(1) The Migration Act referenced it

Yes, the Migration Act references it by saying that "illegal" is no longer applicable.  The reference in the current Migration Act actually destroys your "argument".

"To avoid doubt, a non-citizen in the migration zone who, immediately before 1 September 1994, was an illegal entrant within the meaning of the Migration Act as in force then became, on that date, an unlawful non-citizen."

In case you weren't aware Maqqa, it is now after 1 September 1994: versions of the Act using the term "illegal" are now superseded (it's a big word, I know, but look it up in a dictionary).

Before September 1994: "illegal entrant".

After September 1994: "unlawful non-citizen".

Yes

they are illegal

No.  Learn to read.  They are  "unlawful non-citizens"

Not illegal.

It is legal to seek asylum
It is not illegal to be an unlawful non-citizen.

An unlawful non-citizen with a legitimate claim for asylum will be granted a visa when their claim is verified.
- Very good! You're slowly catching on. However, when something is "unlawful", that means it is illegal.

At no time in this process has the person done anything illegal.
- Awww, wrong again! I thought you were getting better. They tried to enter Australia without a passport and visa. It is illegal to enter Australia without these documents under the Customs and Immigrations Acts.

Anyone is entitled to go to a point of entry and request asylum it is not illegal.

"We should have ratified Kyoto," he said during a special edition of the ABC's Q&A program last night.

"Maintaining our Kyoto commitments but not ratifying Kyoto looked odd and, frankly, we should have apologised to indigenous people.

"It was overdue, it was gracious and I think the whole country felt buoyed."

"We lost the election, so I guess by definition we should have tried some things differently."

For the period 2001-2007 that equates to 1300

Under Gillard - 33,000 illegals arrived for processing

No, not illegal.

Show us where it says in the current legislation that asylum seekers, today, are illegal.

Waiting ...

Um, no.   Roll Eyes

Try using that line in a court of law and see how far it gets you.

'Unlawful' and 'illegal' are not the same thing.

Yes, the current version of the Migration Act 1958.

Not superseded versions.

Migration Act Section 14.2

Quote:
14   (2)  To avoid doubt, a non-citizen in the migration zone who, immediately before 1 September 1994, was an illegal entrant within the meaning of the Migration Act as in force then became, on that date, an  unlawful non-citizen

I believe the terminology in the current version is "unlawful non-citizen"

AKA -------> I L L E G A L ....entrant......... Huh Huh

That's correct.

Not "illegals", and not "illegal immigrant".
