If your application for asylum is accepted, charges relating to offences against the Immigration Act will be dropped. That is just common sense.

If, however, the application for asylum is rejected, then a few things can happen depending upon the circumstances of how the person entered or tried to enter Australia. They will probably (after all avenues of appeal have been exhausted) simply be deported or in some cases (rarely) charged and fined or imprisoned for offences relating to the Immigration act. Imprisonment usually occurs for repeat offenders or those with serious problems relating to their character (i.e. previous criminal history, etc).

I hope that clears that up!

It is a crime to enter Australia with no documentation. It is not a crime to arrive in Australia and present at an entry point asking for asylum, this is what the vast majority of boat people are trying to do.

Do you guys get it - none of these people are trying to enter Australia illegally, they are doing exactly what it is legal to do.

Do you seriously believe that a taliban operative coming here to setup a sleeper cell is going to go through the boat channel as opposed to the plane channel? Anyone setting up sleeper cells will not be someone of security interest by any means - hence why it's a SLEEPER CELL. Therefore, what stops them on simply coming on a tourist visa?? Grin

Seriously, this fear is incrediably hilarious. Too bad you can never justify it.

The point is that arguing that arriving in a foreign country, unannounced, without permission or documentation is not illegal, is like arguing that black is white. If you can't even be honest about that, why expect anyone to listen to antyhing you have to say?
