Exactly petal. They do however take direction from the Minister. They do not have to abide that direction.

The question remains why don't the Prosecutor's appeal the sentence if they consider it too light?

perhaps they are abiding Ministerial direction. Wink

There are some here who insist it happens at Federal level, why should State level be any different?

Their top cheeses are considered employees as in contracted employees - they do as they are told..... that was the beauty of Howard's Way - contracted senior staff are directly subordinate to the government of the day, and are by no means independent.  One falcup.. one refusal to do as directed ... and your contract's ash... and it's adios muchacho...

Now back to the issue....

Should repeat offenders be tried as adults? 

Thus far - at last count made public -
54
people have been charged with bushfire offences this disaster season... - now that doesn't mean they all lit bushfires... but those who did will not want to be facing a magistrate...

Considering climate change chaos and prolonged droughts will be the norm then penalties for starting bushhfires will have to be increased...no doubt burning crops in the increased extreme conditions will be a great tool for terrorist...reap what you sow.

Yes - not all are calculated acts... sometimes it's the Darwin Effect in action...

"I think I'll just have a small burnoff in a high wind, and huge temperatures, dry grass and bush, and during a total fire ban.. Should be OK..."

Still charged, just not with an act of arson... you need to be a true arsenole to do that... and it remains conspicuous that fires seem to suddenly start during high winds etc.... and often in the same areas and downwind of built-up areas... and even around the same time of day...

Funny that...

the fact that ANY ADULT is charge with starting a fire is a shocker for this country...... Angry Angry Angry

kids Roll Eyes well lets face it  some are not mentally stable....but we are far too lenient when it comes to dealing with this god awful problem.....people are dying   because of louts....

is it time we did more advertising about fire bugs and the consequences.........its time we sent a message of rage and anger to those who may think its amusing  Angry Angry Angry Angry
