His Honour did state:

In light of my conclusions, each proceeding must be dismissed. At this point, I would ordinarily publish my reasons, but I understand that the Commonwealth has an application to make in that regard.

I will shortly move into closed Court to publish my closed Court reasons. As I have said, I will ask the parties and the Commonwealth to consider carefully whether there are aspects of the closed Court reasons which might be published on an unrestricted basis.

Geoff already knows I did two years conscription, I've talked about being trained often enough how to kill people. You stick a long knife in, twist it 90 degrees and pull it out. They reckoned if you didn't twist it, the knife could get stuck and you can't spend all day trying to remove it. Then of course there was training how to riddle bodies with bullets.

They were training me to do all this knowing full well that I was just out of my apprenticeship of machining, had been law abiding, looking forward to a career in my trade (the Army refused to let me do that). They drove me mad because I instinctively knew that I needed to gain more post-apprenticeship skills in my trade to be proficient later on. But the politicians were embarking on the de-industrialization of Australia at that time, so they wanted as many future manufacturing tradesman out of the workforce as they could get out. Then they implemented what we now know as, a "Service Economy"

At the moment, I'm reading a book called "The Nashos' War", and it says in there that some wounded Vietnam soldiers were shot by a few of our troops at the end of the battle of Long Tan, under the guise of "they were attempting to escape". It was being done on both sides, American wounded bumped off by the Vietnamese, and wounded Vietnamese bumped off by allied troops

Albosqueaky is in Vietnam now, or was the other day, keeping his mouth shut about war crimes I'll bet. We love Communist Vietnam now, great blokes they are, it's as if the war never happened, in spite of the fact that the North Vietnamese Army murdered countless innocent civilians when they first crossed into South Vietnam

Did you ever do overseas service and if so where?

Why didn't you apply for a deferment, as you were entitled to, given you say you were in an apprenticeship?

No! Never in ADF and never would.

There are many others who would charge unassailable positions and murder detainees on the orders of a superior whose morals, judgment, and credentials would be questionable.

There is no way Bias is bullshitting us about this. My (1st) father in law fought in WW2 against the Japanese. The few times I caught him willing to speak out was when I sat quietly with him outside the backyard with a cup of tea and dear God he also shared the same sorts of views/sentiments that our Bias here has posted.

From what I could conclude back then ( the guy died at age 65 because of his war wounds ) was this : he was thankful that he came back alive even if it was with 1 leg missing because his 2 brothers died in combat. There were 3 boys in his family all up. But he was angry with our govt. He kept repeating that our govt lied to us all the way. They didn’t tell us the truth regarding our missions and how awful it was going to be. They taught us how to kill people quickly with our weapons. Bullets, knives whatever and to never second guess who our enemy was. Some looked like ordinary civilians but they weren’t. He had a dreadful hatred for anything made in Japan until his dying day. None of us could buy a Japanese car even. It would have just betrayed his broken heart. War is bloody awful. It destroys the lives of everyone involved ... even those who survive it.

indeed war is legalized murder, and brutalizes a good number of combatants, eg Morant , and Roberts-Smith.

And yet we are all complicit, so long as the veto in the UNSC remains in place, to allow war to settle the dispute.

So...where did you spend the TWO years of conscription you are sobbing about?   

Into whose guts did you thrust a knife, twist it 90 degrees so that you could pull it back out? 

What are you whingeing about?

As for not knowing about it....I appeared before many Magistrates for blokes who claimed 'conscientious objection.'  Never lost a case, it was always a laydown misere, as no Magistrate wanted to put that sort of bloke into the ADF where being able to rely on your mate is essential.

I was referring to the war crimes committed by commandos back then which included summary executions; also the legal defences used back then during court proceedings (I was following orders —> Nuremberg Defence)

There are a lot of parallels Aussie. Another (interesting) parallel is this : for some Morant was and still is a war hero...for others he was nothing more than a cold murderer.
