a refugee advocate saying it is " not appropriate" doesnt negate the facts John. Good try though. Better than Ozzys . At least you had something. And you arent even a  lawyer. How about that.

Both can be punishable by law.





The verdict

Mr Morrison is correct.

Based on the definition set out in the people smuggling protocol, people who have come to Australia without a valid visa have illegally entered the country.

That is the case even though these people have not committed any crime, nor broken any Australian or international law.

The Convention says Johnboy...

"The Contracting States shall not impose penalties, on account of their
illegal entry
or presence,
on refugees who, coming directly from a territory where their life or freedom was threatened in the sense of article 1, enter or are present in their territory without authorization, provided they present themselves without delay to the authorities and show good cause for their illegal entry or presence. (Article 31, (1))

These people are not illegal or illegals.  Their entry in some context may be described as illegal.

Cambodia, the poorest, most corrupt country in SE Asia will take their first lot of asylum seekers from Manus Island.
