Yet another complicated territorial situation being 'watered' down by tabloid newspaper for the commoners to consume. Lets begin...
1. The initial claim on these Antartica territory was by the United Kingdom in 1841, and later on transferred to Australia. In 1961, the Antarctic treaty came into force through UN. And article 4 specifically deal with territorial claims.
Article IV
1. Nothing contained in the present treaty shall be interpreted as:
(a) a renunciation by any Contracting Party of previously asserted rights of or claims to territorial sovereignty in Antarctica;
(b) a renunciation or diminution by any Contracting Party of any basis of claim to territorial sovereignty in Antarctica which it may have whether as a result of its activities or those of its nationals in Antarctica, or otherwise;
(c) prejudicing the position of any Contracting Party as regards its recognition or non-recognition of any other States right of or claim or basis of claim to territorial sovereignty in Antarctica.
2. No acts or activities taking place while the present treaty is in force shall constitute a basis for asserting, supporting or denying a claim to territorial sovereignty in Antarctica or create any rights of sovereignty in Antarctica. No new claim, or enlargement of an existing claim, to territorial sovereignty in Antarctica shall be asserted while the present treaty is in force.
So in a nut shell, the article pretty much said you can claim your land, may be, but you cant prohibit others from claiming land. As a result, only four countries in the world recognized Australia's claim in Antartica, and these are: New Zealand, United Kingdom, France and Norway. The rest of the world does not. So if you have any notion that the Chinese is building on 'our' land, then.. think again.
Currently there are total of 8 stations in the Australian antarctic territory. Australia has 3 stations (Mawson, Davis, Casey), Russia has 3 (Mirny, Vostok, progress station), Romania has 1, France/Italy has 1, and China 1 (Zhongshan). So where is the outrage against Russia and Romania?
All true except China doesn't give a rats about any international law or treaty as clearly shown in the South China sea.
By far the Chinese have more presence down there than anyone else, tens of thousands of Chinese tourists every year, massive amounts of krill fishing and building stations smack in the middle of Australia's claimed territory.
"Given Beijing’s track record in moving rapidly on a broad front, as it’s done in the South China Sea, we need to be prepared to respond to a rapid increase in the speed and scale of its actions in Antarctica.
We shouldn’t help China use Antarctic research for resource exploitation, to gather information on advanced technology with clear potential for military purposes, or to act in environmentally harmful ways. Australia should regularly inspect Chinese facilities (and China can inspect ours)."
China is using the old rule which states: Possession is nine tenths of the law!
