Applications for protection visas are assessed by trained departmental officers.

According to you - no application is needed

You just turn up and make a verbal claim

One simple has to make a claim, and then they become.......??

REALLY!!??

Yes, that's 100% correct Maqqa.

One simply makes the claim that they are seeking asylum, and they become an asylum seeker.

Did you honestly think there was an application form?   Grin

That would be section 28-51

LOL    Grin

No Maqqa, wrong again.

Those sections don't deal with applying to become an asylum seeker (because there is no such application): those sections deal with applying for visas.

There is no application form needed to become an asylum seeker.

I must admit, it is getting quite funny now.

He actually believes that one must apply to become an asylum seeker.

These asylum seeker threads remind me of a line from the 1970 hit single by The Temptations called "Ball of Confusion (That's What the World Is Today)"

"So, round and around and around we go."

Don't worry though... I'm sure there will be plenty of shopping trolley collection work available for alevine and the rest of the refugee advocates once they're out of a job when Prime Minister Abbott sorts things out. Smiley

Yes, and I'm 100% correct: one just makes the claim for asylum (verbally) and one becomes an asylum seeker.

Then, an asylum seeker needs to apply for a protection visa.

This is basic stuff Maqqa.

You can also be an 'Unlawfull Non-Citizen' AKA 'Illegal entrant' if you overstay your visa conditions.

Nope they arrive legally (EG. with a Visa as Lawful non-citizens) and then overstay their visa conditions and hence become unlawfull non-citizens (AKA "illegals") .  Big difference GPC. Huh

But they dont enter australia until they are granted visas.

That's the point of difference Borg.  They (plane arrivals) enter Australia legally.  Their bonafides are subject to screening.  Boat arrivals aren't.

They don't mean the exact same thing, which is precisely why the Migration Act was amended.

But they do according to the Migration Act.

It states

Quote:
14   (2)  To avoid doubt, a non-citizen in the migration zone who, immediately before 1 September 1994, was an illegal entrant within the meaning of the Migration Act as in force then became, on that date, an  unlawful non-citizen

They are the same which is the issue you raised. (Refer your Reply #128

So I guess your are wrong GPC?

No. Grerggery is absolutely correct.

You seem to have very poor comprehension skills.  The section you just quoted states very clearly that
what was deemed illegal prior to 1 September 1994, is now not illegal.

What was an "illegal entrant" is now an unlawful non-citizen.

Not illegal

And this is consistent with our obligations under the Refugee Convention:

The Convention stipulates that what would usually be considered as illegal actions (e.g. entering a country without a visa) should not be treated as illegal if a person is seeking asylum. This means that it is incorrect to refer to asylum seekers who arrive without authorisation as “illegal”, as they in fact have a right to enter Australia to seek asylum.

Ok Rabbit, if 'unlawful non-citizens' (AKA 'illegal entrants' according to the Migration Act) aren't unlawful (AKA "illegal")

WHY are they detained??????

BTW the Refugee Council doesn't make the law Rabbit?  You do realise that don't you? Grin

Refugee convention allows for detainment for a specified time to identify and go through the checks.  Doesn't mean they are illegal.
