Violent home invasion in Queensland

Rugby legend Kefu stabbed in stomach; condition critical after foiling home invasion

"Australian rugby great Toutai Kefu has been rushed to hospital in a critical condition after being stabbed in the stomach in his Brisbane home when he disturbed a burglary."

"police retrieved a knife and an axe at the crime scene and also believe a machete was used"

"Three other people were injured in the attack with a man in his 20s suffering abdominal and back lacerations, a woman in her 40s significantly injuring her arm and a female teenager with a hand injury."

Home invasion and kidnapping:

Police charge a man over alleged kidnapping of children from Blackburn North

...

A 36-year-old man was arrested at a property in Mitcham and has been charged with two counts of kidnapping, aggravated burglary, false imprisonment, and car theft.

A man has been charged with kidnapping and other offences over an incident in Blackburn North on Monday in which two children were taken from their home.
Key points:

A man allegedly abducted Adilla Wally, 5, and Bilal Wally, 3, and drove them away in their family’s black Mercedes

Police have charged a 36-year-old man with kidnapping and other offences

Victoria Police Commander Mick Frewen said the attack did not appear to be random

Police said the children were reunited with their mother after "good old-fashioned policing" led authorities to a property in the neighbouring suburb of Mitcham in fewer than 12 hours.

Before 9:00am on Monday, it is alleged a man abducted Adilla Wally, 5, and Bilal Wally, 3, and drove them away in their family's black Mercedes.

The children's 32-year-old mother was allegedly attacked at the Blackburn North home. Their father was not at the property and had been at work.

The incident sparked a massive search for the children and the vehicle, with investigators conceding they had few clues until about 4:00pm.

By 7:20pm, officers from the Special Operations Group were able to retrieve the children from the Mitcham property just before they were set to be moved to another location, Victoria Police Commander Mick Frewen said.

'A lot of unanswered questions'

Four suspects were arrested and the black Mercedes was also found.

"There's a lot of unanswered questions in this investigation," he said on Tuesday morning.

"We're still working through the motivation. We're still working through how, or if at all, the victim and these people of interest are connected.

"The children have displayed resilience well beyond their years. Obviously Mum and Dad are really happy to have them with them again."

Mr Frewen said the attack did not appear to be random.

Have you been charged with Kidnapping?

If so, you will need to engage the services of a criminal law specialist as soon as possible.

Kidnapping is an extremely serious offence, which can only be heard in the County or Supreme Courts. You should be aware that most people who plead guilty to this offence face a significant term of imprisonment to serve immediately.

The maximum penalty is 25 years in prison.

You and your lawyer will need to consider many questions before deciding how you will plead. Did you take or carry another person away? Did you use force or trick them? Did the person consent to being taken away? Did you have an excuse for your actions? Did you act alone?

All these questions and many more, need to be discussed with an experienced lawyer who specialises in criminal law. See below for further information on Kidnapping.

The offence

Kidnapping is a common law offence. It is also in Section 63A of the Crimes Act 1958.

The prosecution must prove:

    The defendant took or carried that person away;

    The defendant deprived another person of his or her liberty;

    The defendant did this by force or fraud;

    The person taken or carried away did not consent to that conduct;

The defendant acted without lawful justification or excuse.

The maximum penalty

Level 2 imprisonment being a maximum of 25 years.

Where will my case be heard?

Kidnapping cases can only be heard in the County Court or Supreme Court of Victoria.

Questions to consider

Do you have a defence?

If you are pleading guilty, what can you do to minimise your sentence? As Kidnapping is both a common law offence and an offence under the Crimes Act 1958, ensure you consult a criminal law specialist before proceeding further.

What to do next?

Consult an experienced criminal lawyer urgently.

Ensure that you don’t leave preparing for your case to the last minute. Thorough preparation is key to the success of any criminal matter.

If you have been charged with Kidnapping, get in touch today and let one of our experienced lawyers help you.

The legislation

Section 63A Kidnapping

Whosoever leads takes or entices away or detains any person with intent to demand from that person or any other person any payment by way of ransom for the return or release of that person or with intent to gain for himself or any other person any advantage (however arising) from the detention of that person shall, whether or not any demand or threat is in fact made, be guilty of an indictable offence and liable to level 2 imprisonment (25 years maximum).

It's outrageous.

What sort of people are we bringing to this country?
I wonder if the alleged kidnapper/kidnappers were born here?

...

A man allegedly demanded a $1 million ransom for the return of two young children who he allegedly kidnapped from their home in Melbourne's east.
Jiangang Ji, 36, fronted the Melbourne Magistrates' Court today, facing charges including two counts of kidnapping, trespassing, aggravated burglary, armed robbery and false imprisonment.
Police allege the construction worker tried to blackmail his boss by kidnapping his two children, aged five and three.

The Mitcham man allegedly broke into his boss' Blackburn North family home armed with a knife shortly after 8.30am on Monday.
Police alleged he bound, gagged and assaulted a 32-year-old woman then abducted her two children and stole her black Mercedes.
He was allegedly arrested more than 10 hours later, after 7pm, when he was allegedly caught putting the children back into the car.
Mr Ji's three housemates were also arrested but have been released without charge.
9News understands Mr Ji was employed by the children's father.

The court heard Mr Ji had never been in custody before, with his lawyer saying he was experiencing suicidal thoughts.
Mr Ji sobbed during his court hearing, holding his bruised face in his hands, and told a prison guard he was sorry.
Police maintain the family is still "bewildered" by what happened here and are certain they had no enemies.

They're yet to return home and are being provided accommodation by police.
The children were not injured.

Looks like he's going to try and beat the charges by pleading insanity?

...

A man accused of taking two children from their home in Melbourne's east this week demanded a $1 million ransom, according to police documents.
Key points:

Police allege Jiangang Ji assaulted a woman before stealing her black Mercedes and taking her two children
Police prosecutor Holly Baxter told the Melbourne Magistrates' Court the accused and the victim were known to each other
The case has been adjourned until December 17

The man, 36-year-old Jiangang Ji, faced the Melbourne Magistrates Court on Wednesday afternoon, sporting a black eye and appearing emotional during a filing hearing.

Mr Ji is facing charges including kidnapping, aggravated burglary, armed robbery, false imprisonment, assault and theft of a motor vehicle.

Police say the children's mother was assaulted at the family's Blackburn North house on Monday morning before Mr Ji allegedly stole her black Mercedes and took the children with him.

Mr Ji was arrested on Monday night, while two children were located by police at a Mitcham property less than 12 hours after a large-scale search began.

According to charge sheets, Mr Ji was carrying a knife at the time of the alleged attack and demanded $1 million to release the children.

Prosecutor Holly Baxter told the Melbourne Magistrates' Court on Wednesday there were three locations where investigators had seized items for analysis.

"There are three phones that need to be analysed and that is because the accused and the victim were known to each other," she said.

Ms Baxter said material on the devices needed to be translated from Mandarin.

Ms Baxter said a police hand-up brief would be prepared by November 3.

Mr Ji, who faced the court via video link, listened to the proceedings over the phone from a remand centre with the help of a translator.

After being brought into the virtual courtroom, Mr Ji shook his head repeatedly and lowered his surgical mask, revealing a large bruise over his right eye.

Mr Ji's lawyer, Sharon Healy, said it was her client's first time in custody and she asked that he be assessed by a psychiatric nurse.

No application for bail was made.

The case has been adjourned until December 17.
