Fined For Short-Changing The Workers.

Hungry Jack's fined for short-changing workers

A court has fined a central Victorian fast-food outlet and ordered it to repay $105,000 to 180 underpaid staff.   Smiley

The Fair Work Ombudsman took action in the Federal Magistrates Court against Chamdale Pty Ltd, which runs the Hungry Jack's store in Bendigo.

The franchise director argued he had been given the wrong advice about pay rates and entitlements.

The court ordered him to back pay the staff and imposed a $46,000 fine.

Craig Bildstein from the Ombudsman's office says staff as young as 14 were affected by the problems dating back to 2005.

"Twenty-nine of them were underpaid amounts above $1,000," he said.   Sad

"One individual was short-changed more than $8,000.

"Now, teenagers are often not fully aware of their workplace rights and they can be reluctant to complain, so obviously when we get allegations that this group in society is being underpaid, we treat them very seriously.   Wink

Young workers at a Cessnock pizza outlet underpaid by almost $50,000.   Angry

   

The Shop Assistant's Union has applauded the Fair Work Ombudsman for prosecuting a Cessnock fast food outlet caught paying its employees just $9 an hour.

It is alleged Stacborn Propriety Limited, which operates the Eagle Boys Franchise at Cessnock, underpaid 19 employees almost $49,000 between October 2008 and June 2010.   Shocked

The Ombudsman says junior workers should be paid at least $12 an hour.

The Union's Northern Secretary Barbara Nebart says she has seen many young workers in similar circumstances.   Sad

"Mostly it affects young workers who are either intimidated or ignorant of their rights and we find out about these things after they've left," she said.

"I must say the fast food companies that we deal with the majors are very good about this sort of thing, it's the smaller chains and the individual franchisees that get themselves into trouble."

Ms Nebart says some Hunter fast food outlets have been totally unscrupulous in the way they exploit teenage workers.   Sad

"We had a case not so log ago when a franchisee was well aware of what he was doing.   Angry

"We were taking him to the commission and he shut up shop and opened the next day with a different ABN.

"So we were unable to pursue a large part of what we were claiming back for employees because that's how he got around it."   Angry

If only they would pay their proper rates of pay, then they wouldn't get fined.  Anyway I suppose sometimes a fine or two can work wonders.   Smiley
