Some were. Were they also targeting drink drivers or were they concentrating on Freeman.

That's irrelevant to your idea that the gunman is similar to the captive. Freeman and drunk drivers are all law-breakers in Australia, so on your idea, drunks can be shot because of Freeman's crime. Drunk drivers could kill someone.

When you think civil evidence equates to criminal evidence, that can't be the case. BRS has not had any criminal evidence against charges as yet.

Goodo. That's not your issue about the gunman and Afghans in general. So I take it you accept the idea that the Geneva Convention on POW remains in force for ADF.

You write as if the gunman shooting trainers is fact and it had real connection with the POW being killed as a fact. Facts can't be called 'civil' or 'criminal', it's the court's opinion which defines the type of intent of a person. 'Beyond reasonable doubt' of a criminal mindset is the high level that the case will try to reach.

The matter of the Afghan gunman, unlawful combatants and spies etc then may be relevant for reducing the jail-time sentence, if one is given.  The conditions were stressful, but so is standard war against a regular army.  No-one expects regulars to email
'we're ambushing you at the village tomorrow. We have 200 troops, mortars and lots of bullets'.

While captured spies are not entitled to prisoner of war status and may be the subject of derogations from certain rights under IHL, they are not entirely without legal protections. For example, a spy cannot be kept entirely incommunicado and retains the right to humane treatment and a fair trial.

Consequences of Not Wearing Uniforms:
Loss of prisoner of war status and protection.
Liability for prosecution and punishment by military tribunals.)

So the captive Afghan is not called 'POW' but the legal protection still applies.
LWP-G 0-1-7 Internment and Detention 2007 is the ADF order.

You should volunteer for the next OS engagement our troops are sent into.

But I'd warrant you wouldn't even pass basic training in any branch of the ADF.
