A female driver is furious after receiving a hefty fine because
her passenger was using FaceTime while she was driving.

'I honestly didn't know that was a thing': Driver fumes as she's handed a $337 fine for a VERY little-known offence - as fellow motorists share her outrage

    A driver was fined $337 because her passenger was on her phone using facetime
    Others shared her anger, but police and RMS confirmed it's a legitimate offence
    Last month a NSW man was fined because his passenger was using a laptop.

A female driver is furious after receiving a hefty fine because her passenger was using FaceTime while she was driving.

Sheree, from Sydney, posted a photo of her $337 fine to social media, saying she had no idea she was breaking the law.   

'Tell your passengers to stay off their phones while you are driving, I got fined because my passenger was on FaceTime,' she wrote. 

'Honestly didn’t know that was a thing.'

The offence on the fine was listed as 'Drive vehicle with TV/VDU image likely to distract'.

Her post has been shared more than 10,000 times, and other drivers echoed her anger, arguing the little-known offence should be publicised more.

'What a joke. They haven’t advertised this much. As if we need something else to control while we’re driving,' one woman wrote.

'Ok this is ridiculous. I get drivers being off their phones etc but this is pathetic,' wrote another.

'Tell me you’re going to fight this?!?! That’s ridiculous,' another woman wrote.

But it turns out that the bizarre offence is actually a law in New South Wales.

It's crazy.
What if you have a Tom Tom Sat Nav stuck to the bottom of the
the center of your windscreen?
I use one whenever I don't know the streets well.

Would I be fined in NSW?

What about cars with an inbuilt Sat Nav?

Doubt I'm imagining when not long ago, flat screens were being touted as a feature of vehicles

flatscreens in or just under the dashboard for viewing tv, news, movies, etc.

what happened to those?  How did they pass muster

its madness   what about people who smoke in their cars..its all a distraction of some kind... Roll Eyes Roll Eyes

someone needs to take this to court....its too bizarre for words...

what with  put your seat belt on buzzers

will we have.....now put mobile in the glove box.buzzers?.

what about that radio  how many push buttons on them or put new music on... Roll Eyes Roll Eyes

all the while driving...

they are interfering in our private space far too much...

It seems that the Legislation that nobody knew about does not specify that requirement while it would make sense if true there is no indication that it is.

Cops can legally use mobile phone, did you know that?

The grubberment is not getting their anticipated immoral revenue from speed $cameras because people use their GPS and social media feeds to warn them.

The grubberment are now looking additional revenue as the start putting drivers off the road for drink and drug driving. ( this is a good thing, keeps them off the road)
But the grubberment recognise that no licence means, in most cases, no tax revenue and quite possibly dole payments.

So the grubberment have decided, through their slut, the roads authority, to generate as much dirty money as they can.
Mobile phone use.....massive fines
Obstruct your number plate.....massive fine
Bald tyres....a pittance of a fine.
Which is the greater danger?

Get ready to be fleeced
The grubberment want and need your money
They will use every sneaky, immoral, barely legal and sometimes illegal means to get it.

And why do they want this money?
To give to parasites, lots and lots of parasites
Muzzos
Reffos
Abbos
Dead beat dole bludgers
Politicians
Senior public servants.
Etc, etc.

The working class are expected to fund these parasites with 1/3 or more of their income every year.

It is nothing new for people to look at a police car and see that the officer driving can be usually on his/her phone as he/she proceeds to a job. And there "ain't nothin' we can do aboud-it". Police are exempt from laws regarding the use of phones whilst driving.

Facebook search for her name. Look up her profile. Then look at her location. And if that does not tell you enough, you can look at her photos. Then use a process of elimination and estimation to figure out her address. Or you could use a phonebook if she is listed. After you get to her house.... ask if you can have a feel. If she refuses, it was not worth the time, expense and effort.

When you're driving your car, that's all you should be doing.

Eating, smoking, fiddling with the radio, etc. all have the potential to distract drivers.

Many years ago I saw a driver in front of me kill himself by changing tapes in his car's cassette deck.

As he lent over to reach the centre of the dashboard, he inadvertently turned the steering wheel and went over an embankment.

The car landed on its roof, and he died on impact.

I have no problem with police charging drivers who are distracted.

I don't want some idiot running into me while they're texting their friends.

And so the R&M come up with any semi- legal, immoral and corrupt mechanism they can to grab as much cash from the worker they can.

Bring on double demerits, or more accurately
Holiday time, time to saturate the roads and raise revenue.

Remember when the RTA were accused of revenue raising?
They stated it wasn't and they made all minor offences 3 points, at double demerit time it became 6 points.
Then people were losing their licenses hand over fist, revenue was down because no car meant no job, no job meant no tax.
So the grubberment redesigned the points system
1 point for the 90% of offences, less than 10k over the limit
And many more for the rest.

Best of both worlds, lots of revenue, and still working.

Now they are taking licenses off people for drug and alcohol offences
When they start losing more revenue, they will change that rule too.

Money is king to the grubberment
They don't care how they get it

By the way, it was mentioned in her facebook photos that her infringement notice was revoked due to the officer being misinformed about the rule regarding distraction. The rule only applies to the passenger being distracted if the passenger is at the time teaching the learner driver at the controls of the vehicle.

But, SPERS wanted a piece of the pie, adding the offender levy on top of that decision. SPERS can get the minimum repayments I am allowed. bugger-em. I better not be getting increased demerit points, too.

Speed cameras are about as accurate as a two Bob watch.
They measure your speed over 1 metre, that's right, 1 metre.
The signal is picked up by a piezoelectric sensor in the road and sent to a computer mounted in a box on the side of the road.

As your wheel goes over the second piezoelectric sensor, a second signal is sent to the computer

If the timeframe is too short, it tells the camera to take a picture.

Bingo, flash for cash.

Now the facts
Piezoelectric sensors are know to fail or malfunction regularly.
Putting them in an environment that can be anything from 0 deg to 60 plus degrees will cause them to malfunction even more often.

Then there is the computer
We all have computers don't We?
All of our computers function flawlessly every single day, don't they?
And putting a computer in a box on the side of the road that has temperatures of a similar range to the road 0 deg to over 60 deg c is really going to be beneficial to the computer function.

Trucks, cars and other vehicles also vibrate
Quite a bit in fact.
Out of balance tyres can affect the piezoelectric sensors
Vibration can and does destroy circuitry in the boxes that house traffic lights.

(I used to test these things and you should see how truck noise vibration destroys the circuitry)

But the speed camera computers, far more complex than traffic light computers, won't be affected like every other electrical device, because the known lying R&M tell us so????

Finally, you get the "fine" in the post weeks or months after the event.
It's virtually impossible to prove you were not speeding at a time weeks or months before.
And the grubberment have circumvented the law by making you guilty without actually proving you are.
You must prove your innocence, rather than them proving guilt.

Our grubberment are all crooks
The R&M are even bigger crooks, justifying their lies and corruption by claiming they save lives.
But there is ZERO , nada, nuffink to prove that putting up speed cameras and camera cars has actually saved even one life.

try dealing with the dept. of immigration .... they make SPERS look like alter boys. They fuq up, mix up their files so they're looking at the wrong person altogether and you can prove it, and your only choices are to appeal or to start all over again and apply again, both of which cost the same ($2500 14 years ago ... god knows what they charge these days) but the appeal can take up to 12 months.  Cheesy Cheesy Cheesy

I will tell you some of the details. It was a public holiday. The officer was under pressure to fine any motorist to justify his job. I came along about a second too late to go through an amber light. The traffic lights turned from amber to red when I was about halfway through the intersection. I exited the intersection a second later. The officer put his emergency lights on and intercepted me down the road. Officer explained to me that I could have stopped at the stop line. I told him otherwise. I figured that there was a rule -- later told to me by a duty lawyer -- that if you cannot stop safely for a yellow light, you may proceed through. It is now told to me that even if you cannot stop for the stop line safely, you should stop safely over the stop line and back up. Only excuses are emergency reasons, or if a car is following behind. $391 fine - 3 point demerit.

The court did not want to hear any of my claims that I tried to brake, even after I pointed it out to her in the dash cam footage of a red flash, and even the car coming in to view that I was braking until I withdrew braking procedure and rolled over the line and then kept going. I left the scene of the intersection well before the officer's vehicle had got the green light. I did not impede or do any dangerous on the road. If anything, had I tried to stop for the stop line, I would have gone off the road.

What really irks me is that the prosecuting lawyer acted like this was an open-and-shut case. The audible scoffs she gave when I was giving testimony. The all-high-and-mighty attitude about how I should have easily gone from 50kmh to 0 inside a distance of 10m from the stop line. The way she summed up by telling the magistrate how to do her job giving her directions. Oh, and she was acting on the police's behalf at no cost to the officer. I wish I could have had a representative speak on my behalf, given that I was not in any considerable fashion someone with lawyer experience.

I wish the Qld police would make up their minds on what is acceptable.

It is a levy made against a person found guilty of a driving offence after contesting the charge in court. Not only do you risk having your fine increased, and pay court costs. But, you have the SPERS go after you with another cash grab.

In other words,
The grubberment have decided, not just to punish you for some semi- legal cash grab fine
But if you have the gall to dare and question them, they fine you on top of the fine?

But you can't get compensation for your time and effort to fight the fine if you win.

And this is an honest system???????????

I will tell you some of the details. It was a public holiday. The officer was under pressure to fine any motorist to justify his job. I came along about a second too late to go through an amber light. The traffic lights turned from amber to red when I was about halfway through the intersection. I exited the intersection a second later. The officer put his emergency lights on and intercepted me down the road. Officer explained to me that I could have stopped at the stop line. I told him otherwise. I figured that there was a rule -- later told to me by a duty lawyer -- that if you cannot stop safely for a yellow light, you may proceed through. It is now told to me that even if you cannot stop for the stop line safely, you should stop safely over the stop line and back up. Only excuses are emergency reasons, or if a car is following behind. $391 fine - 3 point demerit.

The court did not want to hear any of my claims that I tried to brake, even after I pointed it out to her in the dash cam footage of a red flash, and even the car coming in to view that I was braking until I withdrew braking procedure and rolled over the line and then kept going. I left the scene of the intersection well before the officer's vehicle had got the green light. I did not impede or do any dangerous on the road. If anything, had I tried to stop for the stop line, I would have gone off the road.

What really irks me is that the prosecuting lawyer acted like this was an open-and-shut case. The audible scoffs she gave when I was giving testimony. The all-high-and-mighty attitude about how I should have easily gone from 50kmh to 0 inside a distance of 10m from the stop line. The way she summed up by telling the magistrate how to do her job giving her directions. Oh, and she was acting on the police's behalf at no cost to the officer. I wish I could have had a representative speak on my behalf, given that I was not in any considerable fashion someone with lawyer experience.

I wish the Qld police would make up their minds on what is acceptable.

Had I kept braking, I would have stopped over the stop line. It all came down to whether I felt I was doing the right thing.

I had a near similar situation a month after that, where I slowed from 60kmh to 50kmh for that area. I got a yellow light, where the vehicle was in a similar relative position. I quickly braked and braked heavily. I went from 50kmh to 0kmh in a short time and managed to pull up to the stop line, with the front wheels over the stop line. The difference being that I was in a smaller car and had readied myself better and was not in the process of accelerating.

The Qld police have fined me for stopping over the stop line, 20 years ago. Now, they changed their minds and will fine people for not stopping for yellow light signals. I wish that had some consistency with their rulings. This was a blatant revenue raising exercise for the police officer.

RACQ spokesperson Clare Hunter said a raft of amendments are set to occur in Queensland on July 1.

'Once again drivers will be paying more to renew their licences and they'll be out of pocket more to keep their vehicles registered. The cost of a driver licence will increase to as much as $180.70 for a five year licence,' Ms Hunter said.

Doesn't appear to me that you are capable of driving a motor vehicle safely. If you cant judge and adjust your speed appropriately going through a set of traffic lights you are dangerous to other road users.

Several years ago, a council in Sydney put up a 1 way sign on a dead end street.
A corrupt and immoral cop sat at the entrance and booked any cars who came out.
Even if 1/2 The people he booked couldn't be bothered fighting it, they made money for nothing.

Another one was when they changed the speed limit in my area overnight.
They changed the signs from 80 to 60, and didn't paint new signs on the road, just blacked it out.
The next morning, I got booked for doing 70 in a 60 zone, I stated it was 80 and I was under the speed limit.
He laughed and said "read the sign"
I explained that creates like him are what makes slugger and cockroaches look bad.
Emphasis on the cockroaches, a police name for highway patrol by regular cops.

He got quite angry and decided to go over my car for defects.
I stood back and watched as he went over everything, looking for any defect.
He found nothing.
I then told him it was a company car, and that even had he found something, it wouldn't matter as my company woukd simply fix it, so he wasted his time.

He got even angrier.
I told him I would go back down the road and warn people by pointing at the sign.
He said that was illegal, I asked him how it was illegal to point at a sign and laughed at him.

True to my word, I did exactly that.
After a while he realised that I was doing it and he came and told me to move on.
I said no, you will have to arrest me.
I laughed again and he drove off in quite a huff.

I waited around, deciding sick pay could pay for the fine, and about 1/2 hour later he came back thinking I woukd be gone, I waved at him and laughed
He was seriously pissed off, revenue was taking a hit.

I wasted a few hours listening to music and reading.
But the important thing was I pissed off a dead shite moron.

I love the school zone scam.

There is one school in Sydney that is at least 1/2 kilometre from the road that has a school zone set up.

The speed cameras in both directions are set up on a heavily trafficed road.
Whereas , where the school is, there is very little traffic.
But they won't let honesty or morals get in the way of a 24 hours, variable speed and red light camera.

The other little scam they love is the "constantly changing speed limit" scam.

From my home to the freeway (10 klm) there are no fewer than 9 speed limit changes.
One, from a 70k zone to a 50k zone and then back to a 70 k zone happens as you turn a corner.
This is a favorite to our local cockroaches.
It can be, and is fought in court successfully, because of the distances involved.
But only if you fight it
Many cannot afford to or can't be bothered to fight it, so it's quite profitable.

Speed limits in my area change quite frequently, road work, even digging a damn hole on the footpath, brings a 40 then a 15 klm/ hr speed limit.
Even when the road work is on an estate, nowhere near the actual road, our council puts up road work signs, accompanied by the resident cockroach.

Newcastle had a good one
Every holiday, they put up road work signs at a local school.
The speed camera was set up for school zone, so with the road work, they just left it there and reaped profits.
But, there was no road work.....ever.
And they got pinged.
But for years they made lots and lots of revenue.

the worst one in my opinion is when at the end of xmas holidays, teachers usually go back to school a day or two before the students to prepare lessons for the year. Go through a school zone on these day thinking your kids are still on holidays, and you'll cop a fine.

Traffic rules say speed limit in school zones is 40 when school is in. During holidays it's 50 or 60 depending on where it is.

Why book someone for doing do 50 when students aren't at school? It's a blatant money grab,

Traffic rules say speed limit in school zones is 40 when school is in. During holidays it's 50 or 60 depending on where it is.

Why book someone for doing do 50 when students aren't at school? It's a blatant money grab,


Why not just do what I do, and avoid the chance of being booked?

Plus, kids often hang around schools when school's not in.

They jump the fence and use to basketball hoops, etc.

Slow down to 40 for 100 mtrs - it ain't gonna kill ya, but it might just save someone's life.

I rarely need to look down at my speedo.

Experienced drivers know roughly what speed they're doing.

They certainly know the difference between 60 and 80 without having to look at a gauge.

see, that's just it Greg. These days 'roughly' doesn't cut it. Many years ago cops took a more relaxed attitude and would allowed up to 10% over the limit to go unchallenged. Today, go 1km over the limit anywhere near a camera and you get done like a roast dinner.

The problem was, I tried to stop for the yellow light. And had I not slowed down for the yellow light, I would very likely have exited the intersection before the lights had turned red. Then rolled over the stop line at a perceptively slow speed on dash cam footage. At that point, I accelerated off the intersection halfway through to clear the intersection, which was about the time of the red light. Alternatively, had I kept accelerating to the speed limit before the stop line, I would have got to the stop line a second after the light turned amber, and I would likely have gone through the intersection easily before the light turned red. Had I kept braking, I would have stopped over the stop line. It all came down to whether I felt I was doing the right thing.

I had a near similar situation a month after that, where I slowed from 60kmh to 50kmh for that area. I got a yellow light, where the vehicle was in a similar relative position. I quickly braked and braked heavily. I went from 50kmh to 0kmh in a short time and managed to pull up to the stop line, with the front wheels over the stop line. The difference being that I was in a smaller car and had readied myself better and was not in the process of accelerating.

The Qld police have fined me for stopping over the stop line, 20 years ago. Now, they changed their minds and will fine people for not stopping for yellow light signals. I wish that had some consistency with their rulings. This was a blatant revenue raising exercise for the police officer.


Sounds like the fine worked as intended and made you pay more attention.

If I don't look I roughly know (within 3 to 5 kph).

I DO look though, which means I keep at or below the limit.

If a driver finds it too hard to look at their speedo whilst driving, they don't belong on the road.

The $130 fine I got for "disobeying a red light signal" should have been enough. And the warning I got when I first was pulled over for a yellow light infraction should have been the end of the debate. Stopping for a yellow traffic light or arrow
(1) A driver who is approaching, or at, traffic lights showing a
yellow traffic light—
(a) must stop—

reaching, the stop line;

I read that rule as in if you have to hit your brakes heavily to stop before the stop line, you could claim that it was not going to be safe to stop for the stop line.

However, there is a section in subparagraph iii) that states:
if the traffic lights are at an intersection and the
driver can not stop safely under subparagraph (i) or
(ii), but can stop safely before entering the
intersection—before entering the intersection;

So, basically, the rule for stopping safely means that even if I did not stop safely for the stop line, I could still stop safely before entering the intersection, but over the stop line.

The magistrate pointed out that it is a traffic offence to drive through a yellow light. The only arguments that can be taken into account would be if you were a second away from reaching the stop line and would not be able to stop either for the stop line or just over the stop line. Or, if there was a car following that looked like it would not stop in time.

There is no, "had I felt that I would have stopped in the intersection, I could just keep going" judgement calls. That was what I felt was what the magistrate should have ruled. I won't like the ruling. But, that is how things will have to change for me, now.

Speed cameras are inaccurate, very inaccurate.
As I described, the method used is at best, primitive.
The R&M reject many speeding fines simply because cars cannot achieve the speeds detected.

Cops with radars are far more accurate
Set up on a tripod with correct placement, accuracies of up to 0.5 klm/hr are possible.
But how many actually set up correctly, most just hang the radar out the window, which has been proven to be quite inaccurate.

The speed camera cars are up tgere with the radars, using similar technology.
HOWEVER the mob tgat Australia uses to collect revenue were kicked out of the US for fiddling the setting to get additional revenue.
They got caught, the fines had to be refunded and the mob was kicked out .
Do you honestly think they are any better controlled in Australia?

Red light cameras.
These little beauties caused so many rear end crashes in the states, that they were also banned.
They worked out that more people were being injured in rear enders than in red light runner crashes.
We are a little better in Australia, being as we are so pussy beaten, but the cameras are still just anger revenue tool.


Now, the R&M, under the orders of the grubberment, are desperatly looking at every opportunity to fleece motorists.
Mobile phone offences ( but cops are exempt)
40k zones when the disco lights are flashing, another poorly thought out "solution" to a problem that docent exist.

It will soon be that you have to pay fines every year and get a refund if you don't do anything wrong.
More and more inventive revenue tools are still to be introduced, they are coming people.

One suggestion was a sealed GPS device which you submit every year, which records how many times you exceeded the speed limit based on GPS location.
They have to iron out the multiple speed limit changes before that little gem can be introduced.
Rego time, hand over the GPS, run it through the computer
Tgat will be $2397.00 thank you
You exceeded the limit 9 times.

Or even better
That will be $12345.00 thank you
You exceeded the speed limit 200 times.

BLOODY thieving crooks.

Speed cameras will take a photograph of your car if you exceed 10kmh over the speed limit. Unless you can prove that it was not your car, or there was another car in the photograph that there would be doubt, then you might as well pay the fine. If you contest the fine, it would have to be over a mistake made on the police's part.

Or discarded failures

They state that the cameras are calibrated.....this is a lie

The cameras have inaccuracies due to external factors, such as vibration, weather, type of vehicle etc.

If they were correctly calibrated, they woukd have to disclose
The estimate of inaccuracy and repeatability.
Every camera would have to be scrapped and all fines refunded if the truth ever got out.

My phone has the capability of determining speed, based on time and location down to the second. If you can prove that you were doing less than 10kmh an hour over the speed limit using that technology, the ticket can be withdrawn.

Despite these fines stupid people do stupid things on the road all the time. Without the fines to keep the idiots in check because a financial penalty is all they understand we would have road warrior every day on the roads. The average driver on the roads in Australia is an idiot. Western Australia is the worst probably because of all the inbreeding. NT next stupid because high percentage of retards.

I think the problem would be more that the police just bollschitt you with their readings. I got done for doing 56kmh in a 60 zone. I had been travelling through a school zone before that and was probably over the 40kmh. But, the officer wanted to do me for 56, even though I had been in a 60 zone. He may as well have got me for doing 49 in a 40 zone. I would have paid the fine with no complaint.

Who cares what happens interstate. The case I was reading was a mum driving with her kids past their local school on the last day of the schools Christmas holiday break. She knew her kids went back to school the next day. There was no reason for it to be declared a school day since the 40k speed limits are supposedly there to protect the kids and the kids weren't at school.

It's blatant revenue raising.

Consider this
You are driving down the road safely at around 60k in a 60 k zone
You come to a school zone

First you check to see what speed you are doing..1 to 2 seconds
Then you check the time of day ( is school zone operating?)....1 to 2 seconds

Then you slow down..2 to 5 seconds, unless you stand on the brakes.
Checking your speed as you go
You hit the school zone at the posted 40k everybody's happy

But in the process you have had your eyes off the road for 4 to 9 seconds

Now 60k is approx 16m per second
Multiply that by 4 seconds and you have travelled 64 metres without looking at the road
Or 9 seconds which is over 140 metres not looking at the road.

Ok you hit the school zone at 40k
happy days.
But what about the kid not crossing outside the school zone?
Or the parent crossing the road outside the school zone?
Or that car pulling out from the curb?

64 metres people, just to make sure you don't pay extra revenue to the grubberment.

It's a farce, a total farce
Conducted by a criminal , greedy grubberment department to raise revenue.

And 100 metres down the road
A kid who is desensitized to vehicles travelling at 60 k
Walks out in front of a car thinking he can beat it
Instant bloody mess.

Woukd it not
And I know this is a HUGE consideration.
But would it not, be better to teach kids to be wary of traffic and obey the road rules?

Play the ignorance card if you like but if as you say it was the last day of Christmas school holidays you can see my point above. Public/Private start and stop holidays quite often on different days. Is the software that controls these supposed to account for every school even when they can change at will? Or is it more reasonable to set the dates as a fixed thing that encompasses all school holidays and let the motorists adjust when the lights are flashing "school". Just slow down for 30-60 seconds, your life won't be affected unless you don't. First world problems are so hard to deal with.

That is irrelevant. By the time you see the sign that says 40kmh school zone, you don't take 1 to 2 seconds to check your speed, then 1 to 2 seconds to think about whether it is that time of day to be doing 40kmh through the school zone. You don't need 2 to 4 seconds to react appropriately to signage. You start dropping your speed down to 40kmh when you see the sign, and then you can reconsider whether it was the right time of day to do that speed.

I find adjusting my speed for different speed limit signage areas to be second nature for myself. Any driver with at least 5 years experience should be able to do the same.

I got one a few years ago for going 48 in a 40 zone.
I think the ticket was wrong but I just paid it.
I consider it a cost of driving just like registration.
Now I drive 30km/hr in the same area to make sure that
I can't exceed the speed limit & I have dozens of cars backed up
behind me - some tooting their horns -
but I don't care - they can all go slow so that I can avoid another fine.

I've driven through those without flashing lights, just a sign with the times, when I have had no idea of the time so I just do 40K for 30-60 seconds. It's not that hard.

On Parramatta Rd near Lewisham there is a 40 zone. There is an overpass separating 6 lanes and two sets of lights about 500 metres apart. There is a 8 ft cyclone fence to stop students climbing onto the road. The school is a high school. If you're that stupid at 12-13 years of age that you'll ignore an overpass and two sets of lights to scale an 8 ft fence to cross six lanes of one of Australia's busiest roads: you don't deserve to reach adulthood. Let natural selection do her job.
