Moslem defense against a charge of racial hatred
Reply #1 - Jun 11th, 2025 at 9:08am

Moslem defense against a charge of inciting racial/cultural hatred.

He has been 'sued', IN AUSTRALIA, with words [in a religious sermon] which could incite racial/cultural hatred.

"......he is alleged to have maligned Jewish people
as “vile”,
“treacherous”
and cowardly."

A moslem cleric, IN AUSTRALIA, is essentially publicly saying, that describing disbelievers
[i.e. ALL disbelieving Australians]
as vile and treacherous, is permissible and lawful,
[and, presumably then, his view would be that it is also permissible for >> every devout Moslem, IN AUSTRALIA <<
to express such views, about ALL Australian disbelievers]
because this hatred [of disbelievers] is expressed within the HOLY Koran, and the Hadith.

i.e.
This moslems' defense [in an Australian court] against a charge of inciting racial/cultural hatred,
is that because these views are expressed in the HOLY Koran, THEN IT IS LAWFUL [an act of 'religious freedom'] FOR THE DEVOUT MOSLEM TO OPENLY EXPRESS THIS RACIAL/CULTURAL DENIGRATION TODAY,
IN AUSTRALIA.

denigrate = = criticize unfairly; disparage.

"LOOK !!!   It's in the book - so it's OK.
....IT IS LAWFUL."

Australia:
Muslim cleric sued for antisemitism says his case is ‘a battle between Islam and kuffar’

Jun 10, 2025
By Robert Spencer

......A Sydney Islamic cleric being sued in the federal court for alleged racial discrimination of Jewish people
has described his case as an existential battle “between Islam and unbelievers”.

........The lectures quoted ayat and hadith from the Qur’an about Jews in Medina in the 7th century and, the federal court claim alleges, made derogatory generalisations about Jewish people......

........Haddad’s defence case argues, his sermons were delivered in “good faith” as religious and historical instruction.

If his sermons are found to breach 18C, then, he argues, the law is unconstitutional
because it restricts the free exercise of religion.

AL WALAA WAL BARAA, "Islamic jurists"

Essentially, this translates as;

".....loving and hating for the sake of Allah."

It means, LOVING your moslem brothers.   .....as per ISLAMIC religious precepts.

It means, HATING the disbelievrs.   .....as per ISLAMIC religious precepts.

It means, being a moslem.

It means, OBEYING ISLAMIC LAW !

Pure Al-wala' wa-l-bara' in the Koran....

"Thou wilt not find any people who believe in Allah and the Last Day, loving those who resist Allah and His Messenger, even though they were their fathers or their sons, or their brothers, or their kindred...."
Koran 58.22

"O ye who believe! Choose not your fathers nor your brethren for friends if they take pleasure in disbelief rather than faith. Whoso of you taketh them for friends, such are wrong-doers."
Koran 9.23

"Ye [moslems] are the best of peoples, evolved for mankind, enjoining what is right, forbidding what is wrong, and believing in Allah. If only the People of the Book had faith, it were best for them: among them are some who have faith, but most of them are perverted transgressors."

Mr Wertheim and Mr Goot are seeking a declaration that Mr Haddad contravened section 18C of the Racial Discrimination Act – which makes it unlawful for a person to “offend, insult, humiliate or intimidate” someone based on their race or ethnicity.

They also seek injunctions to have the speeches removed from the internet and restrain Mr Haddad and the centre from publishing similar content in the future.

Alongside this, the Jewish leaders want the respondents to publish a corrective notice on Al Madina Dawah Centre’s social media pages and are seeking an order for costs.

Mr Wertheim said the ECAJ’s action in the Federal Court came after a failed bid to the Australian Human Rights Commission, “but a conciliated resolution could not be achieved”.

“Accordingly, we have commenced proceedings in the Federal Court to defend the honour of our community, and as a warning to deter others seeking to mobilise racism in order to promote their political views,” he said in a statement.

Mr Haddad's lawyers denied there was any breach of the Racial Discrimination Act and said the speeches were directed only at practising Muslims.

They further argued the centre was not a public place because members of the public do not have access to it as a right — its attendees must be either Muslim or permitted by a member of its committee.

Mr Haddad's legal team says that if the court does find there was a contravention of the law, then that section of the Racial Discrimination Act is unconstitutional because it would be prohibiting the free exercise of religion.

In defence documents, Mr Haddad argued the speeches were derived in substance from the text of the Koran and Hadith — reports believed by Muslims to be the words of Mohammed, his family and companions.

Zionists have a long history of claiming antisemitic, as Peter cried Wolf.

Do we get to see the exact, full, and unadulterated lecture, so to draw our own conclusions?

Q.
Considering the quotes above........
Are these KORAN verses [below], also, now to be regarded as 'protected speech', whenever uttered by devout followers of ISLAM,
in Australia ??
.....because they "......were derived in substance from the text of the Koran." ???

"If anyone desires a religion other than Islam (submission to Allah), never will it be accepted of him;...."
Koran 3.85

"And fight with them until.....religion should be only for Allah,..."
Koran 2.193

"Allah hath purchased of the believers their persons and their goods; for theirs (in return) is the garden (of Paradise):
they fight in His cause, and slay and are slain:...."
Koran 9.111

"O ye who believe! Fight those of the disbelievers who are near to you, and let them find harshness in you, and know that Allah is with those who keep their duty (unto Him)."
Koran 9.123

"....take not the Jews and the Christians for your friends....
......he amongst you that turns to them (for friendship) is of them."
Koran 5.51

n.b.
those words......
".....he amongst you that turns to them (for friendship) is of them."

This is    >> religious instruction <<   to every follower of ISLAM,
...that in BEING THE FRIEND of disbelievers,
a former moslem would be 'ex-communicated' from ISLAM.
.....and therefore as an 'apostate', he/she, would be worthy to be LAWFULLY killed [e.g. 'honour killing' victim],
to be eagerly performed by one of your former co-religionists.

That, is what Koran 5.51 is saying !!

Instruction from the prophet of ALLAH,

"...the Prophet said, 'If somebody (a Muslim) discards his religion,
kill him."

FURTHER CONFIRMATION.....

.....regarding what officially 'constitutes' apostasy....
.....to the devout follower of ISLAM......

ISLAMIC LAW....
"Ibn 'Umar related that the Messenger of Allah, upon whom be peace, said, "I have been ordered to kill the people until they testify that there is no god except Allah, and that Muhammad is the Messenger of Allah, and they establish prayer and pay the zakah. If they do that, their blood and wealth are protected from me save by the rights of Islam. Their reckoning will be with Allah." (Related by al-Bukhari and Muslim.) "
fiqhussunnah/fus1_06

ISLAMIC LAW....
"Ibn 'Abbas reported that the Prophet said: "The bare essence of Islam and the basics of the religion are three [acts], upon which Islam has been established.
Whoever leaves one of them becomes an unbeliever and his blood may legally be spilled.
[The acts are:] Testifying that there is no God except Allah, the obligatory prayers, and the fast of Ramadan."...."
fiqhussunnah/#3.110

n.b.
"Whoever....becomes an unbeliever...
....his blood may   legally   be spilled."

Justice Stewart must now decide whether Mr Haddad's comments violated section 18C of the Racial Discrimination Act.

Mr Haddad argues that, if his comments are found to have been unlawful, the act breaches the Australian Constitution, which prevents the making of laws that prohibit the "free exercise of any religion".

Mr Haddad also argued section 18C would infringe the implied freedom of political communication under the constitution, if his speeches, which addressed the war in Gaza, were found to be unlawful.

If Justice Stewart is persuaded of this argument, he would have to overrule his own conclusion in November that the law is valid in a case brought by Greens Senator Mehreen Faruqi against One Nation Senator Pauline Hanson.

Will muslims argue not being able to kill gays blasphemers and those who leave Islam breaches the Australian Constitution, which prevents the making of laws that prohibit the "free exercise of any religion".?

Pauline was guilty of 18C for telling Mehreen to piss off back to Pakistan.

May Allah continue to have mercy upon Mohamed Morsi and all others who held firm onto the rope of Allah and the Sunnah of Prophet Muhammad (peace be upon him).

What is the minimum wage for an Islamic hate preacher can he afford to pay court costs?

Quote:
A series of lectures delivered by an Islamic preacher at a Sydney prayer centre must be removed from social media under orders from a Federal Court judge who found they contained "fundamentally racist and antisemitic" material.

Justice Angus Stewart today found the speeches contravened the Racial Discrimination Act and rejected Mr Haddad's defences.

Justice Stewart said he was satisfied Mr Haddad and the centre should be ordered to publish corrective notices on their social media accounts for 30 days, but will hear the parties further on the terms.

He said the ECAJ's case had been "overwhelmingly successful" and there was no reason why Mr Haddad should not have to pay costs.

When Mr Haddad stepped into the witness box, he initially appeared to distance himself from the publication of the lectures online, but eventually accepted he was aware they would be published.

Mr Haddad's lawyers also argued that if the court found the speeches were unlawful, a section of the Racial Discrimination Act must be unconstitutional because it would be prohibiting the free exercise of religion.
