The jury empanelment process has started in the trial of Erin Patterson, who stands accused of murdering three relatives after allegedly cooking a poisonous beef Wellington.

A large pool of potential jurors gathered outside the Latrobe Valley Law Courts on Tuesday morning, before being brought into the precinct.

The group has been drawn from the area around the trial location of Morwell, about an hour's drive from where the alleged poisonings occurred in Leongatha.

Over the coming hours, a group of 14 or 15 will be picked to sit in on the highly-anticipated trial.


The case, which has attracted global media attention, is set to run for up to six weeks.

The deadly mushroom cook behind the poisonous lunch that killed three of her relatives was an experienced fungi forager, a friend of the family says.

The friend said Erin Patterson was “very good at foraging” and knew how to identify the wild mushroom varieties near her home in Leongatha in Victoria’s Gippsland region.

“The Patterson family (including Erin and ex-husband Simon) would pick mushrooms each year when they were in season,” the friend told the Daily Mail.

“It’s very common for people to go mushroom picking around that area.”

It comes as Ms Patterson has hit back at being unfairly “painted as an evil witch”.

“I lost my parents-in-law, my children lost their grandparents,’’ she told The Australian on Wednesday.

“And I’ve been painted as an evil witch. And the media is making it impossible for me to live in this town. I can’t have friends over.

“The media is at the house where my children are at. The media are at my sister’s house so I can’t go there. This is unfair.’’

Ms Patterson, 48, invited her form er in-laws Gail and Don Patterson, and Gail’s sister Heather Wilkinson and her husband Ian to her home for lunch on July 29.

After eating the beef Wellington cooked and served by Ms Paterson, the guests became violently ill.

Gail and Don, both 70, and Heather, 66, later died. Ian is in hospital fighting for his life.

Erin’s ex-husband Simon Patterson was also supposed to be at the meal but pulled out.

Police suspect that the lunch contained highly toxic death cap mushrooms.

In a written statement to police, Ms Patterson said she bought the mushrooms she used in the dish at two separate stores — button mushrooms from a supermarket and dried mushrooms from an Asian grocery shop in Melbourne

The quote from the friend makes her sound even more guilty. How could you be an “experienced mushroom forager” and not recognise the most common deadly mushroom. Unless it’s a case of gamblers bias where she was lucky to find edible mushrooms most of the time and stumbled upon deadcaps for the first time. But if that’s the case she was merely a mostly lucky (until recently!) forager not an expert one.

The trial of a woman accused of murdering three elderly people after allegedly serving them a lunch of poisonous mushrooms began in Australia on Tuesday, as additional charges of the attempted murder of her husband were dropped by prosecutors.

Erin Patterson is charged with the 2023 murders of her mother-in-law Gail Patterson, father-in-law Donald Patterson and Gail’s sister Heather Wilkinson, along with the attempted murder of Ian Wilkinson, Heather’s husband, in a case that has gripped Australia.

All four became ill after the lunch hosted by the accused at her home in Leongatha, a town of around 6,000 people some 135 kilometers (84 miles) from Melbourne.

Prosecutors allege the mushrooms were served to the victims as part of a beef Wellington.

Fifteen jurors were selected on Tuesday at the Latrobe Valley Magistrates’ Court in nearby Morwell, with the opening arguments expected to begin on Wednesday morning.


Charges regarding the attempted murder of the accused’s husband, Simon Patterson, have been dropped by prosecutors, Justice Christopher Beale told the court on Tuesday.

“Those charges have been dropped and you must put them out of your mind,” he told the jury.

Erin Patterson has pleaded not guilty to all charges.

The case has generated huge interest both in Australia and internationally, with the six seats in the courtroom reserved for media allocated in a daily ballot. Dozens more are expected to watch proceedings in an overflow room set up at the court.

State broadcaster ABC is producing a daily podcast during the trial, which is expected to run for five to six weeks, while streaming service Stan has commissioned a documentary on what it says is
“one of the highest profile criminal cases in recent history.”

Some charges against alleged mushroom lunch killer dropped

Justice Christopher Beale told the jury that most if not all them would probably have been aware of the previous charges in relation to Patterson's husband, but said that the Director of Public Prosecutions had dropped them.

"In other words... you must put them out of your mind," he said.

He also urged them to "dispassionately" weigh the evidence in the case, using their heads and not their hearts.

The trial is being held at a small courthouse in Morwell, about 60km (37 miles) from Leongatha, Victoria, where prosecutors allege the lunch took place.

I doubt there is a potential juror who has not been flooded with the media coverage of this case. It's going to be a hard call - and a lot will come down to 'feelings' again - in which I am going to throw the Usual suspect (by now) problem  .... all those years /decades now of 'determining what is right by feelings' - pushed on us by the fringe feminists and those who saw clear opportunity by allying with that madness which has ended up with gonad chopping boards determining the 'gender' of a person in some Frankenstein Mengele manner - has lead to the position where a hell of a lot of 'balance of probabilities' is going to influence the outcome, Brittany style in the anti-Bruce Crusade (he has piggy eyes - must be guilty, right?).

How determine if she made a genuine mistake over the mushies - or it was deliberate from an experienced mushie picker? If there were so many mushies available for the picking - how did she get to pick those, when most of us KNOW (and I loathe mushrooms) they are not to be eaten? I wouldn't pick those for anyone else!  Why did she not get sick herself?  Avoid the mushies?  That's pretty much the case.....

It will all come down, in the minds of the jurors no matter how dedicated etc - to that.

She may well walk - but who is ever going to dine with her again?

but her story won't add up -
if she really got those mushrooms from a shop then why didn't
dozens of other customers and their families die too?


She was an expert in mushroom foraging -
so it looks like she went foraging -
found some death caps and cooked them in a meal for her victims.

I can't find evidence of something I heard or saw on the internet.
I remember hearing that she posted an article in the local newspaper
about how to safely forage for wild mushrooms and
she did so as a so called expert -
she was known as an expert.

It's possible the mushroom shop was spiked by someone. Then the lady would be shouting about it and demanding the shop explain how it could happen. Also, when preparing the meal she would handle the poisonous one and could recognise it, to exclude it. It had to be a whole mushroom in the shop or others would have been ill.

Ms Patterson served individual beef wellington portions – a dish of beef, mushroom paste, and pastry – to her guests on grey plates, while she ate off a smaller, orange plate, according to guest Ian Wilkinson, who became seriously ill after the lunch, but survived

The prosecution said Ms Patterson had posted online about using a food dehydrator to cook mushrooms, and wrote she had been "hiding powdered mushrooms in everything", the prosecution said

The prosecution also said Ms Patterson's fingerprints were found on a food dehydrator she was seen on CCTV dumping after the lunch. The dehydrator tested positive for death cap mushrooms, the jury was told

The prosecution alleged Ms Patterson lied about buying the dried mushrooms from an Asian grocery store, and that mobile phone data suggests she travelled to where death cap mushrooms grew

The defence argued that "what happened was a tragedy, a terrible accident" and Ms Patterson did not intend to hurt anyone
Ms Patterson's behaviour is being portrayed as "incriminating" by the prosecution, the defence said - but she "panicked" after her guests became ill: "Might people say or do things that are not well thought out... and might make them look bad?"
The defence said Ms Patterson was "generous and kind" to her family

The court heard Erin Patterson purchased a Sunbeam food dehydrator in April 2023.

At her police interview on August 6, the court heard Ms Patterson initially said she had never owned a food dehydrator but later said she may have owned one "a year ago".

Financial records showed Ms Patterson paid a fee at a waste transfer station for disposal of items, including e-waste.

Police later searched an e-waste bin at the disposal centre and found a food dehydrator in a black cardboard box.

Samples taken from the dehydrator found at the waste transfer centre were positive for amanita mushrooms.

The prosecution also alleged Ms Patterson kept two phones and switched SIM cards between them.

Analysis of one of the devices showed Ms Patterson had been talking to one of her online friends about a food dehydrator and how much she enjoyed using it.

The analysis also revealed she travelled to two nearby areas where death cap mushrooms had been identified as growing on a site called iNaturalist, a website where people can log flora and fauna they see.

Defence barrister Colin Mandy SC said Ms Patterson "panicked" and lied to police.

He conceded she did forage for mushrooms but said she was innocent of murder.

"The defence case is what happened was a tragedy and a terrible accident," he said.

"She's innocent."

Then – death cap spores were found in the dehydrator that she tried to get rid of.

Erin Patterson had a collection of books about mushrooms that she kept at her home where her fatal beef wellington lunch took place, according to a family friend.

The friend claimed the shelves of her family home at Leongatha included books about delicious yet potentially deadly fungi.

It was reported this week that Ms Patterson, 48, was an “experienced forager” who — like many families in the area — picked mushrooms when they were in season.

The friend said she had a number of books on the subject in her library.

I'd like to see clear evidence that she had those books, and that she was a forager etc...

It's called 'chain of evidence'   --someone says she had books on fungi - there are receipts or records of her purchasing such books or they are in evidence at her home....... otherwise it's hearsay.

This is like Martin Bryant - AFTER the event tall tales arose in the boondocks of Tasmania about how he was known to grab the steering wheel of the car his late benefactor drove and such and how he must therefore have caused her death and his own serious injury etc and thus gained her property and inheritance   ...  and that he was out shooting all the time and was an expert shot, which does not gel with his testimony on record and is not supported by ammunition purchase receipts etc ... and that he was known to be weird (well - he has a very low IQ) and loved surfing and didn't shoot animals ...

Somehow none of that gels with some alleged sudden urge to go down to the Broad Arrow and shoot some Asians/Japs or something ..... and in the absence of opportunity to do that - start shooting anyone in sight.... it just doesn't gel.

Where is the chain of evidence?  You can't just insert rumours and stories from neighbours... Where Are The Books?  Where are the people who went mushrooming with her in person to testify to her outstanding knowledge of all things fungi- including knowing the difference between the death fungi and others?

I'm starting to get the feeling she might walk on this one.....  and it's only just begun......

“It’s very common for people to go mushroom picking around that area.”

It comes as Ms Patterson has hit back at being unfairly “painted as an evil witch”.

“I lost my parents-in-law, my children lost their grandparents,’’ she told The Australian on Wednesday.

“And I’ve been painted as an evil witch. And the media is making it impossible for me to live in this town. I can’t have friends over.

“The media is at the house where my children are at. The media are at my sister’s house so I can’t go there. This is unfair.’’

Ms Patterson, 48, invited her form er in-laws Gail and Don Patterson, and Gail’s sister Heather Wilkinson and her husband Ian to her home for lunch on July 29.

After eating the beef Wellington cooked and served by Ms Paterson, the guests became violently ill.

Gail and Don, both 70, and Heather, 66, later died. Ian is in hospital fighting for his life.

Erin’s ex-husband Simon Patterson was also supposed to be at the meal but pulled out.

Police suspect that the lunch contained highly toxic death cap mushrooms.

In a written statement to police, Ms Patterson said she bought the mushrooms she used in the dish at two separate stores — button mushrooms from a supermarket and dried mushrooms from an Asian grocery shop in Melbourne


Obviously that's not true.

If she was expert on foraging for mushrooms and had relevant guide books

then she's as guilty a sin .... no death cap mushrooms should have ever been in her hand for collection, to take home or use in cooking.

She would have known straight away what they were.

Police have CCTV of her dumping a food dehydrator at the tip after the murders that contained death cap mushrooms despite her claiming she never owned a food dehydrator....Death cap mushrooms are not sold in Australia....Her mobile phone showed she was in the area in the days leading up to the murders where death cap mushrooms grow....Her relatives were poisoned with death cap mushrooms she fed them but avaoided consuming the deadly meal herself....Relatives have confirmed she was well aware what death cap mushrooms are....Yes definatly innocent???

Simon Patterson recalled that Erin had a few small uniform sets of crockery.


“She had a mixture of plates and it’s not that they’re all different to each other, but she had a bunch of ceramic plates generally that weren’t all the same, but there are a few of the same as each other,” Simon said.

“And then, couple more that was sort of same as each other but different to the first lot, if you know what I mean.”

Mandy: Amongst those plates, there are a number of colourful ones?

I didn't say she was innocent - I said she might walk on the evidence and how it is interpreted.  Wait for the actual Evidence in court - not tales of what 'relatives' say etc.... on local tall tales you'd likely be hung tomorrow at dawn....

We are all aware of the dumping of the dehydrator etc.... it's how it is interpreted that matters.  Her defence team started off saying she panicked after the others fell ill... meaning they are not contesting the dehydrator.... now all the other things have to come together to avoid any doubt.... and that means people don't just repeat local stories - they must have first hand evidence.

Now I'm no chef - but why dehydrate mushrooms for beef wellington?  I thought they were cooked whole in the sauce...

OK - 'mushroom puree' before baking...... who dehydrates mushrooms to make a puree?  Anyone - I'm not a chef or a mushroom cook....??  I hate mushrooms... now I know why...

Who was the main guest, and why did she want to murder them?

I haven't followed the story that closely, and all the evidence seems to indicate that she's guilty, but I can't find a motive.

Who knows what was going on inside that woman's head?

The prosecution only has to prove that she murdered them.

BTW - she won't take the stand so they can't ask her any questions.  ::)

Supreme Court Justice Christopher Beale has now concluded today’s proceedings by reminding jurors about the extensive media coverage of the case, and the fact they may come into contact with people over the weekend who know they are serving on the jury and will want to discuss the case.

“You have to shut that conversation down,” Beale said.

Beale also reminded jurors that they should ignore any information about the case online, and in the media, and urged them to “switch off”, enjoy their weekend and come back to court refreshed next week.

Where Are The Books?  Where are the people who went mushrooming with her in person to testify to her outstanding knowledge of all things fungi- including knowing the difference between the death fungi and others?

I'm starting to get the feeling she might walk on this one.....  and it's only just begun......


Police have CCTV of her dumping a food dehydrator at the tip after the murders that contained death cap mushrooms despite her claiming she never owned a food dehydrator....Death cap mushrooms are not sold in Australia....Her mobile phone showed she was in the area in the days leading up to the murders where death cap mushrooms grow....Her relatives were poisoned with death cap mushrooms she fed them but avaoided consuming the deadly meal herself....Relatives have confirmed she was well aware what death cap mushrooms are....Yes definatly innocent???

I didn't say she was innocent - I said she might walk on the evidence and how it is interpreted.  Wait for the actual Evidence in court - not tales of what 'relatives' say etc.... on local tall tales you'd likely be hung tomorrow at dawn....

We are all aware of the dumping of the dehydrator etc.... it's how it is interpreted that matters.  Her defence team started off saying she panicked after the others fell ill... meaning they are not contesting the dehydrator.... now all the other things have to come together to avoid any doubt.... and that means people don't just repeat local stories - they must have first hand evidence.

Now I'm no chef - but why dehydrate mushrooms for beef wellington?  I thought they were cooked whole in the sauce...

OK - 'mushroom puree' before baking...... who dehydrates mushrooms to make a puree?  Anyone - I'm not a chef or a mushroom cook....??  I hate mushrooms... now I know why...


Mushrooms go in fresh - whole or sliced - at my place.

You'd only use dehydrated if there were no fresh available - surely?

But she could be the type that goes out when wild edibles are in season and picks the lot - uses some and dehydrates the rest so they keep longer.

When police turned up to Erin Patterson's house, they began looking through the rubbish for a leftover beef Wellington.

An officer walked to an outside bin, put on some gloves, and started fishing inside.

"The bin had approximately three bags piled on top of each other," crown prosecutor Nanette Rogers SC told the Supreme Court in Morwell this week.

"The leftovers, which looked like a meat-filled pastry, were in the bottom of the bottom bag."
As a packed courtroom watched on, pictures of the stale-looking remnants were flashed up on the screens.

What was initially thought to be the source of food poisoning, then became a suspected murder weapon.

Reduced to its simplest form, the jury in Ms Patterson's trial will have to decide whether a beef Wellington cooked in her kitchen represents a terrible accident, or the ultimate act of betrayal.

According to prosecutors, Ms Patterson carefully crafted a plan to lure her in-laws to her home on July 29, 2023.

Fungi expert agrees death cap mushrooms under-reported in regional areas

Lawyer Sophie Stafford says Dr Thomas May has made clear the limitations of his opinion when looking at the 10 images and where he required further information.

“That is correct,” he says.

Under cross-examination by Stafford, May agrees that death cap mushrooms may not be reported on websites like iNaturalist because there are no regular surveys in the state besides “sweeps” done at some locations in the Royal Botanic Gardens in Melbourne.

He agrees there is an under-reporting of death cap mushrooms in regional areas.

Fungi expert shown pictures of mushrooms in court

Erin Patterson’s lawyer, Sophie Stafford, has begun cross-examining Dr Thomas May.

Stafford is taking May through 10 images of mushrooms and asking him to identify which ones are consistent with death caps.

May says some images do not reflect the actual colour of the mushroom which can make it difficult to determine the species.

For all of these images there might be a possibility … it could be something else.

Looks like Erin won't take the stand.

If it was me on trial and I was innocent there is no way
I could sit there for 6 weeks and say nothing -
I'd want my say in court before they locked me up for life
for something I hadn't done.

I’m not so sure that they are so easy to id.
I’m very slowly thinking she might not be guilty .

It’s definitely a case that will stop the mushroom market for a bit and I love mushrooms.

It’s the vegan answer to a steak!

I don’t believe mushrooms brought from a farmer or Woolworths are ever going to be dangerous !

Where did she say she got these mushrooms?
A Asian supermarket?

I suspect she picked them herself completely unknowingly they where deadly.

Mycologist told doctors death cap poisoning should be 'impossible'

A photo is shown to the court, which is the same photo emailed to Dr Truong on July 31.

It shows a picture of the beef Wellington pastry and some of the finely-chopped brown filling.

"I told her based on this particular photograph, I would not be able to give her identification," Dr Truong says.

"She said they had been bought from a supermarket and … a Chinese shop I believe."

Dr Truong says she told Dr Muldoon it was "probably impossible" to be death cap mushrooms, due to them only growing in the wild and being unable to be cultivated.

"I also told her there were absolutely no sightings of death cap mushrooms during the last months," Dr Truong says.

"Based on the information I received, it was highly unlikely to be a case of death cap mushroom poisoning."

This is remarkably unremarkable and it is one of the obvious flaws in the Jury system.  If anyone really believes Jurors do NOT discuss the day by day events of Trials with at least one Family Member, then you are denying human nature and common sense.  Sequestration is the answer especially when a person's liberty is at stake.  Yes, it costs large but, if we are fair dinkum about it, that is only way to prevent pillow talk.

This is remarkably unremarkable and it is one of the obvious flaws in the Jury system.  If anyone really believes Jurors do NOT discuss the day by day events of Trials with at least one Family Member, then you are denying human nature and common sense.  Sequestration is the answer especially when a person's liberty is at stake.  Yes, it costs large but, if we are fair dinkum about it, that is only way to prevent pillow talk.

I’ve been working so not really up on everything but it seems-

1 the police haven’t established a motive.

2 the police cannot prove it was death cap mushrooms added by her too the meal.

3 Mushroom experts are on record saying that what they have been shown aren’t death cap mushrooms.

There is now rumours of the occult and witchcraft.

Hmmmm, another “ dingoes got my baby “ case?

Was the poison something all together different? Added by someone without her knowing?

I do note the estranged husband new the dinner party was on.

It’s interesting. I don’t pretend to be a lawyer ( hi Aussie) but I just can’t see how they have proven she actually put the poison in the food.

It seems that there's not a single person on the planet who can answer that question.

They haven't.

The evidence against her certainly looks damning, but they haven't proven her guilt and they haven't suggested a motive.

Erin Patterson's phone connected to cell towers near where death cap mushrooms were growing in the months before the fatal lunch at her home, the Supreme Court has been told.

According to phone records, Ms Patterson's mobile was detected during a potential visit to Outtrim on May 22, 2023, a day after a mushroom expert posted that death caps were growing in Neilson Street.

The trial of Erin Patterson, who stands accused of using a poisoned meal to murder three relatives, continues.

Just thinking about my own mushroom foraging:

I went foraging for mushrooms myself, a few years ago and the problem was that even using
3 different apps on my mobile phone I couldn't identify the type of mushroom 100%.
All those apps had large warnings saying the results could be wrong
and that eating them could make you sick or even cause death -
so – all the mushrooms I found went into the rubbish bin
except for a few found on a grassy field – not under trees
that I was confident were ordinary safe mushrooms.
Even then it was difficult as some of them were known as yellow stainers
and had to be rejected -
if you ran your fingernail over the cap you'd see a yellow stain
yet they looked almost identical to the edible field mushrooms.
The ones I did eat were delicious and didn't hurt me.
I don't think I'd do it again – it's too risky and the ones
that are most prized seem to grow on wood which is also
where the most poisonous ones are too.

I think he was lucky by the looks of this case with 3 dying from it.
It must be hard to tell them apart… I see lovely mushrooms growing but I wouldn’t have a clue and can’t tell the difference.…so I don’t pick them.

As kids - we used to pick mushrooms - and I hated them even then.  As I grew to be able to decide my own likes in food - I dumped mushrooms and a few other things.

Point is - we never picked 'bad' mushrooms .. there were rules on what to pick and what to leave... only the best ones were chosen.

Anything that is not round, flat, white & with brown gills underneath is poisonous.

Like many frog and insect species - the gawdier/brighter the colours the more deadly poison they are.

One thing I miss from my 1950s childhood is
wandering around paddocks after a spring rain
and gathering mushrooms in a bucket.  There's
nothing quite like a black field mushroom sautéed
in salty butter, and maybe on toast or with a steak.

Nowadays farmers are using so many chemicals
on their pastures that I never see them growing
in the wild any more, and the pretend mushrooms
that Coles and Woolies sell are absolute crap.

Laughably, both stores call these things "field" mushrooms...

As a guess what he picked in the field was a yellow stainer mushroom.
They are very common amongst wild edible field mushrooms.
If you run your thumbnail across the cap
you'll see a yellow stain as per here and if you eat them
you'll get very sick but you won't die:

Also - amongst wild mushrooms the ones with white gills underneath are normally poisonous -
however - this type of shop bought mushroom is very tasty - amongst the best you can buy -

After the prosecution wrapped up their case, defence barrister Colin Mandy SC informed the jury that Erin Patterson would take the stand.

Here are some of the things we heard from the beginning of her evidence:

1.Erin and Simon Patterson met at work at Monash City Council in 2004. They started dating in 2005, got engaged in 2007, and married that year. Her parents were on holiday in Russia at the time so Ian Wilkinson’s son walked her down the aisle.
2.Simon converted her to Christianity. She described her first church service, led by Ian Wilkinson, as “a spiritual experience”.
3.Erin says the 2009 birth of her son was long and traumatic,  requiring an emergency caesarean.
4.When her son was ready to be sent home, the hospital wanted Erin to stay but she discharged herself against medical advice.
5.They separated in late 2009, the first of a number of separations. Erin said she and Simon had trouble communicating.
6.Erin told the court she had been fighting “a never-ending battle of low self-esteem”, particularly as she gained weight.
7.In 2023, Erin’s children were living with her full time. Their daughter often spent Saturdays with Simon Patterson, but Erin says their son only saw his father at church or youth group.
8.By 2023, Erin felt a distance had grown between her and the Patterson family, particularly Don and Gail. She didn’t think Simon wanted her to be involved with his family anymore.

Separation was 'difficult', Erin testifies

Erin says in the "immediate aftermath" of the separation, "it was difficult, as it had been at other separations".

"But that only lasted a handful of weeks. We went back to just being really good friends," she says.

She says she "constantly" reflected on the reasons for the separation.

"I didn't want to be separated, but I felt there was no choice," Erin says.

"Our primary problem was, if we had a disagreement or any kind of conflict, we didn't seem to be able to talk about it in a way where either or us felt heard or understood. We just felt hurt, and we didn't really know how to do that well."

We return to the preparation of the deadly lunch

We're back on the meal preparations, as Erin outlines how she fried the steaks on both sides, then let them rest.

Then she assembled the beef Wellingtons.

"I used the egg flip again to, I guess, lift a little bit [of the duxelles] out of the oven try and put on each steak ... and then wrapped each one in filo, and then wrapped each one in puff pastry," she says.

She says she made six of the individual beef Wellingtons.

"At the appropriate time, I put them in the oven ... I wanted them to be out and resting by 12:30 [when guests arrived]," she says.

It is clear she DID put the mushrooms in the meal - she is accepting that - her defence is that she did it inadvertently - which is contradicted by the fact that she alone did not get sick at the meal time.  Her kids eating leftovers - of the dish she specially prepared for herself, is not a valid argument.  If the kids DID eat leftovers from the full meal - they would have fallen ill as well.

Prosecution continues on Erin's conversation at hospital

Dr Rogers suggests that Erin lied to the doctor about mushrooming.

Erin responds that "nobody was interested in what I did months and years ago" during those conversations, and that everything was all centred specifically on the meal.

"Are you telling this jury that you understood Professor Stuart to be asking you questions only about the beef Wellington?" Dr Rogers asks.

"I believe that's what I understood at the time, yes," Erin says.

Erin's asked about previous evidence from another senior doctor at Monash Health, Rhonda Stuart, who saw Ms Patterson days after the lunch.

The doctor previously told the court she asked Erin where she had bought the mushrooms in the meal from but Erin was unable to tell her specifically.

Professor Stuart previously told the court she had asked Erin "if she'd been mushrooming and if she'd used any other mushrooms" but Erin told her no, she'd only used the two types of mushrooms described, from Woolworths and the Asian grocer.

"Do you accept that Professor Stuart asked you if you'd been mushrooming?" Dr Rogers asks.

"I accept that that's what she said," Ms Patterson says.

"Did you, in effect, say no to Professor Stuart?"

"To which question?"

"If you'd been mushrooming."

"I don't remember that conversation."

Dr Rogers suggests that in that conversation, Erin denied going mushrooming to Professor Stuart.

"I don't remember the conversation," Erin repeats.

I think she’s admitted it has occurred and how but I don’t believe the police have proven intent.

Guilty of man slaughter definitely but so far I see no evidence of murder.

It’s a really interesting and  totally tragic event.

I agree. If there was ever intent of murder of 4 persons, one would think of being more discreet so as not as obvious. She’s just too easy for the pickings and trial by media imo.

I read how she was saying her son and grandfather were like 2 minds together. They got on so well.
I doubt she would want to kill that.

Just because people don't have media savvy personalities or even perceive the Media as an all powerful god with its Holy Celebrities, that rule their entire persona and existence of correctness.
The Media will paint them as akin to heathens, unbelievers and GUILTY of being untrue.

She better not lie in court – that would be perjury.

She has told so many lies outside of court -
to the doctors at the hospital,
to the police, to her guests at the meal,
the list goes on and on.

In my uneducated opinion I don’t believe that she can be found guilty of murder as what she has admitted to is man slaughter.

If she is acquitted will she walk free or face a future trial for man slaughter?

When Erin Patterson went to the hospital or even knew about her
dinner guests being in hospital after her meal -
she should have taken all mushrooms she had in a bag and any leftover or
thrown out food from that meal to the hospital so the chemists there
could analyze it for poisons.
There is an antidote for death caps and if taken soon enough
they may very well have still been alive.

All she did was hide the truth and try to cover up any evidence -
then claim she panicked in case it was pinned on her -
she didn't think about those poor people who were poisoned by her food -
only herself.
Just her bad attitude would make me vote against her if I was in the jury -
whether the poisonings were deliberate or not.

without telling my guests first because
everyone knows that wild mushrooms can be poisonous and are hard to identify.

Erin Patterson took to the witness box for a seventh day today, as lead prosecutor Nanette Rogers SC continued to question her.

Here's what the court heard:

1.Dr Rogers said Ms Patterson was "initially reluctant" to have her children assessed at hospital following the deadly lunch because she knew they had not eaten leftovers from the contaminated meal and their lives were not at risk. Ms Patterson said that was incorrect.

2.Ms Patterson was asked why she would feed her children leftovers even though she'd been experiencing diarrhoea in the aftermath of the lunch and knew some of the guests were unwell. Ms Patterson said she "didn't know or suspect" the meal had made them ill.

3.Ms Patterson accepted that the ENRICH Clinic in Melbourne, where she previously told the jury she had an appointment regarding gastric-bypass surgery, did not offer gastric-bypass procedures.

4. The accused maintains she bought dried mushrooms which she believed ended up in the fatal meal from an Asian grocer in Melbourne's south-east. But the prosecution said that was a "deliberate lie" because "you knew you were guilty of deliberately poisoning your [guests]". Ms Patterson rejected that.

5.Ms Patterson told the jury a beef Wellington was "the perfect meal" for pungent dried mushrooms. Ms Patterson previously told the court she had avoided using dried mushrooms she purchased from an Asian grocer because of their strong smell.

No motive either.

Wy would anyone procure poisonous mushrooms?
I'ld imagine poisonous mushrooms are not easy to get.
They are not commercially available.
Why would anyone go out of their way to identify, travel somewhere, pick some, then bring poisonous mushrooms home?
Why put them in a desiccator?
Why discard the desiccator away afterwards?

She's not a stupid person, she worked briefly as an air traffic controller which is a very hard course to qualify from.

But smart people do dumb things.

If she indeed killed them on purpose, all she had to do was claim it was a terrible accident form the beginning and there would be probably no case. She could say she foraged the mushrooms and made a terrible mistake. The max case they could bring would be something like criminal negligence.

I'm the same as Gregg and Daves - I feel she is guilty - but you cannot convict on a feeling.

The prosecutor is intensely rhetorical - which also raises concerns in my mind.  It looks like she is working very hard to give the worst impression rather than letting the facts speak for themselves - as they must.

If Patterson were a yob bloke with a magistrate - she'd be a goner.

Let's see what a jury can work out.

Eh nein,i can collect poison mushrooms any day after rain followed by humidity in my front yard/ jungle.

I never would because-

1 doesn’t matter how much a expert you just can’t tell the difference between the good ones or death ones.

All logical points.

And then there were the spontaneous tears - poor little innocent me.  But she knew what she was doing.  She is not an uneducated person. She procured those death cap mushrooms and used them in the meal knowing full well that they were there - otherwise she would have innocently eaten them and died along with others or become extremely ill like the one survivor. She knew what death cap mushrooms are, she knew what they looked like.  She made sure she didn't eat any.

The husband has also eaten meals made by Erin Patterson that left him in a near fatal condition in hospital. 

Honestly, I know my cooking is pretty much atrocious but I've never left anyone retching after a meal - let alone on death's doorstep!

The jury is out now.

My opinion -

The judge seemed to be on Erin's side when he gave the jury advice.
He said something about how she wasn't on trial for lying -
she couldn't be convicted of murder for lying -
even though any jury member would see those lies as
an attempt to cover up the crime.

If the jury follows that advice then Erin might walk free.    :-/

I've been mushrooming myself and believe me more than
90% of what I picked went into the rubbish bin.
Even all those Apps on the web can't 100% identify any mushroom.
Any mushroom near a tree with white gills is too suspicious to eat.
Was she asked any questions along those lines?

Even field mushrooms can look OK but with the poisonous yellow stainers -
you rub your thumbnail across the cap and if it leaves a yellow stain – don't eat it.

No verdict in mushroom murder trial today
Jurors in the Erin Patterson murder trial have concluded their deliberations for today.

The jury will resume deliberations at 10.30am tomorrow.

The Daily Mail's live coverage will commence from 9am local time on Saturday, July 5.

What happens after the jury reach a verdict
Media, court watchers, true crime fans and various other people including members of the prosecution are waiting around the small Latrobe Valley courthouse where jurors are deliberating.

Once the jury reaches a verdict on whether Patterson is guilty or not guilty of murdering three lunch guests and attempting to murder Mr Wilkinson, parties including Justice Beale and the defence and prosecution will be notified.

Mr Wilkinson (pictured below) has been present in person for most of the trial but hasn't been sighted since the jury was retired to deliberate.

Simon Patterson, Erin's estranged husband, has not been seen at the court since the early days of the trial, which kicked off on April 28.

The next step after the jury alerts the court it has reached a verdict will be to give parties 15 minutes' notice to return to the courtroom for the result.

As a result, most media and legal representatives are keeping very close to courtroom 4 at Morwell where the verdict will be delivered.

Most interested parties are in the courthouse, but some are waiting at a nearby café and other media are gathering outside.

The jury will hand their verdict to Justice Beale via his tipstaff and then they will be asked to confirm the verdict.

Erin Patterson definitely has mental health issues.  It's quite obvious she is a pathological liar. But whatever happens in her trial and the verdict, I am more concerned for her kids' future mental health.

Take for instance the "death wall" in her house.  These drawings by the kids are not normal.

The man, who asked not to use his name, got a phone call from a real estate agent last year asking him to paint the wall so the property could be sold.

“I’ve looked at it and gone, holy sh*t, what the hell’s going on here?” he told news.com.au.

“I went, this is actually really scary for kids to do this inside the kitchen-dining room. I didn’t think it was right, it looked scary. It just didn’t look right to me as a parent.”

The 46-year-old said he was struck by the multiple references to death, and particularly the tombstones.

“That sort of stood right out. It was eerie. I think I put four coats of primer undercoat and two coats of wall paint to cover all that texta.”

The tradie said he snapped the picture and apart from showing a few mates, didn’t think of it again until the fatal mushroom poisonings hit the headlines.

“Now of course this mushroom thing’s come out,” he said.

“They keep to themselves,” he said.

The tradie told news.com.au he was aware homicide detectives wanted to speak to him about the photo, the existence of which had been previously reported.

It's fortunate the tradie took photos of the drawings before he cleaned and painted the wall.

So ... will she get 20 years on each count to be served concurrently, ending up with 18 years non-parole and a max of 20 years?

One good thing is that the judge went out of their way to direct the jury about the salient points leaving very little to no chance for any appeal to hold any water.  8-)

Now that a finding of guilt has been made by twelve people good and true - it brings home the sheer horror of poisoning someone in that way... what it does to their body and how they die.

It takes a special kind of insanity to do that - but does that amount to lack of guilt due to mental illness?  We all know that people who commit heinous crimes have to be be insane to do them - but at the same time we consider that their ability to reason to the point of assuming it is a good idea means they are guilty....

Albo is on one winner in taking away access to sites to kids under sixteen - I'm dropping TOG at hospital Thursday and staying three days until she is awake and settled, when her family will take over - I KNOW that access to some sites is unavailable in that hospital....... I was struggling to log in to one at 9 pm in the foyer and it said 'closed' ... bloke thought I must work there....so why can it not simply be made unavailable anywhere on choice?

Clearly the technology is there........ all it takes is the will and public awareness that it IS available to keep their kids out of ball cutting sites and similar...

Legally, manslaughter is generally a heat of the moment action or extreme carelessness over your actions. Murder usually requires a degree of premeditation and an understanding of what your actions are likely to achieve. She certainly ticks the boxes there.

Not really - you see, the whole thing really comes down to a 'balance of probabilities' - except that in the case of a criminal trial the facts presented are more part of the equation, and emotion is far less. Given the number of mistakes - there can never NOT be some level of uncertainty in any finding..... there must always be some level of Doubt - the question becomes - is that level of doubt sufficient to offer a defendant a Not Guilty verdict.... at THAT point the 'balance' is not of 'probability' - but of the effect of the actual proven realities and how they balance out.

That is why you must never say that a person found to be 'responsible' in a civil action is Guilty .. Guilt is ONLY accorded to an individual found PROPERLY (it hurts my soul to say that) guilty according to solid, supported and undeniable reality (not 'facts' - a word that has become abused in jurisprudence) in a criminal action.

There will always exist the possibility that the tale was as she told it - and her actions were those of a person frightened by what happened and not thinking clearly... but that is a possibility - not a probability, and the weight of realities is against her.

I await the appeals... should be interesting.

I am unsure if it was some underlying narcissistic or if she was a psychopath. She has supposedly lived life crime free up until she murdered those people. People thought she was quite normal.

So what could it have been?

Was she so full of hate and resentment to the point she committed the crime? Because real hate can really consume a person. It is why forgiveness is such a powerful thing.

There are no excuses for what she did. Murder is wrong, but the method she used was quite cruel. It was literally death via rapid liver failure. Not really the way a person would want to exit this life.

We hear it “I never meant to kill…”
People don’t realise that it may not take much for a person to die from … as you say, carelessness.
Why did she then panic and rid the dehydrator later rather than earlier?
But her actions, and lies were her undoing. She could’ve gotten away with it from an accidental inclusion of deathcap mushrooms in the meal… or at least had a lesser sentence for manslaughter.
Premeditated…. not enough thought from someone with no previous crime …. Her husband did get ill from her cooked mushroom meal… yet he survived. Maybe Erin thought her guests would just get ill and survive like her ex did? Plot twist…3 died.
Oops moment from her way of thinking. Didn’t mean to kill them?

I think this ridiculous story coming from women on the inside about Erin tampering with their food?
Really? How?
I’ve heard she had a couple of wishes whilst she’s been locked up 2 years… a doona, a pillow, and writing materials. Simple stuff yes? She was denied it all apparently.

Erin Patterson has been found guilty of murdering three people and trying to kill a fourth by poisoning them with death cap mushrooms.See all 13 stories.
What made her think she could get away with it? Why did she do it? As a psychologist, these are the questions I have heard asked over and over in relation to the so-called mushroom trial.

Erin Patterson’s explanations for her behaviour stretch credibility, or – as the prosecution put it – “beggars belief”. The answer can perhaps be summed up by American self-help guru Wayne Dyer – “When I change the way I look at things, the things I look at change.” The quote is meant to show how changing our perspective can improve matters, but it also demonstrates how the lens we look through affects our perception of reality.


The reason Patterson, who on Monday was found guilty of three charges of murder and one of attempted murder, thought she could get away with it, the reason she did it, was because she does not see the world the same way as you and me. Her lens is likely different. Though I have not personally assessed Patterson, insight may be gained by considering her world view from the perspective of the narcissist.

Most of us start life believing we are the centre of the universe, then through a series of reality checks, we learn we are merely a bit player. It’s reasonable to consider that Patterson learnt a different lesson – one in which her survival depended on her remaining at the centre of her world with everything and everyone else revolving around her.

Through the eyes of the narcissistic personality, they are the central body, while others are mere appendages whose words and deeds fall in an orbit around them. Greek mythology tells us that Narcissus was the exceptional hunter and beauty cursed by the gods to continuously fall in love with his own reflection whenever he stared into a pond. A lesser-known part of the story is that the reason Narcissus was cursed was because he rejected any suitor who showed an interest.

Acceptance and rejection are the over-arching themes for the narcissistic personality. On the one hand, the narcissist craves acceptance and will go to great lengths to morph their interests and behaviour to fit in. On the other hand, their reaction to perceived rejection can be excessive and brutal.

In Patterson’s case, she became a Christian to be accepted by the Patterson family. In her mind, she was loved and belonged, but her fragile self-worth made her doubt her position – a situation necessitating ongoing vigilance and maintenance. For those around her, especially family and friends, her attempts to fit in would have come across as alternatingly pleasant, awkward, and irritating. Irritating because the underlying fakeness would be palpable.

While the narcissist might genuinely believe in who they have become, they have not really become anything. They have simply undergone a temporary transformation born out of a desperate need to be accepted. Since their sense of self is so fragile, so too is the transformation.

On the witness stand, Patterson transformed herself again. She was “sorry” for saying awful things about her extended family. The defence facilitated this perception of a normal, sometimes cranky person who naturally clashed with her extended family. Just like the rest of us.

To outsiders, the narcissist is obviously duplicitous, but the narcissist themselves does not necessarily experience their contradictory words and actions as fake. Their fakeness is their reality. The “real” Erin Patterson, is a constructed confection that changes on an as need basis according to the circumstances. When a young Patterson was working as an air-traffic controller, a former colleague described her as someone who “managed to get guys wrapped around her little finger although she was very unkempt … [and] abrasive”. This highlights the two sides of the narcissist – the outwardly charming, bright person whose mental reality breaks through via eccentric outbursts and abrasive interactions. An otherwise competent person whose dishevelled appearance betrays an internal disorganisation.

Patterson’s use of confabulation – where facts are fabricated, distorted, and misinterpreted – as well as bold-faced untruths and compulsive lying are entirely consistent with this type of personality; one which desperately seeks to control the narrative. The narcissist may not truly make the distinction between the truth and a lie because their whole life, their whole self, is a lie. When they lie, they are in fact, being consistent.

Ironically and sadly, the narcissist’s desperate attempts to fit in can drive people away. Their personality, finely attuned as it is to any signs of change in relationship dynamics, picks up others’ irritation or withdrawal, triggering overwhelming feelings of impending rejection. Panic sets in and a compulsion grows to control the situation. Poorly developed skills to remedy everyday misunderstandings leads to more drastic action. We can all feel insecure, but for the true narcissist, the smallest hint of displeasure from those with whom they seek attachment sends them into a raging, destructive cycle. Since everything revolves around them, minor words and actions from others take on major significance.

From our lens, the parents-in-law’s refusal to get involved in their son and daughter-in-law’s squabbles could be seen as an attempt to be diplomatic, or even a way to protect their relationship with both parties. The narcissist may not truly make the distinction between the truth and a lie because their whole life, their whole self, is a lie. When they lie, they are in fact, being consistent.

Ironically and sadly, the narcissist’s desperate attempts to fit in can drive people away. Their personality, finely attuned as it is to any signs of change in relationship dynamics, picks up others’ irritation or withdrawal, triggering overwhelming feelings of impending rejection. Panic sets in and a compulsion grows to control the situation. Poorly developed skills to remedy everyday misunderstandings leads to more drastic action. We can all feel insecure, but for the true narcissist, the smallest hint of displeasure from those with whom they seek attachment sends them into a raging, destructive cycle. Since everything revolves around them, minor words and actions from others take on major significance.

From our lens, the parents-in-law’s refusal to get involved in their son and daughter-in-law’s squabbles could be seen as an attempt to be diplomatic, or even a way to protect their relationship with both parties. But for the narcissist, the parents’ response is perceived as malevolent and threatening. It’s likely Patterson truthfully believed she was being “cut out” of the family dynamics, even if that was not the case. For the narcissist, this signals rejection and rejection cannot be tolerated, or left unanswered.

So much description, can fit many of us. There are many like this that walk amongst us, family, friends, casual aquaintances.
Aren’t we all a little bit at the mercy of being judged for our shortcomings?
If anyone of us, committed a crime to be plunged into a media circus, would give analysts a field day dissecting us.
Only difference is, many have stayed under the radar. But not without having caused friction amongst family/friends. Then there’s the few that go to the extreme and can’t help themselves as consequences are furtherest from their minds.

True.  The best outcome from her conviction is that she will not have any parental control over her kids and their future upbringing.  It's obvious the kids are suffering.  Just looking at their drawings on the death wall in their former home, you can only conclude that these drawings are not normal.  In fact they're quite alarming and very disturbing.   

The kids are obviously going to need therapy in the short term.  Whether they ever get over this is another question.

She needs help, not just a good defence lawyer… I shudder to think how she will cope on the inside with other inmates.

Being super-smart doesn't mean a person has all the abilities and experience to deal with every situation - often the opposite.  That's why we're called the Civilised Tribes - people have been sneaking up on us for centuries now..

What you say here does point out that she could easily be simply a lost soul, as her defence contended.. I said already that there can never notbe some degree of doubt.... so it's a question of the weight of evidence one way or the other - a sort of 'balance of probabilities' on steroids...

It IS possible that all the things she claimed did happen the way she says they must have - the question is - is it PROBABLE?

The musings of an intelligent person trying to work out how something could have happened must not be mistaken for making up a story... intelligence dictates that the person try to work out the hows and whys...

The p-spike herself says she has not formally interviewed Patterson... and we all know from my first book how p-spikes are often out of touch with the real world.   School - uni - into a job determining issues for people they've never met and who live in a different world where sometimes truth is stranger than fiction ... sums it up for the Veteran community at large, for example....

I'm not sure that she is clinically insane - though certain of her behaviours MAY indicate that she is somewhere on the autism scale - something not unusual in highly intelligent individuals.  There is a sort of disconnection between actions and results/outcomes - she complained about lack of adequate bedding while on remand (and other things) - those are reasonable complaints..... maybe not having her own laptop all the time, but still... that tends to show at least a slight disconnect from harsh reality.

I personally have a genius IQ - estimated by DVA at 150+ - though I don't believe any organisation that consecutively says I'm sane...... and I lack certain social connection skills ... NOBODY has absolute control over what social interaction 'phrases' they use and nobody has complete knowledge and understanding of those things... we all have our blind spots..... and highly intelligent people CAN be more prone to deep internalised thinking, and thus may appear to be what my sister once described me as - an absent-minded professor ....

Such things are easily misunderstood... and can be misconstrued for public viewing.. distorted beyond belief...

Maybe she just thought she would teach the bastards by making them sick...... maybe she just didn't think through the actual outcomes... most people don't when dealing with 'new ground' and there are countless personal factors that can influence an individual's ability to think through things.

NOBODY can grow up knowing how to handle every single thing - and most things are learned by 'mine detecting' - if you lack proper guides and guidelines, you step forward and only when you step on a mine do you realise you have made a mistake.

Maybe she had poor parenting herself and did not 'know the ropes' and over a lifetime struggled to find the right ways by default - by making mistakes, as so many do.

Been there - done that.

Yet…. It appears she was because….she wanted to blend in, feel a need to belong or accepted.
It was said she’s like a chameleon and changes with whomever she is talking with.

As for criminal past… is this it?

In the same year Erin met Simon, she had her first serious brush with the law.

In June 2004, Erin was almost three times over the legal limit when she was involved in a drunken crash at Glen Waverley.

Court records reveal she was driving an unregistered car and didn't stop after the crash or give her name and address. She was also driving 35km/h over the speed limit in a 60 kilometres per hour zone.

Erin pleaded guilty to five charges and was convicted and fined $1,000, which she elected to pay in $40 monthly instalments.

Her licence was cancelled and she was disqualified from driving in Victoria for two and a half years.

It would be interesting to hear from some of the subpoenaed witnesses -
especially doctors or medical people.
I wonder how happy they were to have to appear in court
so far from Melbourne in a place with insufficient proper accommodation?
Were they required to be there for days at a time waiting for
a short 1 hour appearance in court?
What about all their patients in Melbourne?
Were their lives put at risk?
Were they in constant contact via phone or video link to
keep tabs on their patients?
Did operations or medical procedures get cancelled?
Did they lose a lot of money?
Did they give short answers to complicated questions just

I am unsure if it was some underlying narcissistic or if she was a psychopath. She has supposedly lived life crime free up until she murdered those people. People thought she was quite normal.

They are put in a real type situation with a simulator -
their control panel and video display
in front of them - headphones on listening to pilots etc.
they have to make life and death decisions under extreme pressure -
sometimes with certain items switched off to simulate equipment failure.
They have to be able to work in manual mode when many systems fail.
I doubt that even 1% of people in society could handle that job.
The divorce rate amongst the workers is usually 100%.

Erin Patterson will spend at least 33 years behind bars for murdering three relatives and trying to kill a fourth with beef Wellingtons laced with death cap mushrooms.

A Victorian Supreme Court judge today handed Patterson, 50, a life sentence for the 2023 murders of her in-laws Don and Gail Patterson with Gail's sister Heather Wilkinson.

However, Justice Christopher Beale spared Patterson the harshest penalty under the law – a life sentence with no parole – meaning she could potentially leave prison if she is still alive in the year 2056.

Patterson has already been in custody for close to two years.

This is a truly dreadful, cold, calculated thing to do.  I always say no conviction can be 100% without doubt - but when the accused lies and changes stories ....

It was premediated - she betrayed her only friends and
caused them great suffering and death.

She should be hanged from the highest yardarm in Port Phillip bay.

She shouldn't be given special protection -

she should be among the general prison population.

I appreciate judges are untouchable in our current society/ system but I would love to hear from someone to speculate about his decision and why one life taken is worth less then another?

Prisons probably not that bad for an old woman. Good food
Health care. A library. A gym.
Probably like a nursing home but without all the really old crumbley people moaning and calling out in the night.

I think prison would be horrific if you were 20 but for an old duck with no friends.  OK.

she will probably get a job as a consultant about a Netflix series based on herself as well.

She's a drama queen - she'd hate jail.

She had it all - a nice house, plenty of money -
why the hell did she murder all her best friends?

Scoot she's only 50 - that's not old.

If she does her 33 years non parole - she would probably classed as old & grumbly (not crumbley  ;D) - though you never know.

I'm sure there are plenty of young phukked in the head prisoners who cry out in the night .....

especially those on the receiving end(pun intended)whether they be male or female.  ;D

Dog only knows what goes through judge's minds... you'd think such a crime was worth the full penalty for each case and consecutive.  I'll say again - there is always some doubt... but in this case the convicted herself lost the case by spreading here stories firstly and then too thinly.

"I cannot tell a lie - I BOUGHT those mushrooms from a Chinese market...:"

"Where was that market?"

"Ummmm - Woolworths?"

Mushroom murderer Erin Patterson is challenging her conviction on seven grounds, taking issue with jury management during deliberations and "oppressive" prosecution questioning while she gave evidence in her trial.

The 51-year-old was convicted and jailed for life in September with a non-parole period of 33 years after being found guilty of murdering her former in-laws, Don and Gail Patterson, 70, and Gail's sister Heather Wilkinson, 66.

A jury found she deliberately served beef Wellingtons laced with death cap mushrooms to her lunch guests in July 2023 at her Leongatha home in regional Victoria.
