Burger King faces legal claim over size of Whopper

Burger King must face a lawsuit that alleges it makes its Whopper burger appear larger on its menus than it is in reality, a US judge has ruled.

The lawsuit accuses the fast food giant of misleading customers by showing the burger with a meatier patty and ingredients that "overflow over the bun".

"The plaintiffs' claims are false," Burger King told the BBC.

Rivals McDonald's and Wendy's are facing a similar lawsuit in the US.

The class action lawsuit against Burger King alleged that the Whopper was made to look 35% larger, with more than double the amount of meat compared to what was actually served to customers.

Burger King had earlier argued that it was not required to deliver burgers that look "exactly like the picture".

In the ruling, US District Judge Roy Altman said it should be left to jurors to "tell us what reasonable people think".

However, he dismissed claims that Burger King misled customers with its television and online advertisements.

"The flame-grilled beef patties portrayed in our advertising are the same patties used in the millions of Whopper sandwiches we serve to guests nationwide," a Burger King spokesperson said in a statement after the ruling.

Lawyer Anthony Russo, who represents the plaintiffs, did not immediately respond to a BBC request for comment.

All the advertising images lack anything to scale off, so I'm not sure how it is even possible to misrepresent the size. The ratio of the patty size to the bun is definitely different though.

The 1st pic has the meat as thick as the bottom bun.
The 2nd one looks thicker. You're ahead by 2mm making a profit on the deal.

But would you feel ripped off at getting the burger in the 2nd picture?

I don't really care what it looks like. I just never end up feeling as satisfied as I expect.

A couple days ago…. At H.Jacks I thought I would try their crunchy chicken burger out.
I walked into the reception area and stood at the counter waiting to order.
It was about 3.30-4pm
I noted another person before me was ordering on the online screen.
So she stood waiting after.
And we waited and waited….
I noticed there seemed a staff shortage and they were attending to drive through orders only.
It got ridiculous!
The young female standing near me… we looked at each other with a not so impressed concern.
Spoke a few words and I said it looks like they’re understaffed too.

She had enough and started saying as she bent over the counter “excuse me, where’s the manager?!”
And he came and she didn’t mince words. Saying letting an elder person like myself left standing for ages waiting to order etc
I was feeling really “unhungry” after all this!   Grin

She walked out in disgust.
I stood there as another person came in and I asked… “Do drive throughs get served first and more quickly?” He winked and said “You got it, it’s best to, especially at peak times.

It’s too difficult for me to do drive through as I don’t hear the person taking order on speaker. And I want to ask for my seniors free drink too.
Never mind, more personal service is out of fashion.

I recall with R.Rooster when they were understaffed they locked the doors with an apology and to go via drive through.
I will write to H.Jacks to think in terms of doing same.
I am not a confrontational person on the spot… I take it all in and assess, and try to analyse all aspects.
So I’m certain writing with my identity and contact  rather than anonymously, would get more serious thought to it.
Honestly, I’m too frightened to walk into fast food outlets now!
From plodding along thinking of a crispy chicken burger to landing in a big confrontational situation  Undecided

Yes it's fast food, you need to rush up to the counter, lean right across and yell 'quick, I'm hungry'.

Geez I really didn’t know!
I haven’t told the family about it as I’m too embarrassed because being sprung I would cop it like this “what are you doing in those places anyway, it’s all crap fat food and no good for you mum!”

At the 24 hour Maccas close to my place they have terrible fights -
the cops are there nearly every Saturday night.

Hungry Jacks is similar and so is KFC.
Violent drunks turn up and start fights with anyone who looks at them.

I remember when a Big Mac looked a bit like the picture.

How can a quarter pounder size reduce by 30% and still be a quarter pounder ?

With 1/2 kilo of beef I can make 4 quarter pounder size burgers but the math says it's 2.

What I hate are stale posts from 5 days ago at the local fish & chip. Dry toasted buns, cold chips, hard curled up meat. It's just no good.

Everything is nice and fresh at the one I go to -
the chips are hot and crispy - the food smells fresh and good -
even the tomatoes have great flavor.
I think they change the oil often as they never have soggy chips.
The Souvlakis have nice tender lamb or chicken with crispy lettuce.

Find a better place.

If they show the coloured pic and give you a copy and the burger, you've got all they said they offer. Does your fish & chip give you any pics?

yes - and their pic is a bit better than what they serve.
They obviously spent extra time on their hamburger pic
compared with their usual offering.
But still - what they serve tastes good.  Smiley

You're better off collecting all the pics and have something to show for the effort.

We had a good range of chip pics but they all looked the same. Even with chicken salt.

It's too dangerous to sit down at those places.
They have fights all the time.
Always use the drive thru.

He's happy enough about it. I went to a restaurant for a beef dinner. It was a lump of meat and three sticks of asparagus. Absolutely that was all, at high price.

But was it cooked properly - medium rare?

I'll tell you a secret.
The public can't buy those restaurant steaks -
they are sold via the back door to the top restaurants.
That's why they cost so damn much -
up to $100 or more for a 200 gram piece as the customer at the restaurant is served it.
Not only are they juicy and tender they have a strong beef flavor - yummy.

What? The bludgers didn't give me any pics of the back door deal. The menu item said 'beef' and that's exactly what I got so  the magistrate let them off.

Yeah, buying at $100 and selling for $40 could be why they're closed and couldn't give pics or even a cartoon.

they buy for $40 and sell for $100.

food advertisers use a lot of sneaky tricks to make products look more appetising than they actually are when you actually get them. for example the milk depicted in cereal commercials is often glue. burger patties are injected with water to make them look plumper and juicier, etc. photographic tricks using angling and lighting can always make things appear more attractive than they actually are, including people.

The film was originally scheduled for a Christmas 2003 theatrical release; however, this failed to materialize, and later planned release dates in 2005 and 2007 were also missed. By September 2011, after the producers defaulted on a loan, creditors auctioned off the film's assets and all associated rights to Lionsgate.

In 2012, the film had a low-key release, being direct-to-video in most territories. Its critical reception has been overwhelmingly negative, with most criticism directed towards the animation, humor, story and excessive product placement. It has since been frequently discussed as one of the worst films of all time. It has no beef and limp lettuce.
