More than $1 million in lost wages has been recovered for 2500 workers after a major investigation uncovered widespread problems on fruit and vegetable farms.

The Fair Work Ombudsman's Harvest Trail Inquiry completed 836 investigations in the past five years, involving 444 growers and 194 labour hire contractors, with the majority picked at random.

More than half of the investigations found breaches of workplace laws including underpayment and failed record keeping.   Sad

But the ombudsman believes the full extent of worker underpayments is significantly higher than the $1,022,698 clawed back for workers who follow fresh fruit, vegetables and wine grapes harvests around Australia.

"Our inquiry highlighted unacceptable practices of underpaying workers in one of Australia's largest rural industries," Fair Work Ombudsman Sandra Parker said on Thursday.

Growers rely heavily on overseas workers who commonly do not have a good understanding of Australian work rights and entitlements, the report found.

"Migrant workers may not seek help because of language and cultural barriers, concerns about visa status, or because they are unaware of their workplace rights," Ms Parker said.

The vast majority were on working holiday visas, with people on that category particularly vulnerable to exploitation.

As well as underpayments, the FWO found examples of other exploitation including substandard accommodation, transport and extra charges.

During the inquiry, the ombudsman took court action against eight employers for serious alleged breaches of the Fair Work Act, with four actions involving labour hire contractors.

Six matters have now been finalised, resulting in over $500,000 in penalties, and two remain before court.

The ombudsman handed out 150 formal cautions, 132 infringement notices, 13 compliance notices and seven enforceable undertakings and commenced eight legal proceedings.

Despite expressing concern about the findings, the vegetable industry is confident actions already undertaken will remove law-breaking operators.

"We categorically condemn the mistreatment of farm workers in any form and this type of behaviour has no place in the horticulture industry," AUSVEG Chair and Victorian vegetable grower Bill Bulmer said.

Australian Council of Trade Unions secretary Sally McManus called for laws to be changed to give workers quick and easy access to justice to recover stolen wages.

"How many more inquiries like this one will it take before the Morrison government admits that wage theft is a national crisis?" Ms McManus said.   Sad

As if a token slap on the wrist and a good finger wagging will be all these crooks need to mend their ways.  Roll Eyes

The reason why underpayment is so out of control is because these "penalties" are not effective deterrents and the Coalition are soft on corporate crime. Has anyone noticed how the Coalition never, ever mention mandatory sentencing or mandatory penalties in this context?

Well I would like to see the figures of how many of these Harvest Workers are your ordinary Australian worker, your Back-Packer worker and your illegal immigrant worker???

Mind you, in the Riverina - they can pick up 17 illegals a month in those towns. Even I could spot them when I lived out there.

If its most illegals working - then suck eggs to them.

An inquiry into Australia’s horticulture industry has found the amount of wages ripped off from workers is “significantly higher” than the $1 million in unpaid wages recovered for 2500 workers employed on the trail over the past five years.

Since 2013, the Fair Work Ombudsman has investigated 638 Harvest Trail businesses — 444 growers and 194 labour hire contractors — connected with the harvesting of crops including citrus, grapes, strawberries, cherries, mushrooms, apples and tomatoes.

More than half of the businesses breached workplace laws, including deliberate and significant underpayments of base pay rates, falsification of records, ­deliberate withholding of pay slips, non-payments and unauthorised deductions.


“As a result of these activities, the FWO recovered $1,022,698 for 2503 employees,’’ a report of the inquiry’s findings says.

“As Fair Work inspectors were unable to assess and determine the full extent of underpayments in many cases due to issues such as poor record-keeping, cash payments and a transient workforce, the FWO believes the full extent of worker underpayments is significantly higher than this.”

During the five-year-inquiry, court action was taken against eight employers for serious ­alleged breaches of the Fair Work Act.

Six cases have been finalised, resulting in more than $500,000 in penalties, and two remain ­before the court.

Inspectors issued 150 formal cautions to employers, 132 ­infringement notices and 13 compliance notices for breaches of workplace laws, and struck seven enforceable undertakings.

Almost 70 per cent of Harvest Trail businesses employ visa holders, with working holiday subclass 417 visa holders, aged 18 to 31, the most common migrant workers on the trail.

The report says the incentive to obtain a second visa means workers may be willing to accept substandard pay and conditions and unscrupulous employers can use this as leverage to pay less or withhold pay.

“The inquiry found some ­labour hire contractor companies that may have been operating in breach of the Corporations Act 2001,’’ the report says.

Fair Work inspectors interacted with 237 incorporated ­labour hire contractors and identified that 271 individuals had been appointed as directors of these entities. Of this number, 92 of the directors were visa holders, including 22 per cent on working holiday visas and 18 per cent on student visas.

To participate in the government’s Seasonal Worker Program, an employer must apply to the Jobs and Small Business ­Department to become an ­approved employer and must obtain the approval of the Home Affairs Department to become an approved temporary activities sponsor.

The Fair Work Ombudsman, Sandra Parker, said the inquiry exposed widespread non­com­pliance along the Harvest Trail.

“Our inquiry highlighted unacceptable practices of underpaying workers in one of Australia’s largest rural industries,’’ she said.

wow , so many inspectors and so few productive people.

probably best to sell the apple orchards to the chinese and then borrow money off the chinese to buy the apples back.

sound like a good plan  Whiteknight?

all the unemployed farmers can go on newstart and then we can borrow more money from the chinese to raise the dole so that you dont have to go  Cry Cry Cry Cry all over the place.

of course the next generation will be screwed but its important that those who currently contribute nothing still get to live a life of luxury

I bought a peach yesterday.. only 1.. it was terrible...no taste whatever

I AM BEING RIPPED OFF as well....

does anybody care??? not that I am aware of..

they pick the fruit before its ripe and therefore before its edible    as fruit ripens on the tree......

whats going to happen cods (and i say this as a farmer) is that small growers will go out of business.
the wages and conditions that whiteknight demands and the prices that woolworths and coles pay will ensure that no hard working small farmer can survive.

the farms will be amalgmated, sold off to foreign investors.
these investors will demand the right to employ 457 visa holders to work and they will be granted this because our debt ridden government is a slave to foreign investment.

these big agribusinesses will pollute the environment, rape the land, send the best stuff overseas and you will get an overpriced inferior product.

dont blame the farmer,  blame the unions, the big grocers, the government and the entitled consumer .

in the end, they all lose,  the unions have no jobs, the government have a big debt, the big grocers have unhappy consumers and you get rubbish fruit and a destroyed environment.

oh well, thats what happens when everyone is a taker and no one wants to contribute

what do you think is the hourly wage rate for the farmer who owns the business, has all the responsibility, has to worry about everything and take all the stress.

probably about 1/2 what the entitled unionised workforce think they should get.

i would advice him to sell the farm to a big conglomerate that can employ some hard working 457 visa holders and bypass the lazy union chodes
