Court rejects Qantas workers bid for sick leave
Qantas workers, including those battling cancer and heart disease, will not be allowed to access accrued sick leave after a federal court ruling this morning.

The ruling bars workers from accessing sick leave after Qantas stood down workers at the beginning of the pandemic. Several workers have been forced to accept redundancies during this period in order to pay medical bills.

Qantas has previously been found to have misused and underpaid the JobKeeper wage subsidy and is currently attempting to outsource all baggage handling, ramp workers and cleaning jobs.

Last year Qantas CEO Alan Joyce was the highest paid CEO in Australia and the highest paid airline executive anywhere in the world.

“Qantas has abandoned long-term workers with serious medical issues by refusing to allow access to sick leave during a stand-down.

“This is a deliberate decision that Qantas and Alan Joyce have made. They have a responsibility to these workers, some of whom are dealing with life-threatening medical issues, and have the money to pay out sick leave. They are refusing to do so.

“These workers are uniquely disadvantaged, being stood down and also unable to pursue work elsewhere due to illness.

“No worker in Australia should have to take a redundancy to cover medical bills, least of all during a pandemic.

“Qantas has attacked workers at every turn during this crisis. They are currently trying to outsource thousands of jobs in baggage handling and cleaning, in an attempt to cut wages and conditions for workers.

“We stand with the airline workers in their unions who are continuing to fight for fairness in the face of appalling conduct from Qantas.

“The Morrison Government has walked away from the airline industry, leaving thousands of workers unsure about their futures during an unprecedented crisis.

that sounds so UN Australian I thought we were better than that....I know they expect the govt to pick up the tab  but I am not sure thats the point   these people have EARNT THEIR SICK PAY...it wasnt a gift...

I think that says enough about the 'courts' that are in the pay of their political masters.... the kind of 'courts' we have here.

Let's look at this closely people - we have top public servants directly liable to the government of the day via contracts - we have top military personnel in precisely the same position - we have such people as DPPs on contract who decide which cases will be sent to trial - we have courts that have always, in this country, done what they are told (we need only look at some of the vile regulations/legislations and policies that have gone through unchallenged when the courts should have thrown them out at the first hearing) - and we have a persistence in the 'courts' of the good old 'back City Hall' approach from many lower end 'judges/magistrates', who often lack the balls to stand up and say:- "Sorry - this 'law' does not abide by the Rule of Law and is rejected."

Each and every one of these KNOWS with every move that they can be terminated and their contract voided - if they do not follow the wishes and whims of their political masters - each and every one of these commits vile acts of injustice and economic violence against those in their care.....

One of the safeguards of Western democracy has been removed here, people, by the likes of Howard, Keating and other parasites and leeches - each of these bodies above is supposed to be independent - not under the direct orders of the government of the day or abiding by its attitudes like some schoolboy currying favour with the master.

Stand Up Now - Or Spend Your Life On Your Knees!

P.S.  Something had been niggling at me for some time - Peter V'Landys, ceo' of the NRL - I said Jeez he looks like the same Mafia type who was stonewalling over the merciless slaughter of race horses - sure enough - it was him.   Now HTF did he get a gig as 'ceo' of the NRL?  Who Does He Know and Who Runs This Country?  What is a slimey asshole like that doing running our national sport?

They had sick leave - they are merely stood down pending work starting again - they must be entitled to it.

It took my until nearly 70 to work that out.... the world would definitely be a better place without some... and that is a pretty high proportion at this time.

And "stand down" laws need to be changed.

They may no longer accrue any sick, long service, or super but what they have already accrued is theirs .....

the Govt even allowed people to early access their super during the COVID19 pandemic - not that I think that was a good idea - but they have to live -

and Qantas withholding what was already theirs is just a low act .....

even worse for those who were already very ill.

In the case of stand downs - there should be options for staff to take all accrued paid leave before they no longer receive no pay.

And despite that they are still on the books as "employed" until such time as they are sacked or made redundant.

"This means that time stood down is included when calculating an employee’s entitlements under the National Employment Standards, such as notice, redundancy and leave."
