'Franchise outlets are on notice': PappaRich operator faces allegations he underpaid 154 workers

The Fair Work Ombudsman is taking legal action against a PappaRich restaurant operator, alleging he underpaid 154 workers a total of $74,000 across three outlets in Sydney.

The Fair Work Ombudsman is taking legal action in the Federal Circuit Court against Loke Cheng Wong, manager-operator of the PappaRich franchise outlet at Macquarie Park, and former manager-operator of PappaRich franchise outlets in Chatswood and on Liverpool Street in Sydney's CBD.   Huh


The ombudsman is also taking action against two companies Mr Wong is a director and part-owner of PPR Ryde (NSW) Pty Ltd and Gateharvest Pty Ltd, for alleged involvement in some of the underpayments.

The ombudsman is alleging that between May 29 and July 2, 2017, PappaRich employees were allegedly paid flat rates as low as $13 to $14.50 per hour, which resulted in underpayment of the ordinary hourly rates, penalty rates, overtime rates and casual loadings under the Restaurant Industry Award 2010.   Sad


It is alleged that 73 employees who primarily worked at PappaRich Macquarie Park were underpaid $34,834, a further 42 employees at PappaRich Chatswood were underpaid $22,533, and 39 employees at the PappaRich Sydney CBD outlet were underpaid $16,633. Some of the employees worked at more than one of the three stores.

Fair Work Ombudsman Sandra Parker said a number of the affected PappaRich employees were migrant workers on student and working holiday visas.


“All workers in Australia have the same rights, regardless of citizenship or visa status, and we encourage anyone with concerns about their pay to contact the Fair Work Ombudsman. We have an agreement with the Department of Home Affairs where visa holders can seek our help without fear of their visa being cancelled,” Ms Parker said.

"Franchise outlets are on notice that they must pay all employees according to Australia’s lawful minimum pay rates”.

A directions hearing is listed in the Federal Circuit Court in Sydney on May 3.

The ombudsman said all employees have been back-paid in full, except for two who have not yet been located.

Well - the cash to run the nation has to come from someone.... and if all the jobs are removed, that leaves only the machine-operating businesses.... ante up, boys - the game is closing down...

Best move would be to impose - in advance - a tax on any jobs lost due to machines taking over.

Footnote:-  How then are the exploiters going to get away with saying that they are doing a great job employing people and such?  Nobody left to pay income tax.. oh, well...

Maybe a stop on R & D into such things as a deduction is a good start.... that'll slow 'em down a bit...

i think its a dumb move.
creative people are going to make ALL of those people with that mindset IRRELEVANT.
so your solution is unhelpful.

what will be helpful is to coach people to create value and change their mindset about what a job even means,

most jobs that can be automated, in food preparation, in retail, in factories, in transport are going to be automated and higher wages will see this automation occur more rapidly.

so you gweg and your doctrine are as irrelevant as the workers who hold these luddite views.

you either work on yourself and develop value which you can trade for cash or you live a life of pure garbage.

you keep telling people to try and enjoy a garbage existence.

there was a story a few years ago where under the regulations outlines in one of Abbotts FTA's, a Chinese company was able to send workers here for 6 months to run some equipment this Aussie manufacturer had bought from them, under the guise of training staff to use the equipment.

The problem was, they had that many 'trainers' running the equipment all day there was no need for any Aussie staff. Once these guys 6 months were up, the company sent another 6 trainers ... and so it continued. All the while these Chinese workers were being paid what they would have received in China, not Aussie wages.

That was the gist of the story anyway, as it was a while ago I may have gotten some of the minor details incorrect.

Australian companies do the same thing. I know of one case where an Australian company brought one Thai professional to work on the design of a project for Thailand. They paid him Thai rates plus a small premium plus accommodation and expense allowance. Much less than Australians of similar professional standing were earning on that project.
