Another Supreme Court appointment?
Apr 22nd, 2017 at 6:58am

Strong rumours floating around that there could be a resignation from the court in the northern summer.
The chairman of the Senate Judiciary Committee among others has hinted that an 81 year old justice may be stepping down.

An early opportunity for Trump to get another young conservative judge on the highest court bench.

Ruth Buzzy Ginsburg will die before she gives President Trump  an opportunity to appoint a conservative to replace her.

arent any of you even remotely concerned that the US supreme court rules along political lines instead of the actual law or constitution? They are unelected, unsupervised and a defacto law-making body.

LW58.....read everything you can find regarding American Constitutional History pre-colonial, up until recent times......You will find that the Founding Fathers intended the procedure to be a political process, & it is acceptable to the only ones that count in the matter......the American People.

For over 200+ years the process, & the Court has stood as it is, which means that even though the American People have the power to change the laws (the Constitution) if they felt the Supreme Court needed "regulating", the People have never sought to do so, meaning one thing......they accept the decisions of the Supreme Court ..... like them, or not ........ good, bad, or indifferent.

In the end, the will of the American People triumphs over all --- not to say that some day, in some distant century, or even tomorrow for that matter, they may choose to do otherwise. Wink

I've heard the same.....Rumor has it we will be watching the Senate vote on President Trump's second  (2nd)  Conservative Supreme Court Justice Nominee around November this year, or maybe much, much sooner.

And, may I personally predict, within the following 1 to 3 years another Justice will need to be replaced, giving President Trump yet a third  (3rd)  crack at nominating yet another Conservative Justice to the Supreme Court of the United States.......this will surely not sit well in the craw of the Progressive Left, who for many months thought SHillary Slick Willie was scheduled for a progressive royal coronation, complete with chariots & all, only to wake up to a New Sheriff in Town who spits fire, & shoots from the hip!   Grin Grin Grin

All kidding aside though, imagine that, a political outsider, President Donald John Trump, nominating 3 Conservative
Originalist
Supreme Court Justices, & because of the democrats (Harry Reid et al) they all get confirmed by the Senate within 4 years!

Who woulda thunk it??!!

“I think we’ll have another Supreme Court vacancy this summer,” said Cruz, R-Texas. “If that happens, as much as the left is crazy now, they will go full Armageddon meltdown.”

To the Conservative the Constitution is carved in stone and can only be changed by Amendment! To the liberal the Constitution is a living, breathing document to be reinterpreted at their political whim.

Yep, it will...........the best Pro-Second Amendment, Conservative, Origionalist Justice the President can find, after all it is an appointment for life, & by design it was meant to be a Political Appointment, no matter how the Left would like to spin it.  Wink

No, DonkeyBoy........I'm acutely aware of the 200+ year history of the Political Nominations made by the Presidents, & what the Founding Fathers, who wrote into the Constitution intended, when the process was implemented over 200 years ago.....which has been followed to the letter since.

The Constitution's Framers Made the Appointment Process Explicitly Political (link)

Quote:
The decision of the Senate to confirm a nominee, or not confirm him at all, is an awesome political power the Framers vested exclusively in the Senate........

........Once the Senate provides its “advice and consent” regarding the President’s nominee, that person will serve during “good behavior” — what effectively amounts to life tenure — with a salary that cannot be diminished. Short of impeachment, after the Senate gives a candidate the nod, it has no role whatsoever in how the justices exercise the “judicial power.” But until that happens, as the framers designed, the ball rests entirely in the hands of the United States Senate.

JFYI.......the person the President Nominates does not even have to be a Judge.....thought you'd like that bit of trivia...

Yes, they'd hoped he/she would be highly qualified, but every person that has ever served on the SCOTUS has been politically nominated, & politically confirmed.

I also added, for your edification, the person the President Nominates does not, yes, does not even have to be a judge, or ever served as a judge......

Quote:
The U.S. Constitution does not specify what qualifications are necessary to merit nomination to the Supreme Court. The Constitution does not even require nominees to be a certain age, gender, or even have U.S. citizenship.

Leon Friedman, a professor of political science at Hofstra University, says that, historically, presidents have chosen nominees who have a wide range of legal experience, not necessarily on the bench. "If you look at the totals of everybody that's been appointed, 47 have been federal judges out of the 110 appointed. Before the 1950s, it was rare for a judge to be picked," professor Friedman says. "Roosevelt had nine appointments to the Supreme Court. Only one was a federal judge. He picked two senators, the Attorney General, the Solicitor General [lawyer representing the U.S. government before the Supreme Court], a law professor, the chairman of the FCC [Federal Communications Commission], another person, and only one federal judge."
