The first week of Erin Patterson's mushroom murder trial
outlines the decision facing a jury

When police turned up to Erin Patterson's house, they began looking through the rubbish for a leftover beef Wellington.

An officer walked to an outside bin, put on some gloves, and started fishing inside.

"The bin had approximately three bags piled on top of each other," crown prosecutor Nanette Rogers SC told the Supreme Court in Morwell this week.

"The leftovers, which looked like a meat-filled pastry, were in the bottom of the bottom bag."
As a packed courtroom watched on, pictures of the stale-looking remnants were flashed up on the screens.

What was initially thought to be the source of food poisoning, then became a suspected murder weapon.

Reduced to its simplest form, the jury in Ms Patterson's trial will have to decide whether a beef Wellington cooked in her kitchen represents a terrible accident, or the ultimate act of betrayal.

According to prosecutors, Ms Patterson carefully crafted a plan to lure her in-laws to her home on July 29, 2023.

Mr Mandy asks about Erin Patterson as a mother.

"Her life appeared to revolve around her children," Ms Barkley says.

"Absolutely it did, that's all she appeared to care about ... I thought she was a wonderful mother."

Ms Barkley says the cookbook RecipeTinEats was a prominent feature of the online group's discussion.

She says other members of the group had made beef Wellington before and it was a loved dish for the group.

Ms Barkley tells the court that Erin had mentioned her love of mushrooms to the group.

"I always knew that about her, yep," she says.

Fungi expert agrees death cap mushrooms under-reported in regional areas

Lawyer Sophie Stafford says Dr Thomas May has made clear the limitations of his opinion when looking at the 10 images and where he required further information.

“That is correct,” he says.

Under cross-examination by Stafford, May agrees that death cap mushrooms may not be reported on websites like iNaturalist because there are no regular surveys in the state besides “sweeps” done at some locations in the Royal Botanic Gardens in Melbourne.

He agrees there is an under-reporting of death cap mushrooms in regional areas.

Fungi expert shown pictures of mushrooms in court

Erin Patterson’s lawyer, Sophie Stafford, has begun cross-examining Dr Thomas May.

Stafford is taking May through 10 images of mushrooms and asking him to identify which ones are consistent with death caps.

May says some images do not reflect the actual colour of the mushroom which can make it difficult to determine the species.

For all of these images there might be a possibility … it could be something else.

Looks like Erin won't take the stand.

If it was me on trial and I was innocent there is no way
I could sit there for 6 weeks and say nothing -
I'd want my say in court before they locked me up for life
for something I hadn't done.
They couldn't shut me up and I wouldn't care what my lawyer advised.

She had been an air traffic controller – a very high IQ job -
and the fact she survived eating foraged mushrooms before
meant she knew something about identifying them
or she would have been dead years ago.
Death cap mushrooms are easy to spot and they are the first ones
foragers learn about so they can avoid them.

I think he is talking in general but death caps are easy to recognise.

For a start - they have white gills underneath them.

I’m not so sure that they are so easy to id.
I’m very slowly thinking she might not be guilty .

It’s definitely a case that will stop the mushroom market for a bit and I love mushrooms.

It’s the vegan answer to a steak!

I don’t believe mushrooms brought from a farmer or Woolworths are ever going to be dangerous !

Where did she say she got these mushrooms?
A Asian supermarket?

I suspect she picked them herself completely unknowingly they where deadly.

Even mushrooms experts can get it wrong. It’s not hard to imagine she picked them not knowing.

It’s also easy to believe a Asian supermarket supplier got it wrong but then why didn’t anyone else who brought the mushrooms get sick?

Clearly, this is the government’s fault!!!!!🫠

Mycologist told doctors death cap poisoning should be 'impossible'

A photo is shown to the court, which is the same photo emailed to Dr Truong on July 31.

It shows a picture of the beef Wellington pastry and some of the finely-chopped brown filling.

"I told her based on this particular photograph, I would not be able to give her identification," Dr Truong says.

"She said they had been bought from a supermarket and … a Chinese shop I believe."

Dr Truong says she told Dr Muldoon it was "probably impossible" to be death cap mushrooms, due to them only growing in the wild and being unable to be cultivated.

"I also told her there were absolutely no sightings of death cap mushrooms during the last months," Dr Truong says.

"Based on the information I received, it was highly unlikely to be a case of death cap mushroom poisoning."
