Stephen Fry supports end to 'homosexual panic' defence

British comedian Stephen Fry has given his support to a petition calling for the Queensland government to explicitly rule out the so-called "homosexual panic" defence to murder.

It was set up by a Maryborough priest whose church was the scene of a violent crime.

Richard John Meerdink, 41, and Jason Andrew Pearce, 38, were jailed for the manslaughter of Wayne Robert Ruks, 45, in the grounds of Maryborough's St Mary's Catholic Church in July 2008.

The court did not accept their defence that Mr Ruks had followed them to the church and tried to grab Pearce's crotch before he was punched and kicked to death.

Under current Queensland laws, unwanted homosexual or heterosexual advances can be used as a partial provocation defence to violent crimes.

Priest Paul Kelly says the defence should be completely struck out.

"I'm utterly appalled that a law that so revoltingly and openly discriminates against gay people is still tolerated in a modern society," Father Kelly said.

"Queensland is now one of the last states upholding the idea that a person can be panicked enough by homosexual people to justify grievously bashing them to the point that they die."

However, Attorney-General Paul Lucas says none of the states have a provision to exclude "non-violent sexual advance" as a partial defence.

"Like Queensland, they rely on a general provision and leave the matter to the courts," he said in a statement.

The ACT and the Northern Territory did have a specific provision, Mr Lucas said, adding that he had referred the matter to a committee.

The committee had been set up before the petition had started and would report back to the government by the end of the month, he said.

Mr Lucas said the Queensland Law Reform Commission had in 2009 recommended that judges decide in individual cases whether or not a sexual advance amounted to provocation.

He said that in line with the QLRC recommendations, the state government had also changed the criminal code so that words by themselves could not be used in establishing the defence.

I don't see the Liberal Party slashing and burning all of our hard fought for freedoms in this Country.

I don't see Tony Abbott getting a left wing Judge Finkelstein to do a shonky report for the Government so that Gillard can then go and burn, bash and bury our Freedom of Speech. If you think this post is paranoia do yourself a favour and read Finkelstein's recommendation, you will have to put your hand up to go for a sh.t once Gilllard brings in this draconian muzzle on our right to have an opinion.

This is a dreadful Government, a monster of a Government, a Government that would do Mao Tse Tung proud. It would also make Juliar Gillard proud after all, she was a full member of the Communist Part of Australia until ten years ago, right up to her age of 40!

This woman has an agenda and that is a totalitarian State with the Labor Party running it.

In all my life I have never seen such dangerous manoeuvres as the ones happening now; to give the Government more and more and more power. And the right of the citizen to have less and less and less say in what they think in the court of public opinion.

One thing is for certain, the Australian Public although slow to react to the outrageous attacks on our freedom will speak loudly when the election comes.

At that time Juliar Gillard and her Commie cronies will be buried deeper than the Titanic.
