If you think otherwise, cite a reference to the relevant legislation that deems them to be "illegal".
If someone enters a country without legal documentation, without going through legal prescribed protocols.
If someone seeks to enter a country without the permission of the government illegally.
They are deemed illegally entering the country and are incarcerated, like the criminals they are.
Just because the government folded to the will of a bunch of no hoper individuals and granted them a visa, it does not negate the fact that they arrived here ILLEGALLY.
THAT MAKES THEM ILLEGALS.
It was stated , through information gained through the freedom of information act, that more than 80% of these illegal boat arrivals have not been employed in Australia since they arrived.
Our welfare system is bogged down with these parasites who milk the system for all its worth, quickly establishing themselves as disabled and getting maximum benefits for nothing.
Many of these ILLEGALS have become involved in illegal practices, following on from what they were doing in their own country.
I have no problem with immigrants, legal immigrants.
Australia would be a much poorer country without the wonderful people from all over the world.
But this influx of ILLEGAL and twisted cult followers has badly affected how we perceive all dark skinned people.
Its a shame because some Muslims are a great asset to our country.
We need to rid ourselves of these ILLEGAL parasites, before we end up like Paris and other parts of Europe.
Then, let me give you a quick lesson in modern law.
The UN Refugee Convention (to which Australia is a signatory) recognises that refugees have a lawful right to enter a country for the purposes of seeking asylum, regardless of how they arrive or whether they hold valid travel or identity documents. The Convention stipulates that what would usually be considered as illegal actions (e.g. entering a country without a visa) should not be treated as illegal if a person is seeking asylum.
Now, let me give you a couple of real life examples.
Case study: murder.
If a man intentionally murder another.
1. Case one: A man murder another man because he wanted the inheritance. He is otherwise not suffering from any duress, or mental health illness, or impaired judgement. In this case, the man will be found guilty of murder.
2. Case two: A man murders another. But the man is suffering from severe schizophrenia, whose voices told him to commit such crime. This man will be found not guilty of murder by reason of insanity.
Case study: Parking infringement
1. Case one: a lady parks her car in a no standing zone, because its more convenient for her. She will be fined for illegal parking.
2. Case two: a lady parks her car in a no standing zone, but she did so, because she felt some chest pain, and had to call the amublance leaving her car behind. She is techinically parked illegally, but in the eyes of the law, she was not parked illegally or to be fined because of the medical emergency exemption clause.
So, techincally, the boat people entered the country 'illegally'. But if they are applying for asylum, then under the Australian law, they did not enter the country illegally during their processing. They will only be found illegal entry IF their processing has failed.
In Australia, we do not practice strict legalism. Its a combination of legalism, moralism and relativelism. Thats why our laws are full of exemptions.
Fact: to date, over 80% of the asylum seekers had been found to be genuine refugees.
Fact: ALL of the detainees overseas who enter Australia by boat, who are having their refugee status processed, are not illegals. They have committed no crime under the Australian law as we know it, and we are locking them up - men women and children. We are doing so, because, our leaders want to buy votes from people like you.
