That is very relevant.  Evidence of 'recent complaint' is an exception to the hearsay rule.

It may be admissible but whats the strength of it. She had 32 years to back up her complaint but did not file a formal complaint. Unless the coroner gets something more than what she told people and the diary she wrote, how can the corona find that porter has a case of rape to answer?

I heard someone say the other day that these woke men like Pastafarian are like Turkeys voting for Christmas. Absolute lemmings. destroying this man's life when there's no prospects of conviction ior getting to the truth because its 32 years old and she cant give evidence because shes dead and it seems, there are no other witnesses to what happened AND she did not file a formal complaint for 32 years, its disgusting. And if you cant work out that its disgusting your that Turkey the joke is talking about.

There will be much more than what she wrote and has said.  There will be evidence either putting them (alleged victim and perp) or not putting them in the same place at the relevant time.  Many people would have been around at the time.  They all need to be spoken to.

The whole point of an Inquest is an attempt to determine the cause and circumstances surrounding the death of anyone, including those who suicide.  It starts with no preconceived notions, and allows the Coroner to hear what there is and announce what he can as supportable findings.

So tell me this. Why do they need the Federal govt to launch an inquiry. She died last year (I think). Why have they not had a coroner's inquiry by now in NSW/SA?

She died in SA.  That State has jurisdiction.  There will now be pressure for SA to have an Inquest, I am sure.

But her death is an entirely different issue to her alleged rape 32 years ago. As I understand it they're (perhaps her family) are putting pressure on the Federal Govt to approve an inquiry into the alleged rape under whatever powers the Federal Govt has to approve such inquiries. It would be a federal inquiry (even though perhaps conducted by the relevant state court system) to determine whether there is evidence (criminal standard, civil standard?) that Porter raped that lady 32 years ago? Isn't that what's happening? Nothing to do with the death?

I don't know the SA Legislation.  But up here, in Qld, and in my time, an Inquest was held to determine several things including the cause of and circumstances surrounding the death.

Well I haven't read anything to suggest that the death is in any way the focus of the inquiry being sought. No one is trying to stitch up Porter with her death from what I can tell. Its all about whether he raped her or not and whether the Fed Govt will approve an inquiry into the rape.

There has been plenty of media speculation about an Inquest to be held in SA, where she died.

Yes but that may be because the fed govt often uses the state courts for federal matters and this is very much in the nature of a coroner's inquiry

1988?

so she was assaulted and then , because this is a criminal act, she proceeded to the police station.

except it took her 32 years to get there .

FFS.

there should be a statute of limitations.

people cant recall what happened 32 days ago, much less 32 years.

this avenue of mud slinging has to cease.

and apart from the reputation trashing , what is the prospect of a conviction.

the whole western legal system is based on "innocent until proven guilty"

allegations are just that, meaningless drivel until tested and proven in a court of law.

disgraceful, disgusting stuff

Totally disgusting. And whats a corona going to find. She told some friends and family some time later (hearsay). She wrote it in a dairy some time later (hearsay). Has anyone, esp police ever spoken to porter re the allegation and got anything even approaching an admission? A letter from him to the lady "Im sorry I raped you that day". If there's nothing but this lady's allegation that she did nothing about for 33 years and the reports indicate that she suffered from mental illness. Trial by feminism is what this is and its disgusting.

...

A  Mens' Rights Activist speaking here.  Tsk, tsk.  Roll Eyes Roll Eyes

The word, BTW, is "Coroner" not a "Corona".  There is a clear difference in meaning between the two.  Look them up.  Tsk, tsk.  Roll Eyes Roll Eyes

This isn't like remembering what you had for dinner 32 days ago. Its remembering a traumatic event

there isnt a public figure around who wont be susceptible to this type of "accusation".

all reputation destroying.

want to destroy someones reputation.

get someone from your tribe to alledge  the "me-too" game.

disgraceful and disgusting

Then stop acting like "alpha" males.
