How many times do they need a hung jury before they decide not to continue/persist?  I thought the jury would be instructed that if they had doubts they must return a finding not guilty - so now we are seeing 'hung juries' more and more.... so the prosecution keeps going until they get one that sides with them... WTF???

I remain concerned about 'majority' juries, too.... if one person is correct, that person constitutes a majority of one.... we are watching the steady erosion of legal rights in this nation while you all sleep.... anyone with any experience of courts knows the lower courts are outright criminal in the way they smash through rights of any defendant, and uphold any nonsense the prosecution may put forward... we all know they are just there to beat the public into submission, which is why they are enemies of the state  ...  now with this serious weakening of rights in gross criminal matters before higher courts, we are seeing a very dangerous trend.

Bad point to list for appeal, that draws attention to the fact he literally chewed on her genitals and drew blood. He is also a very strong sportsman, he could easily have held her against her will giving her forcible oral sex. Lawyer Grappler, you just got your client another 5 years, what else you got? Appeals can go both ways, he wont appeal. He may get  a longer jail term, in fact the state would be more likely to appeal at the leniency of the sentence.  Violent rape can attract a sentence of 25 years, Im sure his own legal advice is telling him that.

Didn't say it was a point for appeal, though it may reflect the real state of affairs at the time.  The evidence that he chewed is not much and left too long.... a lot of assumptions there.... the 'bite' was only the opinion of a doctor six weeks later.... maybe he has a razor blade tongue

Of course, you've hit upon another thing that needs to be ripped out of the courts or those who sit in the courts ripped out to cut it out - this nonsense that anyone convicted, who then appeals, will be punished for pursuing his/her legal rights with a longer sentence etc.

Legal rights are inalienable and cannot be subjugated by threats, intimidation and bullying in this manner - even if those come from the courts themselves.

If you cannot see the clear dangers in that, I can't help you.

A clear indication of precisely why we need a massive overhaul of our courts..... to make them do their job properly for a change... once that datum is properly established, it should trickledown to the perjurors in the prosecution community ..... once they note that they cannot get away with bullshit any more..

Everything you say points more than clearly to the need for a royal commission into jurisprudence.... and into the management of legal rights in this nation - we are long past the convict colony stage ...

Well - when a person pursuing legal right of appeal is actually threatened by a court ... and a childish move by a petulant court clearly designed to reduce appeals is what it is in reality -  a pretty clear abrogation of that legal right has occurred.  Clearly a very flawed position given our high rate of Wrongful Convictions....

Rights are inalienable... and no court has any right to petulantly cry about its workload.. if you can't handle the job - there are plenty of other ways you could earn a living... and let us never forget - the courts serve the people as sovereign - the people are not its subjects in the sense that they can be pushed about at whim.  There is a world of difference between pure bullying and petulance and proper application of the law as required.

Under our system of law, nobody is 'wasting a court's time' by pursuing legal rights.... and such bullying must cease forthwith.

We don't live in a convict colony, regardless of how bad things are over there in the west... and we don't live in a society that any longer recognises any 'class' differences between court and people.

Every successful revolution sees judges go to the wall... ask yourself why..... then look around properly.

There is no JUSTICE system in Australia.

It is a law system, designed and lorded over by a grubberment intent on subjugation of the masses.

There is no JUSTICE, just control.

If there where justice, we woukd have the right to self defence, we do not.

If there were justice, politicians woukd be charged and incarcerated for their crimes.

If tgere were justice, politicians and senior public servants selling off Australia in corrupt deals would wall be in gaol.

Analyse This, Smith!

Analyse what? No amount of gum flapping or wishful thinking by you will change the fact that you and I weren't  in that jury to see the evidence.

... coming into the final quarter - Smith again selectively quotes without even attempting to address the issues posted... what's your take on this, Hal?..

Well - from down here on the sidelines there is no way Smith is going to make any headway against this strong and very - very solid posting of realities.... unless Smith can find a little energy in the engine room in the next ten minutes or so... well.. it's looking like a white-wash for Smith today...

that's because the 'issues' posted aren't based on fact but instead on you acting out with your old white man syndrome.

They are the issues on which Hayne was convicted, according to a lawyer who knows the case....

You got anything real to add to the discussion.. or are you just breaking in some new slags on people?

I see an overturned conviction coming up......

No, jared was convicted because he didn't understand what NO meant
