Yes Gregg, Highest Court of Appeal in Queensland has looked at all the facts....
Correct.
Quote:and given a verdict of Manslaughter which means that they have found Gerard Guilty of Killing Alison, otherwise they would not have brought down the verdict - Manslaughter.
In very lay terms, correct. The legal position is that the Appeal Court agreed there was sufficient evidence presented for the Jury to reach that conclusion. (I disagree as I have said, but......those whose view counts took a different position.)
Quote:O.K. then they have found that he killed her but they are as clueless as you are to how this happened.
Again......basically correct.
Quote:So the three Judges in their infinite wisdom has 'hypothesised as to the manner which 'she may' have been killed.
No. Incorrect. They looked at the evidence and concluded (correctly in my view) that there were plausible alternative explanations which did not involve an intent to kill which the Crown did not disprove beyond reasonable doubt.
Quote:And on 'the gossamer' they have brought down their decision.
Incorrect. It was on 'the evidence.' The Crown must prove every element of an offence beyond reasonable doubt. They did not produce sufficient threshold evidence on intent to kill.

I'm quite sure they are too.
