Some really good points in there.  But......obviously that issue of consent is contentious.

If a woman is seduced and offers zero resistance at all, says nothing, makes no attempt whatsoever to cease the blokes moves, and intercourse ensues.....I do not reckon that means she can credibly later claim not to have consented.

How many women actually act like whores and sing out 'Give it to me big boy.......harder," as opposed to quietly go along, even submissively if you like, and loving it to orgasm.

Consent cannot be made subject some overt act by the 'woman.'  Her submissive participation is there.

It's a complex issue.... generally a person can tell when the other party is keen... on the other hand a woman can feel out of control of the situation and uncertain about what to do.... in a dark alley it could be terrifying to think that if you refuse you might get beaten or whatever... and there is nobody else around.

This is a strange case to me.... I can hardly envisage an eighteen year old virgin consenting to anal intercourse with someone she just met in a strange environment, but women do some very strange things.

Looking at that seedy guy - what the hell would any woman see in him?  No girl wants to compete with sheep......

Yes Grappler it is complex if you want to make it so and ignore real life.

What bothers me is the suggestion of a requirement of an overt act of willingness on the part of the 'woman.'  Some women do like to meekly submit, as opposed to "Give to me hard, Big Boy!'  Plenty of grey in between, I know, but, the Qld position (as it was in my day) was fine.  It was covered in what then was S.24 of the Criminal Code.........'Mistake of Fact.'  I have no idea what S.24 now provides.

Hmm - yes - what was the litmus test in a court? 

Anyway - I doubt there was meaningful consent from that girl in this case.... and I doubt a real man would consider that there was.... inviting someone to a private area and then taking them into a dark alley with no witnesses is not their consenting to sex of any kind.

Bring back Cosa Nostra....  Joey... Sal... just break his legs a little.... not too hard.. but enough... if his Mediterranean family comes back at us... you know what to do...

If a woman goes back to a motel room with a guy
If a woman goes into a room with a guy
If a woman comes onto a guy and goes to his home

It ain't rape

However
If a man forcably takes a woman to these places
Of if several men are involved
Or if the woman is drunk, drugged or otherwise unable to make a call

It's rape

But these days, just looking at a woman gets you up on charges

I'm glad I'm well past picking up women
I've been married nearly 40 years and I love my wife dearly

Going through today's minefield of different sexual beings, litigation for just smiling at a woman, let alone kissing one, femazi, pooftahs, and all manner of new and wonderful protocols, I'd be stuffed.

No wonder so many Aussie men are heading overseas for a reasonable bride.

So you are saying that when a woman goes back to a motel room with a guy under her own volition and at some stage decides that she isn't into it, even half way through it, it's rape?
Granted, if it's forced or violent, it could be rape, but if it's consentual, it ain't.

Why else would she go back to the motel room?

To play checkers perhaps?

If she, under her own volition goes back to the mans house
And decides again that it's not on, as long as it's not forced or violent, it's not rape

Or did she just go back to his place to see the curtains?

You obviously didn't watch 4Corners.

She was drunk, in the end scared & was in a back alleyway on her hands & knees, & because she was so tight vaginally old Greek mate decided he f*$k her up the a*#e.

He took her phone number as a trophy, told his mate he took her cherry... hardly  Roll Eyes... then admitted in court that anal sex in a back alley wasn't normal & was gross.

She was naive & taken advantage of by a young bighead who thought he was untouchable & could get away with what he wanted because Daddy owned the club.

You Aussie are as bad as the female judge who upheld the appeal on the very same suggestions you made ... you should be ashamed of yourself.

Have you been as supportive to Rolf Harris & Bill Cosby for the charges bought against them for groping women 30 to 40 years ago?  Angry
