In the case of David Hicks, that never happened because the military tribunal - with all its powers - had no evidence. Hicks took a plea bargain  and pleaded guilty to a crime he says he didn’t commit.

A retrospective crime that doesn’t exist in Australia. And how could Hicks even be tried in the US?

He couldn’t - hence rendition and Guantanamo Bay. Hicks was sold to the US for the princely sum of $200.

Instead of Wikileaks links, Mistie, why don’t you post evidence of an actual crime?

I can’t imagine "progressives" advocating throwing the book at someone - anyone - over rumours and smoke-fire allegations, but that’s just what you’re doing. You want Taliban-style justice.

What exactly is the prescribed sentence for "training with terrorists"? Last I looked, we didn’t have such a law.

It would make the work of private security firms, soldiers of fortune, the French Foreign Legion, etc, etc, etc, a little difficult - not to mention the CIA.

Hicks was just a bored white boy who watched to many Rambo movies and thought he would have a little adventure ... I don't believe he at any time intended to fight against Australia or the US, he just want the photo opp. He sh1t himself as soon as things got serious

Now you’re just sounding hysterical. The real enemy is the post-September 11 move against humble Western principles like Habeus Corpus and the right to fair trial.

Belonging to any group - bikies, neo-Nazi organizations, Lashkar-e-Taiba, or even the School of Hygeine Studies at your own uni - is not a crime.

Make it a crime and we’ll talk about it. Until then, David Hicks represents the embodiment of the dearth of human rightsand Western values - a role, he says, he’s not too comfortable with. He just wants to get on with his life, and yes, he’s now against Islamic fundamentalism.

Of course he couldn’t  get a fair trial. The entire process of renditions and offshore justice in Cuba intends to do just this.

US citizens got fair trials in the US. British citizens were sent home. Australian citizens were shelved indefinitely in Guantanamo, which was the stated policy of the Howard government. How could it possibly be fair?

The knuckleheads are arguing for no trials, and no sentences. Presumably they want anyone the Afghans want to hand over for a couple of hundred dollars.a piece to be taken out and shot - or detained indefinitely.

For the knuckleheads, this is "progress".
