A pair of former Subway employees claimed they were underpaid about $36,000 as young workers by the franchise owner.   Sad
Kate told A Current Affair she started with Subway aged just 16, eventually working her way up to store manager - when, she says, she realised "Subway doesn't do things right".
"I worked when I first started for $9.04 an hour," she said.
"And that was during the day, at night, Saturday, Sunday and public holidays."
Kate claimed she had been underpaid almost $13,000, including super. (A Current Affair)
She claimed that over two and a half years, she was underpaid almost $13,000, including super.
Dylan, who worked for the same Subway outlet, claimed he was underpaid almost $24,000.
The pair confronted the franchisee, Perry, but say they were "completely disregarded" and were threatened with losing their jobs.   Sad


In 2017, they turned to Fair Work Australia, and Perry agreed to pay them some of their unpaid wages.

But so far, they said, they had not seen a cent.
One of the provisos of Kate and Dylan getting that money was that Perry sold the franchise.
Kate claimed he texted her saying he had listed the franchise with Peter Cardamone Real Estate - but after A Current Affair checked, the response came back that the real estate had not listed that business for sale.
A Current Affair approached Perry but he did not comment, saying the issue was with the Fair Work Ombudsman.

In a statement he sent later, he said the ombudsman had investigated Kate's and Dylan's claims, and had facilitated a settlement.
Former Senator John Williams, who spearheaded a franchising inquiry that rocked the $182 billion sector, said he believed people like Perry were stuck between a rock and a hard place.
"The franchisor needs to see that they treat their franchisee fairly, that the commodities, the ingredients they supply to the small business are at a competitive price and not a rip-off price, so the franchisee can make a profit and they don't become desperate," he said.
Kate claimed she and Dylan told Subway about their allegations, including while still employed there.

"They never did anything about it," she said.
Felicity Sowerbutts from the Young Workers Centre said plenty of former Subway staff had contact them to complain about illegal underpayments.
"Head office is washing their hands of responsibility," she said.
Wage theft is not the only reason Dylan wanted to speak out - he said he felt Subway was not doing enough about food quality.

"We were never allowed to throw anything out," he said.
"You know, if it was out of date, oh well, just keep it, keep using (it)."
Kate claimed she had seen food picked up off the floor and put back in the sandwich bar. She also claimed she had been made to retrieve a box of rotten tomatoes she had thrown out.
In his statement, Perry said his restaurant had never served ingredients that did not meet food safety standards, undergoing monthly compliance checks.
Kate and Dylan also claimed they had witnessed unsafe food practices. (A Current Affair)
A Subway spokesperson said Subway's food safety requirements exceeded industry standards.
And the spokesperson said that they were concerned with the allegations of wage underpayment against Perry.
"Subway is undertaking a detailed, independent audit of Perry's restaurant processes and employment records," the spokesperson said.
"The restaurant continues to be reviewed monthly across a range of compliance areas."
The federal government has recently moved to fix the scandal-plagued sector by creating a Franchising Taskforce, with the prospect of bigger fines

Hi sir Crook,
I know someone who worked in a fruit shop.
One day he went through all the apples on display
and removed each one that had a bruise or
signs of being rotten - he put them in the bin.
The manager told him off  -
then took all the apples out of the bin
and carefully put them back on display -
rotating each one so the bruises could not be seen.

Always check each item of fruit before you buy it.

bobs I often pick up a piece of uneatable fruit in supermarkets   I put it in a spot where it can be seen by everyone...fruit can go  bad very quick its a huge problem....it is tough having to bin something you have paid for and cannot sell....

lets face it  I believe we waste more food than we eat in this country....  its disgraceful.

Hi Cods,
it's got so bad that I buy only 2 or 3 apples
at a time and carefully inspect each one first.
Gone are the days when I'd arrive home
with a bag full of rotten or soft apples.

me too bobs  I only shop for me...lol.. but most of our fruit today is kept in cold storage for ages.....

dont know about you but we never had  apples and oranges all year round in my day....we had seasonal fruit and veggies...

I think its an awful shame what we have done to the market.....they have even stolen the smell as well as the taste of fruit.

Subway have always been a very bad employer.

There's also something else very dodgy about them which might be made public soon, if the authorities keep investigating.

After picking - they store them at about 2 degrees
in a nitrogen filled cool room.
That way they last for over 10 months.
However  - the nice smell of a fresh apple
is gone after only 2 months.
The trick when buying?
Smell the apple first.
