith. Also the head honcho's many participation medals as compared to his. Cool

Oh  dear.

The Gallipoli  Turkey female sniper on the slopes of  Gallipoli early in the utter defeat of Australian ( I must mention the complete  destruction of the English forces on landing, casualties far greater than Australia) was mentioned in war reports.
She caused maximum casualties from a position of no retreat.  As the report states she was knocked unconscious by a grenade .

On regaining consciousness she found herself in the same position only with her arms and legs spread eagle and tied to  imbedded bayonet.


She was used often as  Australian troops went forward to reward their sexual needs.

She was eventually shot dead out of hand by a private who gave pity on her.

There are no rules in war.

It matters nothing life.
