The High Court overreaches

The High Court ruled that Indigenous People (even if they're not Australian citizens) cannot be deported as they are tied to the land culturally and historically.

Notwithstanding whether or not you agree with this principle, the real question is: "on what legal basis can the High Court make this ruling?" In my view, nothing.

This is an example of where the High Court is over-reaching, and I fear that this is the first step in our Court becoming highly politicised like it is in the United States. The Court made a decision, which in my view, was designed to make a political statement.

The High Court should've ruled that this decision is not for the Court but for Parliament to decide.

Well - let's be real for a moment - I'm 'tied to the land historically and culturally' - and I can't be deported since I am a citizen..

What this is saying is that Aborigines anywhere with any citizenship are somehow citizens of Australia.

As I said - that's like saying I'm a citizen of Germany, Ireland, Scotland et al, since my antecedents came from there.

This is nonsense and cannot stand...

Apartheid??

Are there still Lefty Plants in the High Court put there by Gillard ?

Next thing Dutto will put a challenge into the obviously Greeny influenced High Court.

The High Court is not above all and can be challenged.

What do you think about the fact that the High Court made that decision? Why didn't the Court decide to let Parliament make that decision?


Now that is a question.... my personal view is that the court would have to say the opposite to what  it actually said - a citizen is a citizen or not - no half measures..  it's simply black and white...

I recall the same argument I discussed with my lawyer once about a deceased Digger who had an Asian wife... married legit and all.. and whether or not she c ould inherit given something like only six month's tenure in the 'job'.

I said - "Easy - when is a wife not a wife?"

Well - when is a citizen not a citizen - when he is not a citizen.

There endeth the lesson.

P.S.  does he have a legitimate Aboriginal Passport, to go with his Aboriginal driving licence and car rego etc?  (none - don' need one, Bro - this our lan' and we mek the rules, eh?  Watchu mean I godda git in dat van, copper?  You chargin' me fo' drahve without licence an' rego? What I do wrong 'ere?

Why should the High Court determine who is and who isn't a citizen? That is for Parliament to decide.
