What public opinion was that? How was it expressed? How was it collated? What were the questions asked? Does that mean that every person disadvantaged in the past now requires reparations?
The High Court struck down terra nullius, the Native Titles Act was born.
Just carry the cross, there's no turning back.
Native title was not ownership of a swathe of land simply claimed as freehold..... it was squatter's rights with a proven connection to that land and continuous residence/occupation. You cannot have continuous occupation of a vast swathe of land by occasionally having a few of your group wander over part of it, same as every bushwalker cannot claim continuous occupation of that National Park land. There is no basis for this kind of handover. They are free to use it - and so is everyone else, as a
National Park.
Even Eddie Mabo, though forbidden to go to his land, had family connected there, and there was no conflict of ownership, unlike Mt Warning.
National Parks are not available for freehold.... always was national land.... always will be. This is nothing but a bunch of politicians and unelected public servants pushing on the people they are supposed to be working for some total change to suit a small minority.
Ne Passerons!
Throw out these governments, clear out the public service, and start again.
The answer is NO! This is NOT the law - it is the steady erosion of that law and the gradual creep of interpretation by unelected public servants with an interest and without proper oversight and accountability to ALL stakeholders.
This is the inevitable outcome from a single stupid and half-baked decision by one court... and it must be set to rights by legislation that guarantees genuinely equal rights. There is no longer any privilege of anyone here claiming all the land they can see just because they can see it.... those days vanished in 1788.
If the LNP does this - and Labor is the alternative government.... any thinking person must move to the extreme parties.
Both LNP and Labor have shown us repeatedly that they are the greatest dangers to democracy and to genuinely equal rights for all.
