the article states: He was charged by police just a month later for allegedly breaching the conditions of the CPR by setting up an Instagram account to follow soccer superstar Cristiano Ronaldo and not telling police within the required seven days. He also was accused of using the phone to speak to a child relative.
The 1st charge, using a computer, and setting up an instagram account. It seemed that his parole actually DO allow him to use a computer, setting up an account, however, he need to report that to police within seven days. We had no information to indicate if he did reported late, and if so how late.
The 2nd charge, using the phone to speak to a child. The phone has internet. There are two things the judge would have to consider. The phone belongs to another relative apparently. So while he has access to a phone that has internet - that is not his, there is a defense that if he doesnt have any reasonable means to access the internet with it. For example if the internet is disabled on the phone, if the relative is watching him calling. And second issue is the intent of the phone call. For all we know, he could be on the phone for a few seconds just to say bye.
So as you can see, there are so many questions and details that needed to be iron out. And there is no such thing as black and white when it comes to law and punishment. The judges are legally obligated to consider all situation, even when there is mandatory sentencing attach to a crime code.
In this case, we should refrain from judgement until we know more details of whats happening.
Nah, totally wrong misunderstanding of the justice system. To start with he is not charged with breaching parole conditions. He doesnt get a chance to go to court and plead his case. The parole board breached him, end of story. He was convicted, served time, let out on parole under certain conditions. He breached those conditions, it is black and white. Basically he signed a contract stating he would abide by those conditions or be returned to jail. No grey areas there.
