Banking and financial corporations - Federalism
Apr 21st, 2017 at 4:33pm

Should banking and financial corporations come under the States?. At the moment, the Federal government makes laws for the incorporation and regulation of banks and financial corporations.

The problem with having the Federal Government regulate banking and corporations is that in the event of a financial crisis (i.e. due to lending practices), the entire country is affected; whereas if the banks were subject to State laws, then any such crisis would affect the State alone (assuming that each State has different rules for lending practices).

Of course, the Federal Government would still regulate the value of currency; and whilst this is in one sense related to banking, the majority of the laws and regulation can come under State law.
