So far, available accounts suggest the man intervened after witnessing an ICE agent pushing a woman, at which point he was pepper sprayed, taken down by multiple agents, and further sprayed in the face. Footage and eyewitness descriptions indicate that while on the ground, with his hands covering his face, he was shot while in ICE custody, with multiple rounds fired in rapid succession.

That sequence of events, if accurately reflected by the available material, raises serious and unavoidable questions about the use of force and the conduct of the agents involved.

What the videos show:

- ICE had pepper-sprayed him
- Disarmed him
- Had him subdued on the ground
- At the time of the shooting, he had both hands on the ground in front of him

Just like with Renee Goods, nobody was in danger other than the victim at the time of the shooting.

DHS spokesperson Tricia McLaughlin said in a statement that agents fired "defensive shots"
after "an individual approached U.S. Border Patrol officers with a 9 mm semi-automatic handgun.

It is difficult to reconcile claims of defensive fire with the available footage. The man had been pepper sprayed, disarmed, and subdued, with his hands clearly visible on the ground in front of his face.

At most, the most benign explanation I can conceive is that when the individual in the grey jacket was taking the victim's firearm, the weapon was not properly secured and discharged accidentally, spooking the other agents and prompting them to open fire, the familiar "acorn" defence and they unloaded entire magazines into him...

Regardless of which explanation is ultimately advanced, the outcome remains the same.
