the guy was an opportunist .

most men nowdays are.
they are downright creepy.
they dont "own' their masculinity.

the guy could have had this girl (if she was 17) and he didnt have to be creepy about it.

he could have been just buzzing with awesome masculine energy.
she's obviously a bit lost, needs to drink to feel less inhibited.
but young men nowadays are SO inhibited, SO unsure of how to approach a woman in this modern minefield, that they need careful tutoring.

so he should have just chilled and been an awesome confident cocky guy who was self amused and needed nothing from her.
then he should have invited her out on a 'day 2' and he should have just been buzzing off his own awesomness and again NOT CHASING.

now, to get his validation, SHE HAS TO CHASE, she would be chasing him, hitting him up with texts, hitting him up and then and only then when he can look her in the eyes and say "if we have sex , will that be a win for you" and she says "yes" should he proceed.

the thing is, if the guy is patient, carefree, does not chase or give validation, the women will  all chase.

the hungry never get fed.
the guy who already has tons of girls is totally non needy and thats very very attractive to a woman. its called "social proof".  if all the other girls are after him, it makes her even more desperate to get "the prize"


I agree with much of what you say about males' increasing uncertainty about their role and the reasons for it and agree it's a tragedy not just for the men concerned but also for girls/women and society at large

As to the couple in the OP, I have sympathy with both. Sounds to me as if they both had raging hormones (which is natural and healthy) but fell short of society's expectations

Males are expected to take the initiative, which he did.  Women are expected to resist.  He took the initiative but she didn't resist until belatedly accusing him of rape, which would have been the only course she could take in light of the fact her friend could have told others they were alone in the room together after their initial sexually-charged encounter.  Open knowledge of what had likely happened would have destroyed the girl's reputation.  In time honoured fashion, the boy was charged with rape

My reading of the incident is that he wasn't in search of romantic involvement, although very possibly, she was.  She told him she was 17.  His arm and shirt were around her. She thought, 'he likes me'. She felt wanted, attractive.  He was just being a guy with an available female.  They explored further.  He left and got drunk, she went to lie down, also affected by alcohol. He returned for his shirt.  There she was, lying on a bed.  More to the point, she sent her friend away, which speaks volumes

maybe she believed the romance (her reading of the situation) would be rekindled.  He figured she wanted more/was willing (his reading of the situation).  It happens all the time.  This time, because of the girl's age and because others would have realised what likely went on in the room, he was charged with rape.  If she'd been older we wouldn't have heard about it

if she'd been raised to accept personal responsibility for her actions and if she'd been older, he wouldn't have been charged

just because she's a female doesn't make her less culpable, imo

also, if she'd been say, 25 years old, and had claimed that after being sexually molested she sent a witness from a room in order to be alone with her alleged molester who'd subsequently raped her, she would have been laughed from the room.  Not out of court, because obviously, women are curently granted an automatic halo in response to ongoing crimes against women

I feel most parents, if confronted with the situation, would at least demand from their daughter a series of explanations -- for the drinking - for not leaving the location after the first alleged sexual molestation - for remaining in the room when he returned - and especially for why she'd sent her friend out of the room to be alone with the boy and for not screaming out for help during what she later claimed was rape

If this had happened at the man's residence extenuating circumstances and implied consent could be argued.

However, it happened at another person's residence where a higher duty of care responsibility was implied.

He's 22 now ... he wasn't at the time of this incident.

You must have forgotten your youth.  Is that why you can't see what's blatantly obvious in the linked scenario? 

There are 15 year olds and then there are 15 year olds.  Most 15 year old girls who've been raised responsibly, who've attended sex education classes and who're normally observant would not let a drunk 22 year old close enough to digitally rape them

but if he had, those responsibly raised 15 year olds would not have lain down, for a start.  They would have found a way to get home.  Being digitally raped, for a virgin girl, is a lot to handle, is a shock, etc.

but the girl in the OP decided to lie down.  Not at home.  Lie down at a party where she's been sexually molested

she didn't rip the molester's shirt off her back and toss it on the floor, as most girls would who'd been molested by the shirt's owner

no. She kept that shirt and she went for a lie down -- with the shirt.  And when the molester came looking ahem for his shirt, what did he find?  That's right.  He found the girl of his earlier encounter lying down in a room.  Not a verandah or living room filled with people.  On her own in a room with his shirt, and in a prone position

But she still had a chance to prevent any further intimacy between herself and the molester.  All she needed to do was rise from the bed and exit the room

and she had a girlfriend there to help her do just that

but what did the alleged victim do?  Read it Cods.  Read where she sent her concerned friend away because she wanted to be alone with the molester to 'talk' to him

So he's 22 and blind drunk and initially just wants his shirt

but SHE wants to 'talk'

What about?  How do you talk to a drunk to begin with?  You're talking to the contents of a bottle, in this case, several bottles

and what could a supposedly naive 15 year old want to talk about with the man who molested her (yet she'd remained at the party after being molested/digitally raped) ?

What would she say to him?  A supposed 'kid' talking to an alleged sexual predator?  Would she ask, 'Why did you digitally rape me earlier in the night and that's why I've stayed here, so we could talk about it if you returned to me for your shirt? '

And what would he say?  Would he say, 'Sorry.  Now can I have my shirt.  I want to go home" ?

Would he say, 'Well, you weren't objecting, were you?  If you'd objected, I would have stopped.  But you didn't ' ?


Then it gets a bit blurry, doesn't it?  She's in a prone position and next thing, he's raping her

yet she sent her friend away.  And she's in a room alone with the molester

Did she scream while he was raping her?  Did she call for help?  No?  Why not?  Why didn't she belt him one and run outside to the others at the party to ask for help, for the police, her parents, whomever?

Instead, she did not alert others, did not ask for help, did not run from the room.  She told a friend in a text or whatever.  Then told others

and did they question her as to HER behaviours and reactions that night? 

Or is the word RAPE all it takes for people to begin acting as if he's Marqis de Sade and she the Virgin Mary?

He read her hormonal signals which she now denies.  And the judge, aware of the heated climate currently surrounding rape and 'poor women', set the guy on a path from which he'll never be able to recover


I will NOT be surprised if the girl writes to him while he's inside.  And I make no apologies

as to the girl claiming she'll 'never recover'


I bet she does

What she might not recover from in that particular town/region, are people's opinions about her behaviours, which are definitely in question on that particular night

When my daughter was 14 she was being influenced by a girl friend with a reputation for being wild, jumping out of the window at midnight & sneeking off to see young men 6 & 7 years older.

And despite all the warnings given her she got tangled up with a 21 yr old no hoper.

I went to the Police to seek assistance as I considered his actions "carnal knowledge".

I was advised that bringing a case would be difficult as my daughter may become a hostile witness as she had consented. (she had got the guilts and told her mother and I.)

They told me I should just pay him a visit ... but not punch him in the face to leave visible marks.

I thought that was pretty piss poor on their behalf.

None the less over the next few months I hounded that bastard out of the neighborhood.

He could run faster than I ... but I went close a couple of times.

I've never forgotten what that bastard did to my little girl .................. and I'll never understand why & what a 21 yr old had in common with a 14 yr old immature girl .......

other than a sick sexual conquest thing that some arseholes had at the time .....

called scoring a baldy fork.  Angry

that is a tough one gnads.. that young man wasnt charged was he??...so no one but you know what he did...he had if you like a lucky escape....no stigma..

and by the same token  neither does your daughter...sadly some girls grow up the hard way as well..but in her case she thought she was having a good time....so I can believe she has well and truly moved on....rape on the other hand   is not always easy to move on from  I think .. I dont know... but I think a girl would know if she put herself in that dangerous situation ... being in a bedroom alone with a guy!  isnt whats she should have been doing I agree.,

but if you forget to lock your front door doesnt mean you deserve to be robbed does it?....

and the person who broke the law...should pay the penalty...

the girl didnt break any law...


and neither did the person who forgot to lock his front door..

thats the whole point...

The girl woke up and asked her friend to leave because she wanted to speak to Huxley about what happened earlier.

But he walked around to the side of the bed, climbed on top of her and raped her “vigorously”, scratching her back, a court heard.

The shocked girl called a friend and told another via Facebook Messanger “he f...d me” before her friend’s mum came to collect them both.

During the ride home the girl disclosed what happened to her by typing notes into her phone. Her friend’s mother then offered to take her to hospital where she underwent a Sexual Assault Investigation Kit (SAIK) examination and spoke to police.

Huxley, a former Gosford High School student who lost interest in studies and was expelled in Year 9, was later arrested and charged with four counts of aggravated sexual assault.

In January this year, on the first day of his trial Huxley pleaded guilty to two counts of having sexual intercourse with a person aged between 14 and 16.

Huxley, now aged 22, was yesterday sentenced in Gosford District Court to a year and eight months jail with a non-parole period of 10 months.

Fighting back tears Huxley, who had been on bail, was led into custody.

Reading from the girl’s victim impact statement, Judge Tanya Bright said the rape caused her to “throw up my meals”, quit her job and became alienated from her friends.

Judge Bright said it was the “hardest thing she had been through” and it would likely affect her for “the rest of her life”.

In sentencing Huxley, Judge Bright said his offending was below the high range of objective seriousness, he had good prospects of rehabilitation and had come to “fully understand his offending”.

He will be eligible for parole in March 2020.




as the judge has said  this young women will be very lucky to get over this...we cannot be sure what goes through a rapists mind   at the time  but it surely is never concern for the women involved....and how this act might affect her for the rest of her life..

I often wonder what do the parents of these young men feel?.. we never hear from them   or the parents of the victim....I dont believe they are untouched by these events.....perhaps if we heard how it affects them   maybe some young men would actually think twice...from what I can gather most rapes have a certain amount of planning to them....

Was a long time ago now ..... 24 years ago.

I used it as an example of how difficult it is to define some of these occurrences ....

for me it was as good as a rape ... he being an adult & she a minor.

but she consented .... and the coppers were indifferent.

I know what can happened when girls who are physically mature and lie about their age .... then cry foul after consent ....

a couple of my mates were in court in the mid 70's on carnal knowledge charges and they were 4 to 6 years older than me.

In January this year, on the first day of his trial Huxley pleaded guilty to two counts of having sexual intercourse with a person aged between 14 and 16.

The other charges were withdrawn.

Huxley, now aged 22, was yesterday sentenced in Gosford District Court to a year and eight months jail with a non-parole period of 10 months.

Fighting back tears Huxley, who had been on bail, was led into custody.

Reading from the girl’s victim impact statement, Judge Tanya Bright said the rape caused her to “throw up my meals”, quit her job and became alienated from her friends.

Judge Bright said it was the “hardest thing she had been through” and it would likely affect her for “the rest of her life”.

In sentencing Huxley, Judge Bright said his offending was below the high range of objective seriousness, he had good prospects of rehabilitation and had come to “fully understand his offending”.

He will be eligible for parole in March 2020.




as the judge has said  this young women will be very lucky to get over this...we cannot be sure what goes through a rapists mind   at the time  but it surely is never concern for the women involved....and how this act might affect her for the rest of her life..

I often wonder what do the parents of these young men feel?.. we never hear from them   or the parents of the victim....I dont believe they are untouched by these events.....perhaps if we heard how it affects them   maybe some young men would actually think twice...from what I can gather most rapes have a certain amount of planning to them....

Was a long time ago now ..... 24 years ago.

I used it as an example of how difficult it is to define some of these occurrences ....

for me it was as good as a rape ... he being an adult & she a minor.

but she consented .... and the coppers were indifferent.

I know what can happened when girls who are physically mature and lie about their age .... then cry foul after consent ....

a couple of my mates were in court in the mid 70's on carnal knowledge charges and they were 4 to 6 years older than me.



I understand that its coming from a parent of a girl...

tell me gnads   do you think we are dealing with this problem...[it isnt a cops problem]  men thinking its ok to rape.. or take what isnt theirs to take...because !!! well I dont know why?...

you say that was 24 years ago and not much has changed has it?....laws maybe but not attitude.....I mean we now have date rape.. drugging the victim...we even have videos of the actions and posted on utube....like a trophy....no shame at all...

our footballers can attest to that. Angry  it does appear to be a male thing....

As a parent I can only try to imagine how difficult it must have been for you and your wife and daughter, knowing how much she'd distressed and disappointed you.  Glad to hear it's long behind you

My sister used to climb out of the window when she was about 15 to meet her boyfriend.  She was such a skinny little kid, small for her age and appeared to care only about dolls and her button collection, but obviously she had other interests.  Nothing I said or threatened stopped her.  Mind of her own and just didn't care about consequences.  We moved, so that put a stop to that.  She went on to marry, aged 19, to a man in his late 20s.  He's a great guy. She's still a handful

A girl who worked near me years ago told a group of us about her older sister. The sister, then in her teens, had a secret boyfriend and when they revealed to their parents that they were expecting a baby, the girl's mother had the boyfriend charged with carnal knowledge.  He was imprisoned for several years.  The girl's was consigned to an unmarried mothers home and was made to give the baby up for adoption.  When the boy was released from prison, he married the girl, who was by then of age.  They went on to have four children and were obsessed with finding their first (adopted out) child.  At the time of the telling, they had failed to do so

I knew an Italian woman who'd been married off at age 15 to an older man. The marriage was arranged in advance before she, with her parents and siblings, emigrated to Australia.  She had no choice but agree. Her sister, older by one year, was rejected by the man who'd agreed (based on a black and white photo) to marry her.  The older sister remained a spinster until her death in her 80s, but the younger one who'd married at 15 had seven children in close succession.  Then her husband died followed by a son.  That woman's in her 80s now and all she's known of life has been pregnancy, births, deaths, work, divorced children with children of their own, illness, etc.
