Islamic Divorce show on TV
Jun 28th, 2016 at 5:54am

I do give credit where it is due. I watched part of this TV program about Islamic divorce in Australia.
If I had gone through a similar process, the part where the couples fronted those other guys, I am very sure my marriage could have reconciled. But that was a very long time ago.
The problem I had, not entirely with family law court/s, but with family itself who got involved in our marital affairs and dominated the outcome, one sided, her's.
Who suffered the most was the children at the time.

What I saw on TV, the Islamic way was confrontation in council with both couples, and at least one couple re-conciled from this process.

I will admit though, I was wrong in parts of my doings that caused marital problems, but when one looks at the very nature of our issues at the time, the bad seed was planted early in our marriage,
( long story ), but I guess one could say, Gossip, Jealousy played a major role and over several years the pot boiled over, so to speak.
Had we had a bit of Islamic in principle, ( over 15 years ago ) where attempts of re-conciliation was acted on, and not by her private lawyer using the laws to profit by "winning", I may still have watched my children grow and be part of their lives as an Aussie dad.
There are parts I did not agree with in relation to the Islamic Divorce process, but it would not have mattered in my or our case.
From my experience and I can only say from my experience, divorce process in Australia seemed to be made a business, she with her families $$ paid for a very good lawyer in that type of environment, where all I had was Legal Aid, they did their best to may I add, but in the end, it seems the $$ wins out in some cases, regardless of what the real deal is all about.
Thanks SBS, ( I think it was SBS ) for that program.

It depends on who wants the divorce under Islamic law.

If the man initiates it it goes through.

If the woman wants a divorce the imam will discourage this and urge her to stay with her husband.

Divorce under Sh'ria law is a great deal harder than the bigots believe.   Roll Eyes

Interesting that you (deliberately, I suspect) mistake explanation for advocacy, Gordy.  Do you often erect strawmen arguments like that?   Perhaps you'd care to demonstrate where I have advocated Sh'ria law?   Roll Eyes Roll Eyes

Be it shia law or whatever law, it is the process in principle, the idea is what I watched. It happens to be the Islamic process who "own" this idea. Yet I don't agree with all of it, in particular the male domination side of it. That may need to be tweeked.
However,
She divorced me without a real proper chance of reconciliation due to the Australian Family Court law process, and her family biased intervention, in part there was a element of deluded fear to may I add. There was nothing to fear.
What I am saying is, HAD we used a bit of the Islamic process, or some parts of the Islamic divorce process been adopted for the better, it would have swept away some delusional attributes, and most of all my children would not had to be put through "court ordred" stuff, instigated by her lawyer, only to use the family court's time consuming process till the kids became old enough to legally make choices. That was wrong, very wrong indeed.
What I saw in the Islamic process, it was husband, wife and clerics and divorce granted by clerics after all avenues had been exhausted.
I bet today my ex is thinking the same, "why did I listen to those "other people".." I won't say who those "other people" are, but I say they know how to milk the system.

That's bullshit bwian . Roll Eyes Roll Eyes Cool

The man only has to say I divorce you 3 times for a divorce, some say a witness is needed so open your windows yell it out so the neighbors can hear it. Roll Eyes Roll Eyes Roll Eyes

It's even halal to divorce your wife by text message.

A man can use the threat of divorce to get his wife to do what he wants, I said it once bitch, I said it twice bitch you know what happens when it's said a third time. Roll Eyes Roll Eyes

As for the woman initiating a divorce yeah that's almost impossible under sharia law. Cool Cool

...

Yet, divorce in Islam is described as much harder than that, Baron.   Perhaps you need to read a bit more widely than your bigoted websites?   Roll Eyes Roll Eyes Roll Eyes
