Recognising O/S Gay Marriages.

A cross party bill should see South Australia recognising same-sex marriages from overseas.

The bill which is to be introduced by Greens MLC Tammy Franks and Liberal MP David Pisoni will allow the marriages of same-sex couples conducted overseas to be recognised in South Australia in order to stop discrimination and allow them to be listed on the death certificate as married, should one partner die.

The bill was prompted following the tragic death of British tourist David Bulmer-Rizzi whilst honeymooning with his same-sex husband, Marco, in South Australia. The case made international headlines when Marco was prevented from listing the couple’s marriage on the death certificate.

Following the incident SA Premier Jay Weatherill promised to move forward with laws to rectify the issue with existing legislation but the Greens and Liberal MPs have grown impatient.

Franks told the ABC she was not prepared to wait for Premier Jay Weatherill to push ahead with his own laws.

"It's not good enough to put a Facebook square out, to promise people they'll have their human rights respected and do it on a piece-meal basis," Franks said. "Let's get on and start legislating for equality."

For his part the Premier said he is still pushing for a change in legislation.

"In January, I indicated we will be bringing legislation into the Parliament to address this issue once the Law Reform Institute hands us its report," Weatherill said.

"It's pleasing that other MPs share my concern about this issue and they are welcome to submit their bill to the Law Reform Institute for its consideration."

I was going to say the same. Federal marriage legislation forbids same-sex marriage and it over-rides any state legislation on the issue. It is a pointless exercise.

Why is there any need?  They have common law rights already.. how is/was his 'partner' disadvantaged by his death (apart from the obvious)?

As before, I had a gay friend in the 80's - when he split with his long-term live-in he had to buy him out of the house they shared..... nothing to see here, people.

There is a danger in recognising overseas marriages that do not conform to Australian standards.
Would they set a precedent for court action to sanction marriages to minors?

australia only recognises marriages that conform to our law. not hard to work out.

Pro-refugee activists have protested against the construction of refugee homes on a piece of public land – land on which they happen to squat in a “radical queer trailer park” and run an “anti-discrimination” workshop in.

Must be all Greens voters.
