The only 'fish off the boat' you get are those you catch yourself.... the vast majority of the rest are frozen..... and often Asian rubbish caught with mega trawlers depleting the oceans, killing by-catch by the zillions including dolphins, seals and whales, and giving 'the big boys' their mega-profits while people eat shatfish...

A man has been fined after smashing a basketball hoop with an axe because he was fed up with the noise from children playing near his house.

Douglas John Polain, 66, appeared in the Mandurah Magistrates Court on April 23 and pleaded guilty to one charge of criminal damage or destruction of property.

Police prosecutor acting Sen. Sgt Naomi Foster told the court Polain was at his home in Wannanup on March 10 about 5.45pm when about eight children were playing basketball near his house.

When the children continued to make noise while playing, acting Sen. Sgt Foster said Polain went outside and pulled the basketball hoop down with an axe before using it to smash the backboard.

He was later arrested and taken to Mandurah police station, where Polain defended his actions by saying: “I told them to stop, they don’t have any idea of the noise they’re making. They had been screaming and shouting for five hours.”

Polain represented himself in court and said the basketball hoop the children were playing with was set up by a neighbour just 10m from his bedroom and lounge room windows but 30m away from the living areas of the neighbour’s own home.

He read a statement in court saying there had been a “prolonged situation” with children playing with the basketball hoop, which he described as “huge and immovable”.

Polain said he had approached the City of Mandurah several times for assistance with removing the basketball hoop before the incident.

He said his neighbour’s son and friend continued using the hoop after he damaged it and it was eventually disposed of in a hard rubbish verge pick-up.

Polain said he was sorry for his actions and “had no idea it was a criminal offence”.

Magistrate Leanne Atkins fined him $300.

“I recognise the use of systems like this can cause annoyance,” she said.

“However, that does not excuse your taking an axe to it, having told the children to stop.

“You cannot take the law into your own hands.”
