Quote:Mr Setka is suing Tony Abbott for defamation over comments the Opposition leader made at a Master Builders Association conference earlier this year.
Mr Setka claims he has been "gravely injured" by his public portrayal as a construction site thug.
I do not wish to be seen to be endorsing the CFMEU's or Mr Setka's actions, but I find it curious that certain posters are defending Abbott by talking at length about Setka's actions and words, and his association with Mick Gatto and yet no-one seems to have even mentioned in passing what Abbott said that sparked this issue. Maybe Abbott actually did go too far and said something that was defamatory. Being pure and innocent is not a prerequisite for being a victim of defamation.
Quote:A leaked Victoria Police list of Mr Setka’s criminal record up to 1991 shows he was convicted five times of assaulting police. There were multiple counts of assault by kicking and resisting arrest.

his is a very worrying development. Regardless of who we are talking about, criminal histories should not be "leaked" to the media or the public. Is the source of the leak being investigated? ah here we go again kill the messenger..
ok we can see you prefer this type of person.. Setka..as an upright aussie person.. well done..
like I asked sob would you like one of yours to grow up like this man????
a simple question I think... as this man is setting an example.. Head of the CFMEU. is no baby shakes. he has a loud voice.. and he sets the tone..
so I ask again is this the type of person you would like to mentor a child of yours????
I would think the record of this man would be in ever newspaper archive..almost 40 convictions..
I know I know. you support him so let it be.
Kill the messenger? If it was information that was publicly available, or that was available under the Freedom of Information legislation, you could say that. I wouldn't see a problem with revealing it to a wider audience. However, the report mentioned "a leaked Victoria Police list of Mr Setka’s criminal record up to 1991". Are you suggesting that it is in order to leak highly personal information about a person's Police record to the public? With a person such as Mr Setka, of course a number of matters would already be on the public record, but not necessarily all. Mr Setka is entitled to the same privacy protection as any other member of the public.
A public servant or a Police officer can't just release information when they feel like it because they think it is in the public interest. There are certain provisions in place to protect peoples privacy. This is why we have the Privacy Act 1988 of the Commonwealth and the Information Privacy Act 2000 of Victoria. I am unfamiliar with the penalty provisions in those pieces of legislation, but I think I would be safe in saying that anyone leaking information about a person's criminal history would leave themselves open to diciplinary action, possible dismissal and maybe even prosecution for a breach of one or both acts.
As to your comment as to me preferring "this type of person", I would have thought that I already made it clear that I do not endorse his actions when I made my earlier post. I am assuming that you have a level of comprehension at least equal to that of a primary school student - but then again, I could be wrong.....
