Judge orders new searches for Clinton Benghazi emails

Nine months after the presidential election was decided, a federal judge is ordering the State Department to try again to find emails Hillary Clinton wrote about the Benghazi attack.

U.S. District Court Judge Amit Mehta ruled that the State Department had not done enough to try to track down messages Clinton may have sent about the assault on the U.S. diplomatic compound on Sept. 11, 2012 — an attack that killed four Americans, including the U.S. ambassador to Libya.

In response to Freedom of Information Act requests, State searched the roughly 30,000 messages Clinton turned over to her former agency at its request in December 2014 after officials searching for Benghazi-related records realized she had used a personal email account during her four-year tenure as secretary.

State later searched tens of thousands of emails handed over to the agency by three former top aides to Clinton: Huma Abedin, Cheryl Mills and Jake Sullivan. Finally, State searched a collection of emails the FBI assembled when it was investigating Clinton's use of the private account and server.

In all, State found 348 Benghazi-related messages or documents that were sent to or from Clinton in a period of nearly five months after the attack.

However, the conservative watchdog group Judicial Watch argued that the search wasn't good enough because State never tried to search its own systems for relevant messages in the official email accounts of Clinton's top aides.

In a 10-page ruling issued Tuesday, Mehta — an Obama appointee — agreed.

MEMORANDUM OPINION AND ORDER
I. INTRODUCTION
This case concerns a Freedom of Information Act (“FOIA”) request for former Secretary
of State Hillary Clinton’s e-mails related to the September 11, 2012, attack on the U.S. consulate
in Benghazi, Libya. Although this matter began with much fanfare, the only remaining dispute is
whether Defendant Department of State (“State”) conducted an adequate search for records
responsive to Plaintiff Judicial Watch, Inc.’s FOIA request. Because Secretary Clinton used a
personal e-mail server for work-related communications, Plaintiff’s request caused State to look
beyond its own e-mail servers for responsive records. State searched three external sources:
(1) a cache of approximately 30,000 e-mails turned over to State by Secretary Clinton;
(2) documents produced by three of her top aides—Huma Abedin, former Deputy Chief of Staff;
Cheryl Mills, former Chief of Staff; and Jacob Sullivan, former Director of Policy Planning; and
(3) the collection of e-mails recovered by the Federal Bureau of Investigation (“FBI”) during its
investigation of Secretary Clinton’s use of a personal e-mail server.





"To date, State has searched only data compilations originating from outside sources — Secretary Clinton, her former aides, and the FBI. ... It has not, however, searched 8 the one records system over which it has always had control and that is almost certain to contain some responsive records: the state.gov e-mail server," Mehta wrote.

"If Secretary Clinton sent an e-mail about Benghazi to Abedin, Mills, or Sullivan at his or her state.gov e-mail address, or if one of them sent an e-mail to Secretary Clinton using his or her state.gov account, then State’s server presumably would have captured and stored such an e-mail. Therefore, State has an obligation to search its own server for responsive records."

Justice Department lawyers representing State argued that making them search other employees' accounts for Clinton's emails would set a bad precedent that would belabor other FOIA searches.

But Mehta said the circumstances surrounding Clinton's email represented "a specific fact pattern unlikely to arise in the future."

Hillary Clinton’s use of a private email server has faded for some, but not Platte River Networks, which on Thursday learned a congressional committee wants the government to prosecute its CEO, Treve Suazo.

The Denver-based IT management company found itself in the middle of the Clinton email controversy after taking the Clinton family on as a client in June 2013 — about four months after she left the job as secretary of state.

When the FBI began investigating whether Clinton improperly used a private server to send classified emails, it interviewed Platte River’s employees, who were also subpoenaed by the congressional committee. At that point, Platte’s response said they were cooperating with the FBI.

But the committee’s work was not done. In Thursday’s letter to U.S. Attorney General Jeff Sessions, U.S. Rep. Lamar Smith, R-Texas, who chairs the House Committee on Science, Space & Technology, said Suazo failed to produce documents, made false statements and obstructed the committee’s investigation. The committee wants the case to go before a grand jury.

“Instead of cooperation, the Committee was met with obstruction and refusal to comply with subpoenas and requests for transcribed interviews. These actions, taken together, as well as Mr. Suazo’s false statements to the Committee, made through counsel, support the pattern of obstruction. If left unaddressed, Mr. Suazo’s conduct in ignoring lawful congressional subpoenas, misleading the Committee through false statements, and bald refusal to respond to reasonable requests could gravely impair Congress’s ability to exercise its core constitutional authorities of oversight and legislation,” reads the letter, signed by Smith.

Platte River’s attorney Kenneth F. Eichner said Thursday the company has cooperated with Justice officials. He shared this statement: “Platte River Networks has already fully cooperated with the Department of Justice and the Federal Bureau of Investigation. On behalf of the company, we are confident the Department of Justice has moved on.”

Some of the FBI’s findings were released a few months after Director James Comey said the bureau would not recommend criminal charges against Clinton.

The FBI report, which was released in September 2016, included the agency’s interviews with Platte River employees. Among them was newly public information that a Clinton staff member told a Platte employee that Clinton didn’t need access to emails older than 60 days so the retention policy should be changed. But the Platte River employee didn’t make the change until four months later and on realizing this, he used software called BleachBit to scrub the files to prevent recovery.

Smith’s letter contends that Platte River has refused to cooperate with the committee since January 2016. The committee asked questions involving how the server was secured and what that process was. It also asked for every document and communication related to cybersecurity measures taken to secure Clinton’s private server.

When Platte River responded in September, it didn’t answer the questions, according to Smith’s letter, noting that Platte said it “has nothing to produce that is responsive to your subpoena” and “had no relationship with former Secretary Clinton during her time in office.”

A second subpoena, on Sept. 16, 2016, resulted in a response from Platte that said all of its employees would stop voluntarily cooperating with the committee, citing the employees’ Fourth and Fifth amendment rights.

When the media was going on and on last week about Mueller’s Grand Jury, Dershowitz noticed something VERY messed up…

Mueller impaneled a SECOND Grand Jury to try and Force a Trial!

Now, let me try and explain what Dershowitz was talking about. Apparently, Mueller already had a Grand Jury impaneled in Virginia for the Russia investigation BEFORE it leaked he has one in DC.

So why would he do this? The Virginia jury is only a few miles away from the DC one. Well, according to Dershowitz, there are not many places in the country where you can find a more left-leaning Grand Jury than Washington DC (10 Dems for every 1 Rep).

Because of this, Mueller has now created for himself the option of deciding WHERE to try anyone the Grand Jury decides to indict. The ‘petit jury’ would almost CERTAINLY have a huge biased against a Republican President and his associates in Washington DC.

In reality, it is RIDICULOUS to have 2 different Grand Juries for a single investigation. He did NOT need the DC one to issue Subpoenas. The Virginia one has that power too. What it means is that they will both not be receiving the full scale of evidence for the case.

Hillary was yesterdays news this is only a distraction from the real problem, the imbercile in the white house.

We seem to have gone over and over Hillarie's emails for about a decade. Well over half the politicians have misused their email accounts as well as their employees. This is the real reason that most on both sides just want this to go away.

The real questions include how was it allowed to happen ???? where were the security checks ???? . How many others have done it ????
