Kathy Jackson sacks lawyers, asks judge to quit

HSU national secretary Kathy Jackson has personally told a Federal Court judge he should disqualify himself, arguing in court she had been denied procedural fairness.

It was an extraordinary morning on the last day of submissions into whether the HSUEast and the east branch of the federal HSU should be placed into administration.

In two hours, Ms Jackson sacked her lawyers, appointed a new one who then said he was unavailable, and made a string of adverse allegations about the conduct of the case so far, including the rejection of any need for an administrator until she had been heard in full.

Instead barrister David Rofe, QC, who earlier in the week appeared for Ms Jackson's partner Michael Lawler, sought to have the case halted for a week to enable him to get on top of the material.

Justice Geoffrey Flick said he wanted to know whether the whole course of the case - previously agreed by all parties - was going to change, allowing Mr Rofe 15 minutes to take instructions from Ms Jackson.

He said he had already reached a view that an interim administrator should be appointed, with the former federal court judge Michael Moore the most likely candidate.

But after the brief adjournment, Mr Rofe said he would be withdrawing as Ms Jackson's counsel today, as the judge had not given him enough time to make such a decision.

"In 57 years of practising at the bar table I have never been put in such a position ... this is outrageous," Mr Rofe said.

Approaching the bar table herself, Ms Jackson said she wanted Justice Flick to disqualify himself, as there was an "apprehension of bias".

Ms Jackson said she wanted her affidavit of June 1 to be read in full by the court and said: "I want to call all the witnesses."

She said comments by the judge earlier in the week, critical of her attempts to contact his chambers, were "suggesting that I was guilty of serious misconduct ... the clear implication was that I was guilty of contempt".

After rejecting Ms Jackson's application that he exclude himself from the case, she tried a second time, saying she had been denied procedural fairness.

However, Justice Flick told her she could make that application again next Friday if she wished, when she would be given a full opportunity to argue for a new course of the case, including fresh witnesses and evidence.

Ms Jackson also alleged former Justice Moore was far too "connected" to Workplace Relations Minister Bill Shorten and the ALP to conduct his duties without an apprehension of unfairness.

She sounds like a control freak and a workplace bully. The more you hear about her, the more you start to feel that Thompson was set upon or set up.

But who among you bought Thommos conspiracy theory?  Surely those claims were more outlandish than claiming a judge is too connected to the ALP to deliver a fair outcome.

What was outlandish about them? PoliticalReality did a pretty good post demonstrating that they were plausible.

There's some deeper background on this which makes her look even worse

She had her lawyers front the Supreme Court is NSW to have the whole matter moved to the Federal Court (there are both Federal and State registered bodies involved)

Arguing that it made sense to have it all heard in the one court

She won this argument

She then fronts up at the Federal Court hearings and argues that the court doesn't have the jurisdiction to hear the case!

And now she wants the judge to recuse himself because he's not ruling in her favour.

Yep this has all backfired on her.It is  looking more and more like Thomson was right, this was a set up from the start.
I hope it is uncovered and all those involved end up in jail, though I doubt any Libs will be left to run the party if that happens. Tongue

Yea, LOL ,according to the conga line Abbott had nothing to do with that at all. Funny thing is Abbott actually admits his involvement in the book Latham and Abbott,  I often read through that now Abbott has become the Lib leader and can not believe such a sly, untrustworthy,egotistical, sexist, racist, lying piece of sh it could lead a party let alond be a potential PM. Roll Eyes

A COALITION of right-wing extremists and conspiracy theorists has been identified as the driving force behind moves to revive the so-called Shreddergate affair as the federal election approaches.

Queensland Nationals senators Ron Boswell and Barnaby Joyce were told by government leaders not to proceed with plans last week to table in the Senate a 3600-page report by Sydney QC David Rofe on the Heiner inquiry in Queensland in 1989 and 1990, known as Shreddergate.

The report identified 67 possible breaches of the criminal code by Queensland cabinet ministers and public servants over the 1990 shredding by the Goss government of documents compiled by an inquiry headed by former magistrate Noel Heiner into Brisbane's Oxley Youth Centre.

Several investigations have dismissed claims of a criminal cover-up.

Mr Rofe told The Australian last week that Opposition Leader Kevin Rudd, chief of staff to premier Wayne Goss at the time of the shredding, was perceived as "the man we are after".

I'm a sucker for Australian political bio's,but I'm trying to break the habit. You should see some of the crap I've got, I used to collect them. But I lost one of my favourites, cant remember who wrote it but its about Holt, it was called the PM was a spy, or something like that. You got to love a good conspiracy.
